SHOW CAUSE NOTICE

Dear Mr. Laborte,

You have been hired by Cebu Cargo Vessels Checkering Services, Inc. (CCVCSI) as
one of its Checkers which requires you to be at the Cebu International Port (CIP), Cebu City,
Philippines.

On the morning of 12 May 2019, you were inside the CCVCSI Office, located at the 2 nd
floor of the JSU-PSU Mariners Court, Pier 1, Cebu City for a meeting to be conducted thereon.
You were seen sitting at the President’s table at around 9 to 10 in the morning. After the meeting
was conducted, it was discovered by the President himself that the company’s money placed
inside one of the drawers in his table was lacking the amount of FIFTY THOUSAND
(Php50,000.00) PESOS. Since you were the last person seen around the area of the incident, you
were asked to shed light thereon. However, you categorically denied having sat at the President’s
table despite the reports of your colleagues to the contrary.

In view of the foregoing you are therefore being subjected to a disciplinary investigation
for Serious Misconduct as defined under the Labor Code by reason on the suspicion that you
stole the amount of Php50,000.00 (kept at the drawer of the President’s table) to the damage and
prejudice of the company. Given this, you are hereby called upon to explain in writing within
THREE (3) DAYS upon receipt hereof, as to why you should not be terminated or subjected to
disciplinary action for the aforesaid charge.

Further, your presence is requested on 19 May 2019 at 09:00 am at the CCVCSI Office,
2nd Floor JSU-PSU Mariners Court, Pier 1, Cebu City for a conference where you can further air
your side in the instant matter, present evidence in support of your defenses, and rebut the
evidence against you.

The aforesaid violation if proven true is punishable by the penalty of Final Written
Reprimand to Termination as provided under the same law. Your failure to submit said written
explanation within the period provided herein shall constitute a waiver on your part and shall
constrain Management to decide this matter based on the records and evidence at hand. Should
you wish to avail of the services of your own legal counsel, you may do so.
