State International Wrongful Act

Every state that involve in international relations system is already taking responsibility
toward the actions that they might take in future that possibly cause damages for another state.1
Moreover, the international state wrongful act has been a concern by all state that in
international relations system. As indeed that state might doing some damages that bring
United Nations the organizations that bring all state to bind in international law. In this case,
United Nations made an declarations toward the State International Wrongful Act which are
consist of 4 part, 57 article toward the law that concern on State International Wrong full act.

Furthermore, what is actually wrongful act that based on this declarations by United
Nations? According to the article 2 part 1 which stated;

“There is an internationally wrongful act of a State when conduct consisting of an


action or omission:
(a) is attributable to the State under international law; and
(b) Constitutes a breach of an international obligation of the State.”2
In this article there are two main point of wrongful act that stated which is the
attributable of one state under international law (e.g. one country has been create the treaties
about their relations which is already has an agreement between two actors and bind by the
rules that they are agreed to), in this point state that has injure the international law and cause
damages to another state this consider as internationally wrongful act by state that disobey their
treaties.

In the second point of the article that the breach of an international obligation of a state
which actually clear stated, if the state breach and violent the international law which is as well
as become international obligations for the state as state responsibility. Unless the wrongful act
that happen that base on the treaties that bind or under international law than the state will
investigated and will bind with international law or not. In the other hand, state wrong full act
that also will considered by International Court of Justice which making the decision toward
the law that might be violet, intentionally or planed.
