Research the following sections online using the Ontario Occupational Health & Safety
Act website http://www.e-
laws.gov.on.ca/html/statutes/english/elaws_statutes_90o01_e.htm. Explain the
meaning of the section (in your own words) when you find the relevant provisions:

 59. (2) (b)

An employer or constructor has three days to sign the notice of compliance issued by the
inspector. In case the employer has declined to sign the notice to compliance to the ministry, they
must issue a statement as to why they have refused to sign the statement.

 After testing the air in the paint shop it was found that there was 12 ppm of hydrogen sulfide
present. According to Ont. Reg. 833 – is this over the Ontario TWA Limit and/or the STEL for
“hydrogen sulfide”? http://www.e-laws.gov.on.ca/html/regs/english/elaws_regs_900833_e.htm.

The Ontario TWA limit for hydrogen sulfide is 10 ppm which is less than what was found in the
paint shop but it is less than the STEL which is at 15 ppm.

 26. (1) (i)

This act provides that training programs must be provided for workers, supervisor and committee
members on maintaining and using the equipment, materials and protective devices, keeping the
equipment in good condition, providing measures and procedures to carry out in the workplace
and other clauses mentioned in under section 25

 9. (39)

This section states that if there is a dispute arising in the case of creating a joint committee, as
mentioned in subsection 2, the dispute should be decided by the Minister after consulting the
constructor and the workers or the trade union.

 Where and what is the definition of “Board”

The definition of Board is under section 1(1) of the Ontario occupational health and safety Act.
The definition of Board in the act is that it is referred to the Ontario Labour Relations Board.

 32.0.4

This section states that an employer has the right to take precautionary action to protect any
worker who might expose himself/herself to physical injury at workplace because of domestic
violence.

 18.

 49. (3)

This section states that an employer, worker or a trade union at the workplace can file a
complaint against a certified member on the ground that he/she recklessly exercised or failed to
exercise his power to stop the work because it was considered unsafe to work. The minister of
Labour can act as a party to these proceedings before the Board.
 Ont. Reg. 834 – 1) d - http://www.e-
laws.gov.on.ca/html/regs/english/elaws_regs_900834_e.htm.

The Ontario regulation 834 – 1 defines critically injured as an injury of serious nature in which a
life is at stake, if the person might lose his/her conscious, if it results in serious loss of blood, if
the person might fracture his leg or arm but not his finger or toe, if the person may suffer burns
