PREFACE

This is The Guide in the submission and accomplishment of the Monthly Report of
Cases (MRC) and the pointers to be taken for the MRC to be considered as compliant and
submitted.

We are now using the new system called E-CAMIS since January 2018. Our
objective is to be able to provide timely and accurate data with the use of this System and
the Monthly Report of Cases (MRC) received.

The source of our database is the MRC you submitted. This Guide aims to help you
in the proper accomplishment of the Monthly Report of Cases in order to have a timely
and accurate database.

This Guide also aims to help in the monitoring and evaluation of the Monthly
Report of Cases submitted, for efficient and effective administration of justice.

This Guide will be updated from time to time to be able to continuously respond to
your queries with ease. The date of The Guide will be change when updated.

The ultimate goal i.e. to provide a timely and accurate database, can only be
possibly achieved through the magnanimous and indispensable cooperation of all the
participants – mainly the accountable officers and the SRD personnel.

1) THE FORM

a) Only the forms marked with “UPDATED JANUARY 2018 ver. 2.0”
will be accepted as officially submitted report.

b) The form to be used depends on the kind of court, i.e. First Level Court,
Second Level Court designated as a Drugs Court, Family Court,
Commercial Court, or General Jurisdiction and further classified as
Single Sala Station or Multiple Sala Station.

c) Please see attached forms/file and use the applicable New Form (Annex
A – 1 to A – 6).

d) For the proper identification of the designation of their branch to


determine the form to be used in accomplishing the MRC, please contact
the Planning Division, Court Management Office, Office of the Court
Administrator at 8404-2735.

2) PAGE 1 – CRIMINAL CASES

a) Number of Pending Cases at the Beginning of the month is the Number


of Pending Cases at the End of the month of the preceding month.

In case of inventory, number of pending cases at the beginning of the


month must be based on the actual inventory. Supply footnote to that
effect by hand or type-written.

b) (For Newly Organized Courts) In the MRC submitted for the first
time, there cannot be an entry for Number of Pending Cases at the
Beginning of the Month, there can only be an entry for New Cases
Filed/Raffled. Depending on the directive of the Administrative Order,
in the report of the newly organized court where he/she is the presiding
judge, the cases of such presiding judge previously held as an assisting
judge in another branch will be reported as Number of Cases Received
From Other Court/Station.

c) Cases Decided/Resolved on the merits includes those that underwent a


full trial, cases decided not based on technicality and the like. For
example, Demurrer to evidence and plea bargain are classified as
Decided/Resolved on the merits.

d) If a case cannot be possibly classified as Decided/Resolved on the merits,


report it under Cases Decided/Resolved by way of Compromise, JDR,
etc. with the “etc”, the row becomes a “catch all” for purposes of
counting. For example, Provisionally Dismissed Cases and Mediation.

e) The case decided/disposed for the month shall be reported as such


either in Total Number of Cases Deducted III-A or III-B hence a
deduction from the pending cases at the end of the month. If such case
is appealed during the same month it was decided, report such appeal in
Page 5, Item No. XIII. A Number of Decisions Appealed To.

f) When a cases with more than one accused is decided only as to one
accused and the other accused is/are at large, the case is not yet
considered as decided. It should be reported as Pending or Archived as
the case may be.

g) Number of Cases with Detention Prisoners should not be confused with


what is asked in Page 4, Item No. VII. The Former is the count of Cases
regardless of the number of accused and the latter is the head count of
the accused, as classified in the Profile of the Accused.

3) PAGE 2 - CIVIL CASES

a) Number of Pending Cases at the Beginning of the month is the Number


of Pending Cases at the End of the month of the preceding month.

In case of inventory, number of pending cases at the beginning of the


month must be based on the actual inventory. Supply footnote to that
effect.

b) (FOR NEWLY ORGANIZED COURTS) In the MRC submitted for


the first time, there cannot be an entry for Number of Pending Cases at
the Beginning of the Month, there can only be an entry for New Cases
Filed/Raffled and Number of Cases Received From Other Court/Station.

Depending on the directive of the Administrative Order, in the report of


the newly organized court where he/she is the presiding judge, the cases

c) (FOR MRC-RTC (GJ-MSS)) The Family Court Cases, for example


Annulment of Marriage, Nullity of Marriage and Special Proceedings
involving Family Court Cases shall be reported under Other Civil Cases
(Column 18), not in Ordinary Civil Action (Column 13) AND the break
down of the Nature of the Case shall be reflected in Page 6, B. Other Civil
Cases.

d) Cases Decided/Resolved on the merits includes those that underwent a


full trial, decided not based on technicality and the like.

e) If a case cannot be possibly classified as Decided/Resolved on the merits


count it under Cases Decided/Resolved by way of Compromise, plea
bargain, JDR, etc. with the “etc”, the row becomes “catch all” for
purposes of counting.

4) PAGE 3 - CASES SUBMITTED FOR DECISION

Cases submitted for decision but not yet decided at the end of the month,
including those cases previously reported for decision but still undecided shall be
included in the list. Also included are cases with unresolved motions which may
determine the disposition of cases, i.e. Motions to Dismiss or Demurrer to
Evidence. Patent non-indication of undecided cases or unresolved motions may
constitute falsification of official document, per Administrative Circular 81-2012
(Annex B).

Promulgated Cases, Decided Cases, and Cases with Pending


Motions/Incidents other than Motion to Dismiss and Demurrer to Evidence are
not included. Cases set for promulgation are still included. Therefore, in criminal
cases, cases with decision but not yet promulgated are still considered and reported
as Cases Submitted for Decision.

For Drugs Cases the 15 days reglementary period is to be observed.

Please take note that the cases submitted for decision for the month and
decided within the same month are not included in Page 3. Decided and disposed

cases are reflected in Pages 1 as Criminal Cases Outflow and in Page 2 as Civil
Cases/other Cases Outflow.

Please refer to Administrative Circular 28 (Annex C) for guidance as to


when is the case considered submitted for decision.

a) Indicate the Title and Nature of the case.

b) For cases covered by the Rules on Summary Procedure, write Summary


Procedure under the Title and Nature of the case column.

c) It is important that date submitted for decision, the due date and other
dates required in Page 3 are specified.

d) Uniform Date Format entered in the report preferably EITHER of these


formats ONLY: 01 Jan 2019, Jan. 1, 2019 or mm/dd/yy.

e) Specify the name of the judge before whom the case was submitted for
decision.

f) If the case submitted for decision is not yet due, indicate not yet due or
still within the reglementary period to decide.

g) If the case submitted for decision is already due, please indicate the
reason for not deciding the case, for example No TSN yet (only for
inherited cases), under study or any other actual reason of the judge.

h) Number each Case Number or ADD a number column for easy counting
of cases.

i) For CONSOLIDATED CASES with the same nature of the case,


numbering could be in this manner:

1-10) Case Nos. 2018-211 to 2018-220.

j) Whenever the request for extension to decide the case has been granted
by the Court, indicate the date of Resolution and the number of
days/months of extension within which to resolve the case. This will
serve as the note under the column Reason(s) For Not Deciding the Case.

Do not change the Original Due Date of the case submitted for decision.
This is for statistical data purpose.

5) PAGE 4- MISCELLANEOUS INFORMATION

a) COUNT the number Prisoners, Mediations, Data on Probation,


Warrants, TRO, Preliminary Injunction issued by your branch for every
month, to be able to fill out the required information.

b) Number of accused indicted with a case having a Nature which does not
require posting of bail, shall be reported under Item VII, D.

c) Item No. VIII. Cases Under Mediation is an accumulated report. It


requires beginning balance for the month and the formula in this item
will derive the ending balance for the month.

d) Item No. IX. Data on Probation is an accumulated report. It requires


beginning balance for the month and the formula in this item will derive
the ending balance for the month.

e) In Item No. X, the reporting is monthly and not accumulated.

Item No. X, B. Warrants of Arrest, 1. Number of Warrants of arrest


issued during the month – These are warrants of all kind, be it Warrants
of arrest, Alias Warrant or Bench Warrant, issued by the court during
the month.

Item No. X, B. Warrants of Arrest, 2. Number of Warrants of arrest


Recalled within the month, only requires the number of Recalled
(Binawi) Warrants within the month. It should not be confused with the
Returns of Warrants of Arrest not successfully served.

Item No. X, B. Warrants of Arrest, 3. Number of Warrants of arrest


Pending at the end of the month – Pending warrant are those in which
cases are for issuance of warrant but not yet issued and released by the
court for service under any circumstances.

f) Item No. X, C. 1. TRO and Preliminary Injunction issued during the


month should tally with the entry in Page 2, Item V.

g) Indicate zero (0) whenever there is no case or no data.

h) It is a MUST to keep a Log Book or Record Book or any form of recording


for easy counting.

i) (FOR FIRST LEVEL COURTS) Item No. XII – Aging of Pending


Cases. In computing the Aging of Civil Cases, please consider Page 2 of
the MRC: Small Claims (col. 12), Other Cases under Summary Procedure
(col. 14) Cases under Regular Procedure (col. 15) as Ordinary Civil
Action; Ejectment (col. 13) as Special Civil Action; Election (col. 16),
Other Civil Cases (col. 17) as Other Civil Cases. Please see also MRC FLC
Form, sheet 6 for the illustration (Annex A – 1).

j) (FOR SECOND LEVEL COURTS) Item No. XII – Aging of Pending


Cases. In computing the Aging of Civil Cases, please consider Page 2 of
the MRC: Election (col. 16); Land Registration Cases (col. 17); and Other
Civil Cases (col. 18) as Other Civil Cases. Please see also MRC New Form,
sheet 7 or Sheet 8 for the illustration (Annex A –2 to A-6).

a) Item A. Number of Decisions Appealed to, this refers to


decided/disposed cases that are appealed for the month.

When the Appealed Case is already decided by the Appellate Court, the
said decided Appealed Case will be reported in Page 5 as either Affirmed,
Modified or Reversed.

b) Item B. Number of Interlocutory Order/Decisions Elevated on


Certiorari, this refers to a case that is not decided/disposed.

c) Item XIV. A, of Page 5 - In counting the Number of Days of Court


Session, the day when the judge is having an actual hearing with the
parties and/or counsel shall be considered, be it half day or whole day.
A mere resetting is not considered as a court session.

This is for statistical report purposes only and will not affect the days of
work of the judge and court personnel.

d) Answer responsively Item XIV. B, of Page 5 (for 2nd level courts) and
Item XIV. B, of Page 5 (for 1st level courts). Indicate NONE if no hearing
outside regular station. Do not leave it blank. It does not ask for the court
address.

For example, sessions held at the New Bilibid Prison, Muntinlupa City
or Correctional Institution for Women (CIW).

e) Underline the applicable designation of the Judge whether as


Presiding/Pairing/Acting/ Assisting Judge and that of the Clerk of Court
as Branch Clerk of Court/Officer-in-Charge.

f) Indicate the mobile number of the Judge and the Clerk of Court opposite
their names. This is intended for easy communication and follow up
regarding caseloads, request for travel authority and submission of the
MRC among others.

g) For Acting Judge and Assisting Judge indicate the Administrative Order
Number/Administrative Matter and Date below the name of the Judge.
And check the box/s for the scope of authority of the Assisting Judge.

h) Specify the position/designation of the Administering Officer.

i) The Authorized Administering Officer is a judge, public prosecutor or


notary public, in the order.

Clerks of Courts, Mayors and other LGU officials and PAO Lawyers are
not authorized signatories as administering officer.

j) For those who are using stamps for the names of the signatories, make
sure that it remains readable after scanning the report.

Type written name and designation is still preferred.

k) Ensure that the scanned report is dated and bears the signatures of the
authorized signatories.

l) In case the Judge (presiding/acting/assisting/pairing) or Branch Clerk


of Court is on leave and was not able to sign the MRC, please indicate
beside the name of the judge or branch clerk of court - (on leave and the
duration of leave) in order to submit on time the MRC. Then, E-mail
again the signed MRC after the return of the said judge or branch clerk
of court.

m) The capacity of the Pairing Judge in signing the MRC must be clear
as to its extent. It must be known if such signature of the Pairing Judge
is only because of the absence of the incumbent judge, vacancy of the
judge position or because the Pairing Judge is actually hearing and
deciding the case. This is to properly monitor and account the
performance of Pairing Judge. In doing so, please note said
circumstance beside the name of the Pairing Judge.

7) PAGE 6 – LIST OF OTHER CASES (if applicable)

a) Indicate the number of Pending Other Criminal cases at the end of the
month and/or Pending Other Civil Cases at the end of the month as
reflected in Pages 1 and 2 of the MRC.

The Grand Total should tally with the Sum of the Total of the respective
columns in pages 1 and 2.

b) In Items A and B, write the Nature of the Case of the Other Criminal
Cases falling under either the Family Court, Drugs Court, Commercial
Court or Others with their respective break down.

Based on the above example, the Number of Pending Cases at the


end of the month reflected in Column 11 of Page 1 should also be 75 and
the Number of Pending Cases at the end of the month reflected in Column
18 of Page 2 should also be 40, so that Page 6 will tally with Pages 1 and 2
of the respective columns. Hence, when you add the entries in Column 11
and Column 18, the Grand Total should be 115 in Page 6.

8) THE E-MAIL

a) The email address of each region is intended only for the submission of
the Monthly Report of Cases (MRC) addressed to the Statistical Reports
Division, Court Management Office, Office of the Court Administrator.

b) This email address cannot accommodate your other reportorial


requirements for this Office or other Offices except for the Children
in Conflict with the Law (CICL) Data required under OCA
Circular No. 120-2019 (Annex D) to be submitted by the
Family Courts.

The Quarterly Report on the CICL Cases Undergoing Diversion, as


addendum to the Monthly Report of Cases shall be saved in a separate
PDF File with the proper PDF File Name. This is for management of
emails received.
For example, PDF File Name:

c) Do not send the Semestral Docket Inventory Report through this e-mail
address.

d) Those stations where courts were assigned as assisting courts, the report
as assisting or assisted court cannot be accommodated in this e-mail.
You may give/furnish the copy of such report directly to the assisting or
assisted court. ONLY THE MRC OF YOUR BRANCH IS REQUIRED
AND ACCEPTED IN THIS E-MAIL. (Please disregard this if not
applicable in your branch/station).

9) SCANNED REPORT

a) All pages in the MRC must be scanned in landscape orientation in


Legal size (8.5” x 14”) or Folio size (8.5” x 13”).

b) Only pages 1 to 5 (first level court and single sala second level courts) or
pages 1 to 6 (second level court) of the MRC must be scanned.

c) Scan properly the MRC to avoid submission of inadvertently cut and


incomplete reports.

d) Make sure that the scanned copy of the report is clear and readable
before attaching it to the email. Note that in our part, the report you
emailed/submitted is to be printed before encoding.

10) PDF FILE ONLY

a) Save the scanned MRC in a single filename and in PDF (only pages 1 to
5 or pages 1 to 6 of the MRC whichever is applicable).

b) One MRC one PDF File.

c) MRC in JPEG, EXCEL or any other format is not allowed and is not
considered submitted.

11) SAVED PDF FILE NAME

a) PDF File Name should be done in this manner:


JAN 2018 RTC BR 5 CEBU.

b) If Amended Report – AMENDED JAN 2018 RTC BR 5.

c) If Re-amended Report – AMENDED 2 JAN 2018 RTC BR 5.

d) Add PJ (Surname of the Judge) after the branch number for a branch having

12) COMPOSING E-MAIL

a) In composing the email, write in the SUBJECT portion the File Name.
E-mail Subject: JAN 2018 RTC BR 5 CEBU.

b) If Amended Report,
E-mail Subject: AMENDED JAN 2018 RTC BR 5 CEBU.

c) If Re-amended Report,

E-mail Subject: AMENDED 2 JAN 2018 RTC BR 5 CEBU,


and so on.

d) Add PJ (Surname of the Judge) after the branch number for a branch having
more than one judge. This is for the management of emails received and
sent.

Example: JAN 2018 RTC BR 53 LAPU-LAPU PJ MILITANTE

IN SHORT, THE PDF FILE NAME AND THE E-MAIL SUBJECT ARE THE SAME.

This is for convenient monitoring and review of the reports attached and e-mailed.

13) NO ATTACHMENT

a) List of cases, copies of orders, decisions and the like should not be
included in the scanned report to be e-mailed.

However, each court is required to retain as its own file copy, the copies
of the orders, decisions and the like for the court’s record keeping.

b) No need to scan and attach the transmittal/cover letter. You may


however compose it in the e-mail.

14) BLANK ENTRY NOT ALLOWED

a) Reports with blank or incomplete entries will be considered as not


submitted and an amended report must be sent.

b) All items/entries must be properly filled out in all pages.

15) ONE OFFICIAL E-MAIL ADDRESS PER BRANCH

a) It is a MUST that an e-mail address bears the branch number and


station for easy identification and management of emails. NO MORE
EXCUSES. For example br_30_rtc_dumaguete@y.c.

b) In creating an e-mail address, use the Branch Number and Station as the
Sender Name and not the name of the person creating the e-mail.

For those with existing e-mail address bearing the branch number and
station but still in the name of the person creating it, you may Edit the
Account Information by changing the Sender Name by following the
instructions below.

Log in to your e-mail account

Click the Settings menu icon | More Settings.


Click Mailboxes.
Select the account you want to edit.
Click under 'Your name' to delete or edit your sending name.
Click Save.

Log out your account and then Log in again to see the changes.

c) Avoid using personal e-mail address. Maintain only one email per
branch/sala.

d) Notify the Area-In-Charge for every change of e-mail address.

16) ONE E-MAIL ONE REPORT

a) One e-mail for each Monthly Report of Cases.

b) Do not combine the Monthly Reports of Cases in one file name and/or
one email for easy identification of the report submitted and
management of reports received.

17) AMENDING THE MRC

a) In amending the report, please WRITE the word AMENDED in the


upper/ top portion of the report as part of the title Monthly Report of
Cases in Page One only or in all pages, at your convenience.

b) The word AMENDED can be hand written or type written. Note that in
our part, the report you emailed/submitted is to be printed before
encoding

c) Highlight or identify the amended item or entry by


encircling/underlining the item or entry, whichever is applicable for
easy identification.

18) SENDING THE E-MAIL OF THE AMENDED REPORT

a) Be sure to e-mail the entire report. For example, if amendment is only


for Page 3, send the entire report from pages 1 to 6 or 1 to 5 whichever is
applicable.

b) Do not send the amended page only. Do not forget to let the three
authorized signatories sign the amended report.

c) Please do not send or resend the report through reply to preserve the
email subject. Each time you send or resend a report, please create or
compose a new mail.

19) ADDITION AND SUBTRACTION

a) Please be mindful of the addition and subtraction of numbers.

b) Break down should tally with the total or grand total.

c) Pending Cases at the beginning of the month plus the cases added (in
case inflow) should be equal or greater than the cases deducted (in case
outflow). No negative value should be reflected in the Total Number of
Pending Cases in each column, for example (-1 or -4).

d) In case the formula of the form being used has been corrupted, such that
auto sum is no longer working or different total comes out or entries
cannot be encoded, please ask the Area-in-Charge for a new copy of the
form.

20) FOOTNOTES

a) READ THE FOOTNOTES thoroughly in every page of the report for your
guidance.

21) SEPARATE MRC FOR EACH JUDGE IN A BRANCH

a) For Branches having more than one judge, for instance, there is a
Presiding Judge or Acting Presiding and one or more Assisting Judges,
MRC should be prepared separately for each of the said Judges, hence,
there will be two or more MRCs to be submitted each month for such
Branches.

b) In cases of inhibition:

i. where the inhibited case is heard in the same branch, there


should be a separate report for the judge handling the said
inhibited case even if it is the sole case.

ii. where the inhibited case is re-raffled and transferred to


another branch, the said case should be deducted from the
docket and report in the Out Flow as transferred to other
court/station/branch in Page 1 or Page 2 whichever is
applicable.

c) In cases under OCA Circular No. 149A-2018 (Annex F):

i. Where the case submitted for decision will be decided by


the judge before whom it was submitted for decision who
is now transferred/ detailed or promoted to a different
court/station, within the same province or outside of the
province in the judicial region, the clerk of court/branch
clerk of court where the case is docketed, shall

prepare a separate report in order to account the


performance of the deciding judge.

For purposes of reporting the case submitted for decision,


the said judge shall be designated as “assisting judge” in
the E-CAMIS.

ii. In preparing the MRC of the above mentioned judge, there


shall be no entry in Item II – TOTAL NUMBER OF CASES
ADDED in Pages 1 and 2.

The count of cases submitted for decision shall be the


NUMBER OF PENDING CASES AT THE BEGINNING
OF THE MONTH in Item I of Page 1 and 2.

Whenever a case if finally decided or resolved, it shall be


reported in Item III – TOTAL NUMBER OF CASES
DEDUCTED, hence will decrease the number of pending
cases at the end of the month.

Please provide a footnote (hand/type written) in


Page 1 and 2 explaining the adjustments in the
Number of Pending Cases at the Beginning of the
Month in the report; that it was transferred to the
“assisting judge” handling the his/her cases
submitted for decision.

22) DUE DATE FOR THE SUBMISSION OF THE MRC

a) The MRC must be submitted within the first ten (10) days of the
succeeding month.

b) Prompt submission of the MRC is encouraged as the updated MRC is


vital in the issuance of Travel Authority and in the release of Certificate
of Clearance, etc. of the judges and accountable officers.

23) ACKNOWLEDGEMENT RECEIPT OF MRC

a) Acknowledgement receipt of the MRC submitted will be sent only after


viewing of the report by the Area-in-Charge.

24) SANCTION FOR NON SUBMISSION AND DELAYED


SUBMISSION OF THE MRC

a) Accountable Officers will be sanctioned by withholding of salary for non-


submission and submission of MRC with incomplete or inaccurate
entries. Please refer to Administrative Circular No. 81-2012 for details
(Annex B).

POSTFACE

The Area-in-Charge (AIC) evaluates the MRC e-mailed. Submit immediately an


amended report in case any errors are detected and re-email your MRC. Notify or message
the AIC of your region via email or phone call in the event of delay in the submission of
the reports.

Those branches/sala with pending compliance or already delayed reports for the
period covering January 2018 to November 2019, use the “UPDATED JANUARY 2018
ver. 2.0” in accomplishing and submitting the said reports.

Please ask/contact the Area-in-Charge for any other concerns not addressed here
regarding the accomplishment of the MRC.

For continuity of accurate and updated MRC, please print this Guide and provide
the other personnel of your branch helping in the preparation of the MRC.
