CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT made and entered into this 1st day of January 2019 at the City of
Legazpi by and between:

AAAAA, Filipino, of legal age, married with residence and postal address at PINAS,
hereinafter referred to as the LESSOR;
AND
BBBBB, Filipino, of legal age, married, a resident of PINAS, hereinafter referred to
as the LESSEE;
WITNESSETH:
1. LEASE OF THE PREMISES: LESSOR leases unto LESSEE the premise
located at _____________________, and more particularly described as
follows: a One house/unit, in good tenantable condition;

2. TERM: The term of the lease shall be for a period of one (1) year beginning
from 1 January 2019 and to expire on midnight of 1 January 2020. Renewable
upon such terms and condition mutually acceptable to the parties.

3. RENTAL FOR THE PREMISES: LESSEE shall pay the LESSOR a monthly
rent of 6000, Philippine currency during the entire term of the lease without
the necessity of demand. Payment of the said rent shall be made on or before
the due date of each month with 3% interest for non-payment on the said due
date.

4. DEPOSIT: Upon the execution of this Agreement, the LESSEE shall pay the
LESSOR by way of the deposit the amount equivalent to one (1) month rental
and another amount equivalent to one (1) month-rental as advance rental.
The deposit shall not be used or applied by the LESSEE as payments for
rentals which had become due or may be due during the entire period of the
lease but the same shall be exclusively used for payments for whatever
damages on the premises resulting from the use and occupancy of the leased
premises or for any unpaid account to a third party relative to and in
connection with the lease such as bills for electric, water, telephone, and the
like.

5. USE OF THE LEASED PREMISES: The leased premises shall be shall be


solely as a residence of the LESSEE and his family. No improvements shall
be introduced on the premises without the written consent of the LESSOR.

Any improvement introduced by the LESSEE shall be removed by the
LESSEE if the same is possible without damaging or destroying the original
appearance of the leased premises, otherwise, the same shall remain or
become owned by the LESSOR without any liability of reimbursement for
costs and expenses thereof.

6. MAINTENANCE OF THE LEASED PREMISES: The LESSEE shall at his own


expense maintain and keep the leased premises in good and tenantable
condition. Upon termination of the lease contract, the LESSEE shall
peacefully surrender and deliver possession of the premises to the LESSOR
in the same condition as leased excepting the effects of ordinary wear and
tear.

7. DEFAULTS AND REMEDIES: In case of default be made by the LESSEE in


the payment of rentals, or any bills due thereon, or any failure on the
performance of duties contained in this agreement, or any violation of any
terms and conditions thereof, the LESSOR after due notice to the LESSEE
may be required to vacate the leased premises forfeiting the deposits. Upon
due process, the LESSOR may opt (1) To collect, by suit or otherwise, any of
the rents due either judicially or extrajudicially; (2) to padlock and re-enter the
premises removing or ejecting all persons therefrom, take possessions of all
equipment, fixtures and personal properties that may reasonably answer
whatever damages, unpaid rents, bills or monies owing the LESSOR.

8. ASSIGNMENT AND SUBLETTING: Assignment and subletting the whole or


any part of the leased premises is strictly prohibited.

9. ATTORNEY’S FEES: In case litigation is brought or commenced by the


LESSOR against the LESSEE relative to and in connection with the contract,
the LESSOR shall be entitled for the reimbursement of his attorney’s fees not
less than twenty-five percent (25%) of the sum claimed and demanded.

10. HOLD OVER: If the LESSEE shall hold over the leased premises after the
original term had expired, such holding over shall be considered as a lease on
a month to month basis, upon the same terms and conditions herein
contained, expect that the LESSOR shall have the right to increase the rentals
by at least seven percent (7%).
