APPLICATION FOR PROBATION

COMES NOW accused, ABC, by counsel, unto this Honorable Court,
most respectfully applies for Probation and manifests as grounds the
following:

Accused was found guilty and was sentenced by the Honorable Court
to suffer the INDETERMINATE PENALTY OF TWO (2) YEARS, FOUR
(4) MONTHS OF PRISION CORRECCIONAL AS MINIMUM TO FOUR
(4) YEARS, NINE (9) MONTHS TEN (10) DAYS OF PRISION
CORRECCIONAL AS MAXIMUM and to pay a fine of TWENTY
THOUSAND PESOS (P20, 000.00) with subsidiary imprisonment in case of
insolvency;

The crime to which the accused is convicted is not a crime against

National Security or Public Order;

Accused has not been previously convicted by final judgment of any

offense punishable by imprisonment of not less than one month and one day
and/or fine of not less than two hundred pesos;

Accused has not been once placed on probation under the provisions
of Presidential Decree No. 968, otherwise known as the Probation Law of
1976, as amended;

He has all the qualifications and none of the disqualifications for

Probation;

 He believes in the Probation program of the government and if his
Petition will be granted, he shall abide by all the terms and conditions of
Probation.

PREMISES CONSIDERED, it is most respectfully prayed of this

Honorable Court that the Petition for Probation be referred to the Parole and
Probation Officer for the requisite post-sentence investigation and thereafter,
the petition for probation be granted.

Other reliefs just and equitable in the premises are likewise sought.
