Under the Labor Code, six (6) months is the general probationary
period, but the probationary period is actually the period needed to
determined fitness for the job. This period, for lack of a better
measurement, is deemed to be the period needed to learn the job.
The purpose of this policy is to protect the worker and at the same
time enable the employer to make a meaningful employee selection.
This purpose should be kept in mind in enforcing this provision of the
