1. GENERAL

1.1. Purpose

1.1.1. The purpose of this document is to define the specific technical characteristics that must be complied with in
the Design, Manufacture and Inspection of pressure equipment intended for installation in Spain and the
remaining Member States of the European Union (UE) as defined by the indicated Directive. European
Pressure Equipment Directive 97/23/CE (PED), in Spain transposed to the Royal Decree 769/1999, dated May
7 1999, (RD/PED), which establishes compulsory requirements for the design, manufacture, conformity
assessment, and marking of pressure equipment and assemblies that are to be traded in the European Union
(UE), whether these were manufactured in a Member State or in non-Member States, and that are to be
installed in the European Union (UE).

1.1.2. This specification makes special reference to the RD/PED, which is the applicable legislation for pressure
equipment intended for installation in Spain. However, when the equipment is going to be installed in another
Member State of the UE, the proper legislation of such State, which transpose the PED, shall be applied in
substitution of the citations to the RD/PED referred to in this document.

1.1.3. This document makes up an “Addendum” to the REPSOL YPF specifications related to any pressure
equipment, being such understood as any vessel, piping, safety accessory, and pressure accessory, as well as
any assembly formed by the foregoing components that is included within the scope of application of the PED
and/or the RD/PED, and which as such, must be considered as complementary to it. In principle, the
corresponding specifications, providing that the following list can not be considered as complete, are:
• Pressure Vessels (ED-C-01.00-I).
• Storage Spheres (ED-D-02.00-I).
• Shell and Tube Heat Exchangers (ED-E-01.00-I).
• Surface Condensers (ED-E-02.00).
• Plate Heat Exchangers (ED-E-03.00).
• Air Cooled Heat Exchangers (ED-E-04.00-I).
• Fired Heaters (ED-F-01.00-I).
• Power Boilers (ED-F-02.00-I).
• Pressure Relief Valves And Rupture Disks (ED-J-18.00-I).
• Design of the different instruments that must be considered as safety or pressure accessories (ED-J-
XX.XX, X being = 0 ÷ 9).
• Piping Design for Process and Service Units and Auxiliary Facilities (ED-L-01.00-I).
• Pipe and Instruments steam tracing (ED-L-03.01).
• Jacketed Steam Pipe (ED-L-03.02).
• Steam traps (ED-L-04.00).
• Pipe Supports (ED-L-06-00).
• Fire Detection and Protection against Fire Systems (ED-S-02.00).

1.1.4. Additionally, this document also complements the addendums of the specifications indicated above and all
those specifications indicated as required by the above, such as for example, ED-B-02.00-I or ED-B-05.00-I.
Likewise, it complements mechanical equipment specifications with regard to their components or auxiliary
groups subjected to pressure.

1.1.5. This Addendum ED-C-01.01 shall prevail should any conflict arise with applicable REPSOL YPF Specifications.

1.1.6. In the event that two or more Addenda apply to a certain equipment, in those points where possible
discrepancies may arise, the most restrictive ones shall apply.

1.1.7. Any exceptions, variations or additions that involve any change to this Addendum must be notified to REPSOL
YPF in writing and accepted by the said company.

1.1.8. Compliance with the rules and recommendations established by this Addendum does not exempt neither the
pressure equipment Manufacturer nor the Notified Body (NB) partially or totally from their contractual and/or
legal responsibilities and guarantees.

1.1.9. The requirements established by REPSOL YPF Specifications are considered as the minimum ones to be
complied with by purchased pressure equipment and assemblies, regardless of any additional requirements or
criteria that the Manufacturer or Notified Body (NB) may establish in order to comply with the PED and/or
RD/PED.

1.1.10. Any interpretation of the PED and/or al RD/PED done by the Manufacturer and/or NB contrary to that
established by this Addendum or that is not covered in the same, must be notified to REPSOL YPF for its
knowledge and review, prior to its implementation on the affected equipment or assemblies. The mentioned
notification shall include the corresponding interpretation duly justified and reasoned. Subsequently, those that
affect equipment design shall be included in the design dossier.

1.2. Definitions

With the purpose of clarifying several terms mentioned throughout the current Addendum, and in order to
establish contents, obligations, and responsibilities of physical and/or legal persons, as well as documents, the
following are defined as:

1.2.1. Pressure Accessories: those devices with operational purposes having pressure-bearing housings.

1.2.2. Safety Accessories: those devices intended for the protection of pressure equipment in the event that the
allowable limits being exceeded. These devices may be:
• Devices for direct pressure limitation, such as safety valves, bursting disc safety devices, buckling
rods, and controlled safety pressure relief systems (CSPRS).
• Limiting devices that activate intervention means or provide for shutdown or shutdown and lockout,
such as pressure switches, temperature switches or fluid level switches, and “safety related
measurement control and regulation (SRMCR)” devices.

1.2.3. Particular material appraisal: document issued by the Manufacturer, if the equipment is category I or II, or by
a Notified Body (NB), if it is category III or IV, to declare that the materials standards or specifications to be
installed on a specific pressure equipment are suitable for it, and comply with the Essential Safety
Requirements that affect it.

1.2.4. European Approval for Materials (AEM): a technical document that defines the characteristics of the
materials intended for repeated use in the manufacture of pressure equipment, and which are not covered by
any harmonized standards.

1.2.5. Assemblies: several pressure equipment assembled by one Manufacturer to constitute a functional
installation, such as Packaged Units or Plants acquired under the “turn-key” mode, being such assemblage
and the obtained assembly subject to RD/PED. See the definition of Facility in order to discern the difference
between both.

1.2.6. Nominal Diameter (DN): A numerical identification of the diameter common to all the elements in a piping
system, other than elements indicated by outside diameters or by thread gauge. For reference purposes it shall
be a rounded number, without being strictly related to manufacturing dimensions. It shall be designated with
the letters DN followed by a number. Table 1 is included as a reference with indications on the DN to be
considered taking into account that the sizing standard is ISO 4200 or ASME B36.10 / B36.19.

1.2.7. Recognized Independent Organization: An independent organization designated by a Member State, in


accordance with PED and RD/PED Article 13, in order to comply with the tasks established in points 3.1.2 and
3.1.3 in Annex 1 of the same.

1.2.8. Pressure Equipment: the vessels, piping, safety accessories and pressure accessories. Considered as
forming part of the pressure equipment the elements attached to the parts subjected to pressure, such as
flanges, nozzles, couplings, clamps, supports, lifting lugs, etc.

1.2.9. Manufacturer: according to the Guide to the implementation of directives based on the New Approach and the
Global Approach, the Manufacturer is any natural or legal person responsible for the design and manufacture
of a product with a view to placing it on the Community market on his own behalf. The Manufacturer’s
responsibility apply also to any natural or legal person who assembles, packs, processes or labels ready-made
products with a view to their being placed on the Community market under his own name. The Manufacturer
may subcontract its activities partially or totally, but cannot in any case decline its responsibility. He must
always retain the overall control of the pressure equipment and make sure it has received the information
required in order to comply with its responsibilities in accordance with the PED and/or RD/PED.

1.2.10. Fluids: gases, liquids and vapors in pure phase as well as mixtures thereof or mixed phase. A fluid may
contain suspended solids.

1.2.11. Facility: several pressure equipment assembled under the responsibility of the User to constitute as
integrated and functional whole. Such assemblies are not subject to the RD/PED. See the definition of
Assemblies in order to discern the difference between both.

1.2.12. Harmonized Standard: a technical specification adopted by European Standardization Organisms (CEN,
CENELEC and ETSI), declared as such for PED purposes by the European Commission and published in the
Official Journal of the European Communities (DOCE), which compliance, though is not compulsory, gives the
so called presumption of conformity to the PED Essential Safety Requirements that said standard covers or
makes reference to.

1.2.13. Notified Body (NB): an Organism designated by a Member State, in accordance with Article 12 of the PED
and RD/PED, to perform the procedures referred to in Article 10 (Conformity assessment), and Article 11
(European Materials Approval), as well as the specific tasks which those bodies have been appointed to carry
out.

1.2.14. PED: European Parliament and Council Directive 97/23/CE, dated May 29, 1997, related to the new approach
to the Member State Legislation about Pressure Equipment. DOCE Ns L181 dated 9.07.97 and L265 dated
27.09.97.

1.2.15. Pressure: the pressure relative to atmospheric pressure, that is, gauge pressure. Consequently, vacuum is
designated by a negative value.

1.2.16. Maximum Allowable Pressure (PS): the maximum pressure for which the equipment is designed, as specified
by the Manufacturer. It shall be defined at a location specified by the Manufacturer. This must be the location
of connection of protective and/or limiting devices or the top of the equipment or, if not appropriate any point
specified.

1.2.17. RAP: in the case of Spain it is Royal Decree 1244/1979, dated April 4, 1979, which approved the Regulation
for Pressure Devices.

1.2.18. RD/PED: in the case of Spain it is Royal Decree 769/1999, dated May 7, 1999, which decrees the applicable
dispositions of European Parliament and Council Directive 97/23/CE, related to Pressure Equipment, and
which modified Royal Decree 1244/1979, dated April 4, 1979, which approved the Pressure Devices
Regulation. BOE number 129, dated May 31, 1999. For the case of another Member State of the European
Union (UE), the same must be substituted by the legislation of such state that transpose the PED.

1.2.19. Vessel: a housing designed and manufactured to contain fluids under pressure, including its direct
attachments up to the coupling point connecting it to other equipment. A vessel may be composed of more
than one chamber.

1.2.20. User Representative: Natural or legal person that, with the authorization of the User, acts in its name for
those matters cited in the current specification.

1.2.21. Minimum design metal temperature (TMDM): a minimum design metal temperature shall be defined for
every pressure equipment, which shall be the basis for establishing the necessity of impact strength for the
materials and welds of each equipment. The minimum metal temperature shall be equal to that required by the
applicable code.

1.2.22. Maximum (TSmax) / Minimum (TSmín ) allowable temperature: the maximum and minimum temperatures for
which the equipment is designed, as specified by the Manufacturer.

1.2.23. Piping: the piping components intended for the transport of fluids, when connected together for integration into
a pressure system. Piping includes, specifically, a pipe or pipe system, tubing, fittings, expansion joints, hoses
or other pressure-bearing components as appropriate. Heat exchangers consisting of pipes for the purpose of
cooling or heating air shall be considered as piping.

1.2.24. Permanent Joints: joints which can not be disconnected except by destructive methods.

1.2.25. User: REPSOL YPF and the company of the REPSOL YPF group to which the equipment is destined. New
approach Directives to the legislation do not establish obligations for the User, except those related to the
commissioning of the equipment.

1.2.26. Volume (V): the internal volume of a chamber, including the volume of nozzles to the first connection or
welding and excluding the volume of permanent internal parts.

1.3. Scope of application

1.3.1. PED and RD/PED apply to the design, manufacture, and conformity assessment of pressure equipment and
assemblies with a maximum allowable pressure PS greater than 0,5 bar.

1.3.2. The PED and RD/PED are applicable when pressure equipment and assemblies are intended for trading and
installation in European Union (UE) Member States, independently of whether the country of manufacture is or
not a Member State.

1.3.3. The PED and RD/PED are also applicable to all new equipment purchased or traded on, after May 29, 2002,
date on which the transitional period finished, for the substitution of existing equipment. Even though their put
into service had been prior to the date of legal validity of the RD/PED.

1.3.4. European Pressure Equipment Directive 97/23/CE (PED), for application in Spain has been transposed to the
Royal Decree 769/1999, dated May 7, 1999, (RD/PED). Since the RD/PED which transposes the PED do not
reflect textually the entire contents of it, the following points must be taken into account:
• When a Manufacturer intends to apply any one of the 27 initial postulates of the PED that are not included
in the RD/PED, such application shall be justified and endorsed by an NB and, additionally, REPSOL YPF
shall be notified for its information and/or acceptance.
• The RD/PED does not include the Article 14 and the Annex V of the PED concerning “User
Inspectorates” and, therefore, these are not recognized in Spain for all legal purposes of this RD/PED.

1.4. Exclusions

1.4.1. When for an equipment or assembly the Manufacturer concludes that it is included in one of the exclusions
detailed in paragraph 3, Article 1, of the PED and RD/PED, such exclusion shall be justified and endorsed by a
NB.

1.4.2. The assembly of pressure equipment to constitute a facility is excluded from the PED and RD/PED. Only the
put into service of the facility is regulated by the RAP.

1.4.3. As per the “First Additional Provision. Applicable Regulation” of the RD/PED, are excluded pressure
equipment and assemblies with a put into service prior to the date of legal validity of Decree RD/PED. They
shall continue to be regulated according to the technical prescriptions of the Regulation that had been of
application to them.

1.4.4. As per the “Second Additional Provision, Commissioning” of the RD/PED excludes, the put into service of
pressure equipment and assemblies included in the scope of the RD/PED, for which the procedures
established to such effect by the Pressure Equipment Regulation (RAP), must be followed, Royal Decree
1244/1979, dated April 4 1979, and its complementary technical instructions”. The RAP shall also be applied to
authorize the installation.

1.4.5. As per the “Single transitional Provision. Transitional period” of the RD/PED, excludes equipment
marketed prior to May 29, 2002, date on which the transitory period concludes, even though its put into service
was at a later date.

2. RISK ASSESSMENT

2.1.1. The PED and/or RD/PED requires that the pressure equipment manufacturer perform a risk assessment on the
equipment that should at least consider those risks related to pressure. It will form an integral portion of the
initial considerations in the design of the pressure equipment. If any type of information related to processes is
required from REPSOL YPF with the purpose of preparing such assessment, and this information is subject to
confidentiality agreements with the owner of such technology, REPSOL YPF reserves the right to limit such
information only to the minimum absolutely necessary, upon the signing of a confidentiality agreement.

2.1.2. In the mentioned risks assessment, the Manufacturer shall declare residual risks (those that could not be
completely eliminated), if any, and include them in the equipment’s operation manual or operating instructions
of the equipment that shall be delivered to REPSOL YPF. Without prior approval of REPSOL YPF, such
manual or instructions shall not impose a more restrictive frequency of inspections and tests than those which
correspond to the equipment according to the category established by the RAP and its Complementary
Technical Instructions, specifically MIE-AP-6 for Petroleum Refineries and Petrochemical Plants.

2.1.3. The “Risk Assessment Data Sheet” HD-C-0101.01 must be considered as a reference for implementing such
assessment. The Manufacturer must fill in this form or, alternatively, an equivalent one that should be
submitted to the prior approval of REPSOL YPF.

3. DESIGN

3.1. Design code

3.1.1. The design code shall be that indicated by the applicable REPSOL YPF specification. Independently of the
minimum value for the design pressure that such code establishes as the limit for its application, the code must
be applied when the design pressure is greater than the lesser of the two following values:
• 0,5 bar
• The pressure limit for the application of the code.

3.1.2. The experimental design method shall not be admitted unless REPSOL YPF expressly authorizes the same,
and in such case it should be specifically included in the Vessel’s Design Dossier.

3.1.3. Applicable harmonized standards may be used as an alternative only with the prior written approval of
REPSOL YPF, for example: EN 13445 for unfired pressure vessels and EN 13480 for metallic industrial piping.
In order to request said approval the Manufacturer must indicate the technical and economic advantages
involved with their application.

3.1.4. In any case, the design shall cover PED and/or RD/PED minimum requirements, unless it is technically justified
and accepted by a NB.

3.2. Pressure Equipment Classification

3.2.1. All pressure equipment shall be classified by category, in accordance with that indicated by PED and/or
RD/PED Article 9, based on the information contained in the data sheet of the equipment and the group to
which the fluid it shall contain belongs.

3.2.2. In addition to lay down the pressure equipment category according to the PED and/or RD/PED, RAP category
shall also be determined, since it is required for periodical tests and possible repairs. Both categories must be
shown in the detail engineering and manufacturing drawings as well as in the quality dossier for each
equipment.

3.2.3. Pressure equipment which Article 3, paragraph 3 is applied to, since they do not overcome the limits to be
classified as Category I, shall comply with RAP regulations and requirements, or if such were not applicable,
with the applicable Regulation.

3.3. Design Conditions

3.3.1. Maximum Allowable Pressure (PS)

The PS value shall be assumed as the design pressure indicated by the specifications and contractual
drawings, except that the corresponding value for PS was specifically indicated on them.

3.3.2. Maximum (TSmax) / Minimum (TSmin) Allowable Temperature

TSmax and TSmin values shall be assumed as the maximum and minimum design temperatures indicated by the
specifications and contractual drawings, except that the corresponding values for TSmax and TSmin were
specifically indicated on them.

3.3.3. Minimum Design of Metal Temperature( TMDM)

A minimum design Metal Temperature (TMDM) must be defined for each pressure equipment, which shall be
the basis for establishing the necessity of impact strength for the materials and welds of each equipment.

3.4. Design allowable stresses

3.4.1. To determine the design allowable stresses that shall be applied for sizing the pressure equipment, the lesser
of the following values shall be chosen:
• That indicated by the applicable design code.
• The lowest of the allowable stresses resulting from the application of the criteria established by Annex
1 of the PED and/or RD/PED. For this purpose, the values to be considered for yield strength, tensile
strength and elongation shall be the minimum required by the material specification and not the real
ones that characterize the material. The expression 2/3 Ret., shall be adopted in the case of
austenitic steels, if the minimum elongation value required by the material specification is equivalent
to 35%.

3.5. Joint Efficiency (E)

3.5.1. For the adoption of joint efficiencies (E) shall be applied the lesser value resulting from taking into account the
contractual design code and PED and/or RD/PED criteria, except that the same shall not be less than 0,85.

3.5.2. For the calculation of stability, the joint efficiency to be considered shall not be less than 0,55 for the joint of the
bottom head to the skirt, and 0,70 for the joint of the skirt to the anchor ring.

3.6. Impact strength

3.6.1. If the design code adopted includes criteria to analyze the necessity of impact strength or bending rupture
energy for the materials applicable to a pressure equipment under its design/operating conditions. And from
this analysis a minimum required impact value for such materials is got as a result or, inclusively, releases
these materials from being subjected to such test for not being necessary under such design/operating
conditions. REPSOL YPF considers that the fracture toughness of the material, deduced from the design code,
satisfies PED and/or RD/PED shear fracture requirements. In the case that the Manufacturer and/or the NB
were contrary to this interpretation, they shall proceed in accordance with that indicated in paragraph 1.1.10.

3.7. Hydrostatic test pressures

3.7.1. Unless otherwise noted, all pressure equipment shall be subjected to a hydraulic pressure test in which the
value of the pressure to be reached shall be the highest obtained from the application of the following criteria:

• Applicable REPSOL YPF specification

4. MATERIALS

4.1.1. The PED and/or RD/PED requires that materials used for the manufacture of pressure equipment shall comply
with a “Harmonized Standard” or have a “European Approval for Materials” or a “Particular Material Appraisal”.

4.1.2. Particular Appraisal by a NB shall be required in the case of ASME codes for equipment and piping, if the
same are category III or IV. The "Particular Material Appraisal” shall be required and obtained by the
Manufacturers, considering the same included for all intents and purposes within the scope of supply
contracted by REPSOL YPF.

4.1.3. With the purpose of minimizing the steps of the process and extra costs, Manufacturers are recommended to
try to obtain the certificates under a double quality, one corresponding to ASME or the applicable design code,
and the other corresponding to a Harmonized Standard.

5. MANUFACTURE

5.1. Equipment included in PED and/or RD/PED Article 3, paragraph 3

5.1.1. The “sound engineering practices” that the Manufacturer will apply to the equipment included in PED and/or
RD/PED Article 3, paragraph 3, must be sufficiently documented and submitted to the approval of REPSOL
YPF.

5.2. Permanent Joints

5.2.1. For all categories of pressure equipment and piping found within the scope of the PED and/or RD/PED, welded
joints shall be performed in accordance with qualified procedures and executed by qualified personnel
following the methods and criteria established by the adopted design/ construction code, and completed with
those of the PED and/or RD/PED. If the latter does not indicate the methods and criteria referred to, then
standards EN-287 and EN-288 Standards shall be adopted.

5.3. Inspections and Tests

5.3.1. The Inspection Points Program (PPI) prepared for controlling the requirements of the equipment included in the
contract, shall contain all of the activities resulting from the application of the PED and/or RD/PED, such as NB
witnessing, manufacturer declaration of conformity, and NB certificate of conformity, as well as the
interventions of a Recognized third-party organization related to the review of vendor documents and
procedures and records for permanent joints and non-destructive tests.

5.3.2. Any comment or modification that may be carried out by the NB or Recognized third-party organization shall be
notified to REPSOL YPF, prior to its implementation in the affected equipment or assemblies.

6. NAMEPLATES

6.1.1. The “CE” marking of pressure equipment shall be imprinted on a proper location of the nameplate required by
REPSOL YPF. Such nameplates shall be as indicated by the standard drawings mentioned in section 10.1.

7. OPERATING INSTRUCTIONS

7.1.1. Prior approval of REPSOL YPF is required for the operating instructions of any pressure equipment in the case
that they include more restrictive inspection and test frequencies than those required by the RAP, according to
their category.

7.1.2. Operating instructions shall be written in Spanish, unless REPSOL YPF previously authorizes the same to be written
in English.

8. CONFORMITY ASSESSMENT

8.1. General

8.1.1. As a basic premise, the Manufacturer shall have implemented a certified quality assurance system in
accordance with ISO-9001 or EN-729. Additionally, when the applicable Conformity Assessment Module
requires it, the quality assurance system shall be audited and certified by a NB.

8.1.2. Except for the cases mentioned in sections 8.2 to 8.5, the selection of the Conformity Assessment Module and
the NB are the choice of the Manufacturer, although REPSOL YPF shall be notified of such at the moment of
the proposal, for its acknowledgement and acceptance.

8.1.3. In certain cases, REPSOL YPF, when it is considered on the basis of safety, reliability and cost reasons, shall
impose a specific Conformity Assessment Module and/or specific Notified Body (NB).

8.1.4. Module G may be applied in all cases as an alternative to those indicated for each type of the following
pressure equipment.

8.2. Pressure Vessels

8.2.1. Conformity Assessment Modules that include verification of the product by an NB shall be applied for all
pressure vessels. Unless that during manufacturing there were a planned inspection, done or contracted by
REPSOL YPF, to ensure the quality and safety levels of the contractual specifications, in which case
Conformity Assessment Modules that imply a lesser participation of Notified Bodies and, therefore, a lower
cost, may be proposed.

8.2.2. B1+F modules shall be applied for category III.

8.2.3. Module G shall be applied for category IV.

8.2.4. Renown highly qualified Manufacturers that have a certification for H or H1 modules, in accordance with the
PED and/or RD/PED, may apply these modules, if previously it has been indicated in the proposal and
accepted by REPSOL YPF.

8.3. Pressure Pipe and Accessories

8.3.1. Module D1 shall be applied for category II.

8.3.2. Modules B1+D shall be applied for category III.

8.4. Safety Accessories

8.4.1. Modules B+D o H1 shall be applied for safety accessories.

8.5. Assemblies

8.5.1. In the case of assemblies, the Supplier shall have the responsibility of the Manufacturer and the H1 module
shall be applied, for which the Manufacturer must have a certificate of its establishment in accordance with the
PED and/or RD/PED.

9. DOCUMENTS TO BE SUBMITTED BY THE MANUFACTURER

9.1.1. In the proposal stage: In addition to the information and documents indicated in the Request for Quotation,
the Bidders shall attach to their proposal the following:
a) The possible Notified Bodies or Recognized third-party organizations that may intervene in order to comply
with PED and/or RD/PED requirements. REPSOL YPF reserving its right of not admitting any of them, for
which reason the assigned Company shall not enter any claim whatsoever.
b) The Conformity Assessment Module or Modules which shall apply to each of the pressure equipment
proposed, attaching copies of the corresponding certificates of establishment, in accordance with PED
and/or RD/PED.
c) Annex 1 of this addendum duly filled-in and signed.

9.1.2. In the Purchase Order stage: In addition to the information and documents required by contractual
documents, the pressure equipment Manufacturer shall deliver to REPSOL YPF or its Representative, for its
comments and/or approval, the following documents:
a) General Arrangement drawing, which should indicate at least:
• Equipment categories in accordance with PED and/or RD/PED and with the RAP.
• Conformity Assessment Module or Modules applied.
b) Risk analysis in accordance with PED and/or RD/PED.
c) Operating instructions.

9.2. Manufacturing documents

9.2.1. Upon delivery of the equipment, the Manufacturer shall deliver to REPSOL YPF, in addition to the information
and documents required according to the contractual documents, the following:
a) In the Design Manual:
• Design Examination Certificate.
b) In the Quality Dossier:
• Certificates of inspections and tests conducted by the NB.
• Hydraulic pressure test certificate approved by the NB.
• Sizing and tolerances certificate approved by the NB.
• Declaration of Conformity.
• Certificate of Conformity.

9.3. Approval of documents

9.3.1. The approval of Manufacturer documents by REPSOL YPF or its commissioned Representative does not
release the Manufacturer of its responsibility in the mechanical design, manufacture, and testing of the
equipment.

ANNEX 1
STATEMENT OF COMPLIANCE WITH PED

The BIDDER declares and guarantees that any pressure equipment or assembly included in the scope of its
proposal corresponding to the request for quotation ____________________________________ complies with
the RD/PED, which is the transposed legislation of the Member State where the equipment or assembly shall
be installed, (which in the case of Spain is Royal Decree 769/1999, dated May 7, 1999), of European Directive
97/23/CE, concerning Pressure Equipment (PED). Pressure equipment and assembly being understood as
defined in PED Article 1. In particular, the BIDDER, with respect to the RD/PED and PED, for each pressure
equipment or assembly commits to:
• Request and obtain all the approvals required by the RD/PED and PED and their corresponding
documents, from a Notified Body and a Recognized third-party organization.
• Conduct a risk assessment in accordance with Annex 1 of the RD/PED and PED.
• Apply entirely the design and manufacturing code selected, which is: __________________,
complemented with the RD/PED and PED requirements that are more stringent than those required
by such code.
• Select and require all of the materials in accordance with RD/PED and PED and requirements,
being totally responsible for obtaining the required particular material appraisal, as well as the
certificates for them in accordance with the conditions required by the RD/PED and PED.
• Subject each pressure equipment or assembly to a conformity assessment procedure in accordance
with Annex III of the RD/PED and PED.
• Perform CE marking in accordance with Article 14 or 15 of the RD/PED or PED, respectively, as well
as according to its Annex VI.
• Issue the Declaration of Conformity in accordance with Annex VII of the RD/PED and PED.
The BIDDER declares and guarantees that the operation manual or operating instructions of each pressure
equipment or assembly that it shall elaborated and delivered in the case of a purchase order, shall not include
any limitation that contradicts or conflicts with the requirements included in the contractual documents with
respect to:
• Installation and assembly.
• Commissioning.
• Utilization.
• Maintenance.
The BIDDER, in the case of a purchase order, commits to transmit to and require from its suppliers the
obligations mentioned in this annex, for the components, pressure equipment or assemblies that make up part
of the supply of the same. Likewise, it fully commits to guarantee that it will watch over and verify that its
suppliers have correctly applied the RD/PED and PED and the previously mentioned obligations.
