CONTRACT TO SELL

OF A PORTION OF A PARCEL OF LAND


 
KNOW ALL MEN BY THESE PRESENTS:

This CONDITIONAL SALE is made and executed by and between:


 
       HELEN T. ESPIRITU, of legal age,  Filipino, married to HILARIO
ESPIRITU, and with postal address at  Purok 01, San Jose, Gonzaga,
Cagayan, hereinafter referred to as the "SELLER ";
 
-AND-
 
AVARICHES BUILDERS AND REALTY CORPORATION, a
domestic corporation duly organized and existing by virtue of the laws of
the Republic of the Philippines, with office address at 525 Don Juico
Avenue, Brgy. Malabanias, Angeles City, Filipino, represented by Richard
Rivera, hereinafter referred to as the "BUYER". 

WITNESSETH;
 
WHEREAS, the SELLER is the registered owner of a parcel of land specifically
located at San Jose, Gonzaga, Cagayan WITH ORIGINAL CERTIFCATE OF TITLE P-
77075 hereinafter referred to as the PROPERTY;

WHEREAS, the SELLER offered to the BUYER the purchase of a portion of the
above mentioned property with total area of eighth thousand nine hundred twenty-one
(8921) square meters more or less and the latter accepted the same;

        NOW, THEREFORE, for and in consideration of sum of FIVE MILLION THREE
HUNDRED FIFTY TWO AND SIX HUNDRED (Php 5,352,600,000) PESOS, shall be
paid by the BUYER to the SELLER in the manner herein below specified, the SELLER
hereby cede, transfer and convey, by way of CONTRACT TO SELL unto BUYER, her
heirs, assigns and successor-in-interest the above-described property in full compliance
of the following terms and conditions:

1. The BUYER shall pay the down payment amounting to FIVE HUNDRED
THOUSAND (Php 500,000) PESOS to the SELLER on or before January 31, 2023
by way of post-dated check.

2. The BUYER shall pay the remaining balance of the total contract price
amounting to FOUR MILLION EIGHT HUNDRED FIFTY TWO THOUSAND
AND SIX HUNDRED (Php 4,852,600) PESOS to the SELLER on through the
following manner.

a. The BUYER shall pay the first half of the balance amounting to TWO
MILLION FOUR HUNDRED TWENTY SIX AND THREE HUNDRED
(PHP 2,426,300) PESOS on or before June 20, 2023 by way of post-dated
check;
b. The BUYER shall pay the second half of the balance amounting to TWO
MILLION FOUR HUNDRED TWENTY SIX AND THREE HUNDRED
(PHP 2,426,300) PESOS on or before December 20, 2023 by way of post-
dated check.

3. The SELLER shall execute in favor of the BUYER or his heirs, successors/s or
assigns Deed of Absolute Sale and other pertinent documents of the
aforementioned land upon full payment of the purchase price under this Deed.

4. Notice to the BUYER mailed at her address as provided hereinabove shall be


considered as sufficient compliance with the above requirements for purposes of
this Contract to Sell.
