PRELIMINARY STATEMENT

I, ALDWIN GULLE, of legal age, single, Filipino and presently

residing at Purok 5, San Jose, Malaybalay City, Bukidnon, after having
been duly sworn to an oath in accordance with law, execute this Counter-
Affidavit in a question and answer form which shall constitute as my
counter affidavit, and fully aware that I am answering the questions
under oath and under pain of criminal liability in case of any false or
perjured testimony, to wit:

9 nga studyante sa Bukidnon National High School – Main
Campus, ug residente sa Purok 5, San Jose, Malaybalay City,
Bukidnon;

(What can you say about the allegations in the complaint?)

A : Kani ang mga gipang storya ni Sophia ug sa iyang testigo

nga si John Mark S. Lucid mga bakak ni tanan tungod wala
gyud nako na nahilabtan si Sophia.
(The allegations of Sophia and her witness John Mark S. Lucid
are all lies because I never raped Sophia.)

6. Q : Unsa man diay gyud ang nahitabo, kung kabalo ka?

(What actually happened, if you know?)

A : Ang nahitabo gyud ani sir mao ni. Adtong December 23,
2019, mga alas otso sa buntag gitawagan ko ni Aiza
Dumalahay ug iya ko gi ignan nga magkita mi sa Kalasungay
kay birthday lagi ni Sir Eugenio nga teacher namo. Mga
10:30 sa buntag naka abot ko didto sa venue sa yuta lang
man to ni Sir Eungenio ug naa dayon gamay nga payag
didto. Kami nag tambay sa murag tent ra sad. Pag abot nako
didto nikaon ko. Naa didtop si Jamjam, Joshua, Jomel, Aiza,
ug si Sophia. Naka inom na sila adto nga panahona ug
nakahurot na ug duha ka long neck nga tanduay. Pagka
human nako ug kaon nag inom na pud dayon ko ug apil nila.
(What really happened is this. On December 23, 2019, around
8:00 o’clock in the morning, my friend Aiza Dumalahay called
me and told me that we see each other at Kalasungay in a lot

 owned by Sir Eugenio since we will have a drinking spree
because it is the birthday of our teacher Sir Eugenio. At around
10:30 o’clock in the morning, I arrived at the venue and I ate. I
saw there Jamjam (John Michael Castroverde), Joshua (Joshua
Moreno), Jomel, Aiza (Aiza Dumalahay), and Sophia (Ma.
Sophia Pabillaran). When I arrived there, they were already
drinking tanduay and they were able to consume two (2) long
neck bottles of tanduay. When I finished eating, I joined them;)

A : Pagka abot ug mga alas dos niabot ang uyab ni Jomel nga si
Alshane Cabrera ug nakig inom pud siya namo. Pagka taod-
taod niabot si John Mark Lucid ug si Christopher Ian
Borromeo ug sila pud ning inom kauban namo. Mga alas tres
or alas kwatro sa hapon, niabot si Sir Eugenio ug nangutana
siya namo kung magdugang pa ba ug ilimnon. Niingon
dayon ang isa sa among mga kauban nga mag dungag ug
tequila. Naghatag dayon ug kwarta si Sir Eugenio ug
nagpalit si John Mark ug si Aiza ug duha ka botelya sa
tequila. Nagpdayon dayon mi ug inom hangtod sa nahurot
ang among ilimnon. Pagka taod-taod, naka abot si Aiza ug si
John Mark. Gitawagan dayon ni Aiza ang among isa ka
amigo nga si Wilfredo Sebusa aron musabay sa amoa.
(At around 2:00 o’clock in the afternoon, Jomel’s girlfriend,
Alshane Cabrera, arrived and she joined us in drinking. After
a while, John Mark Lucid and Christopher Ian Borromeo
arrived and they also joined us. At around 3:00 to 4:00 o’clock
in the afternoon, Sir Eugenio arrived at the venue and he asked
us whether we would like to add on liquor. One of our
companion said to add on tequila. Sir Eugenio give us money
and John Mark and Aiza buy two bottles of tequila. And then
we continue to drink until we finish our drinks. After a while
Aiza and John mark arrived. And then Aiza call one of our
friend named Wilfredo Sebusa to join us ;)

A : Gi abrehan dayon namo ang tequila ug nag ingon ang among

isa ka kauban nga mag body shot. Sa akong nadumduman,
si Sophia ang una nag body shot sa akoa. Pagkahuman ako
dayon nag body shot sa iyang abaga. Pagkahuman si Joshua

 ang nag body shot kang John Michael dayon si John Michael
dayon kang Joshua. Nihangyo dayon si John Michael
Castroverde kay Sophia nga mag body shot si John Michael
kang Sophia. Ug nisugot si Sophia. Gibutang ni Sophia ang
lemoncito sa iyang lips ug nag body shot dayon si John
Michael sa iya. Ang nahitabo gamit ang baba ni John Michael
gikuha niya ang lemoncito gikan pud sa baba ni Sophia nga
hapit nagkahalok sila duha. (we open the tequila and one of
our companion tell that were going to have body shot. As I
remember, Sophia is the first who body shot on my shoulder.
After that, Joshua body shot to John Michael then John Michael
to Joshua. John Michael Castroverde beg Sophia to body shot
on her. Then Sophia agree. Sophia put the kalamansi on her
lips and then John Michael body shot on her. The next
happened John Michael use his mouth to get the kalamasi from
the mouth of Sophia that almost they kiss.

(What is the reaction of Sophia on body shot on her)

A : Nag ngisi siya sir ug nag ingon ug ay yawa.

(She just smiled sir and said “ay yawa”)

10. Q : Kung nakabalo ka, unsa ba ang relasyon ni John Michael ug

Sophia?
(If you know, what is the relation of John Michael and Sophia?)

A : Sila duha sir naa na sila mutual understanding. Sila ang sige
tapad adtong panahona ug nag higda pa gani si Sophia sa
abaga ni John Michael adtong daghan na ang among nainom.
(Both of them sir has a mutual understanding. They were
always sitting beside each other the whole time and there was
even a time when Sophia lean on the shoulder of John Michael
at the time when we had drank much.)

11. Q : Wala bay nag pugos sa inyoha kang Sophia nga mag body
shot?
(Was there any one who forced Sophia to have body shot?)

A : Wala man kay amoa man to tanan kabubut-on.

(There was no one since it is all our free will.)

12. Q : Unsa ba ang mood adto nga panahona?

(What was the mood at that time?)

A : Kami tanan maayo kaayo ug mood ug nalipay ug nag storya

storya samtang ga inom mi. Pagkahurot sa duha ka botelya
sa tequila naka desisyon mi duh ani Wilfredo nga mag uli

 na dayon kay gabii na. Nagbaklay dayon mi paadto sa dalan
para manakayan ug mao to nga panahon nga nakita nako si
Sophia ug John Michael nga nagbaklay padulong sa payag.
Nag hulat hulat dayon mi nga nga naay mulabay nga
multicab. Tungod kay dugay kaayo ang multicab, naka
desisyon mi ni Wilfredo nga mubalik sa among gitambayan
nga tent aron magpa hatod na lang ug motor. Pagka abot
namo sa tent wala didto si Sophia ug si John Michael. Didto
ra dayon mi nagtambay ni Wilfredo. Pagka taod taod
samtang naghulat mi sa motor, kalit lang man naghilaka si
Sophia ug ang iyang hilak gikan sa payag. Wala na lang pud
ko niduol kay nagtuo ko nga nag away lang si John Michael
ug Sophia.
(We were all in good mood and we are all happy and we are
just talking while drinking. When we finished drinking the two
(2) bottles of tequila, I and Wildredo decided to go home since
it is already nighttime. We then walk towards the road where
we would wait for something to ride on and at that time I saw
Sophia and John Michael walking towards the shanty. I and
Wilfredo then waited for a multicab to come by. Since we were
waiting too long for the multicab, we decided to go back to the
tent where we were drinking so that we would just be taken
home by a motorcycle. When we arrived at the tent, Sophia and
John Michael were not there. We then waited in the tent.
Thereafter, while we were waiting for the motorcycle, suddenly
Sophia cried and her crying came from the shanty. I did not go
near the shanty since I thought John Michael and Sophia are
just quarelling.)

13. Q : Kabalo ba ka kinsa gyud ang nanghilabot kang Sophia?

(Would you know who raped Sophia?)

A : Si John Michael ang nanghilabot kang Sophia sir kay adtong

nahurot na ang among ilimnon, ug pabaklay nami padulong
sa dalan, ako ug si Wilfredo nakakita kang John Michael ug
Sofia nga padulong sa payag.
(It was John Michael who raped Sophia sir because at the time
we finished drinking and we were about to go out towards the
road, me and Wilfredo saw John Michael and Sofia enter the
shanty.)

14. Q : Kani nga payag unsa man ni kalayo gikan sa tent kung aha mo
nag inom?
(This shanty that you are talking about what is its distance
from the tent where you were drinking?)

A : Naa ra sa mga lima ka metro.

(At around five (5) meters.)

15. Q : Naa ba ni suga ang payag?
(Does the shanty have its own source of light?)

A : Wala ni suga.
(No it does not have its own source of lights.)

16. Q : Kung wala ni suga, makita ba nimo kung kinsa ang naa sa
sulod?
(If it has no own source of light, can you see who are inside the
shanty?)

A : Dili sir kay ngitngit man kaayo ug ang suga ra kay kadto
gikan sa tent na among gitambayan. Imposible kaayo nga
makakita na si John Mark kinsa ang naa didto or unsa ang
nahitabo didto kay wala man suga ug gabii na kaayo to ug
ngitngit nasad.
(No sir since it is too dark and the only source of light is from
the tent where we hanged-out. It is impossible for John Mark to
see who is inside or what is happening therein because of the
lack of light and it was nighttime and too dark;)

17. Q : Unsa pa ba ang nahitabo pagkahuman adto, kung naa pa man

galing?
(What happened afterwards, if there are any?)

A : Si Sophia niadto sa among balay pipila ka adlaw mahuman

ang nahitabo ug nangutana siya nako unsa gyud ang
nahitabo. Ako siya gi ignan nga si John Michael ang iyang
kauban didto sa payag. Mga tulo ka oras pud to sila sa balay
kauban ang iyang ate ug uyab sa iyang ate. Gi ignan ko niya
nga gusto ko niya mahimo nga witness sa iyang kaso nga
ipasaka. Karon dako kaayo akong katingala nganong ako na
man hinuon ang gikasuhan.
(After several days, Sophia went to our house and she asked
me what really happened. And I told her that it was John
Michael who was with here in the shanty. Sophia spent three
hours in our house together with her sister and her boyfriend’s
sister. Sophia then told me that she wants me to be a witness in
the case that she will. Now I greatly wondered why it was me
who Sophia filed a case against;)

18. Q : Unsa man ang maka ingon nimo aning gi-snopikan nga parte
sa complaint ni Sophia?
(What can you say about the portion of the complaint of Sophia
with a snowpake?)

 A : Kani sir isa gyud ni ka dako nga ebidensya nga wala gyud
kabalo si Sophia kinsa ang nanghilabot sa iya. Kung imong
lantawon ug ipahayag ang parte nga naay snopik, makita
nimo nga kani kay Mark ug Mark Lucid ang nakabutang.
Kani nga Mark Lucid mao ni siya ang iyang gihimo nga
testigo. Kini nagapakita nga si John Michael Castroverde ug
si John mark Lucid gyud ang kasuhan ni Sophia. Natingala
pud ko nganong ako ra man ang iyang gikasuhan ug wala
niya giapil si John Michael Castroverde ug Joshua Moreno.
(That one sir is a big evidence that Sophia does not know who
raped her. If you would look on and put the portion with a
snowpake in a bright light, you would be able to notice that the
name under the snowpake are Mark and Mark Lucid. This only
goes to show that it was really John Michael Castroverde and
John Mark Lucid that she would file a case against. I am also
wondering why it was only me that she filed a case against and
she did not include John Michael Castroverde and Joshua
Moreno when she alleged in her complaint John Michael
Castroverde and Joshua Moreno also violated her rights;)

19. Q : Sa kaning testimony ani John Mark Lucid unsa man ang imong
maka ingon ani?
(This testimony of John Mark Lucid, what can you say about
this?)

A : Wala pud ni kamatuoran. Kung atong basahon ang

complaint ni Sophia ug ang testimonya ni John Mark Lucid
daghan kaayo ni mga dili pagka consistent. Una, niingon si
Sophia nga pag abot niya sa Kalasungay nakita niya si Aiza,
Jamjam ug si Joshua. Wala ko gi mention niya or giapil nga
naa didto. Nipadayon pag ingon si Sophia nga pagka alas
dos niabot si Jomel, Alshane, Ian, ug Mark, wala gihapon ko
gi mention nga ning abot. Apan sa iyang answer sa question
number 9 naapil na man ko ug kalit kalit lang nga wala man
gani siya nag ingon nga naa ko adto nga panahona sa una
niya nga mga gipang storya. Gi ilisdan ra gyud na niya ang
pangalan ni John Mark ug akong ngalan ang iyang gi ilis
para lang naa siya makasuhan. Kabalo man ko nga niduol
na si John Mark kang Sophia ug mao to nga ako na dayon
ang ilang ginaduot.
(This is also false. If we would read the complaint Sophia and
the testimony of John Mark Lucid, there are many
inconsistencies. First, Sophia said that when she arrived at
Kalasungay, she saw Aiza (Aiza Dumalahay), Jamjam (John
Michael Castroverde), and Joshua (Joshua Moreno). I was not
mentioned or included that was around. Sophia then continued
in saying that at 2:00 o’clock in the afternoon. Jomel, Alshane
(Alshane Cabrera), Ian (Christopher Ian Borromeo), and Mark

 (John Mark Lucid) arrived, and still no mention about me
arriving or being there. However, in her answer in question
number 9 she then suddenly included me when she did not even
said in her previous statements that I was there. She just
changed the name of John Mark Lucid with my name for the
purpose of someone to file a case against. I know that John
Mark came to Sophia and that is why it is me that they are
dejecting;)

A : Base man gani sa testimony ani Sophia nakabalo pa siya nga

gidala siya ni John Michael sa payag. Unsaon lugar niya
pagkabalo nga sa gi ingon pa ni John Mark Lucid nga
nakatulog na si Sophia tungod sa kahubog? Imposible gyud
nga makakita ni si John Mark Lucid kay ngitngit man kaayo
sa payag ug wala pud siya sa payag kay naa ra siya sa tent
nakig uban namo. Bisan gani ng screenshot nga giapil ni
John Mark Lucid sa iyang testimonya ang naa ra man diha
kay si Jamjam. Wala man gani naapil ang akong pangalan. Si
Jamjam ang nag ingon kay John Mark nga magbuhat ug
storya para matabunan ang unsa tinuod nga nahitabo. Ang
tinuod nga si Jamjam gyud ang nanghilabot kay Sophia. Ako
lang gyud ang ilang nahunahunaan nga iduot tungod siguro
kay kami pobre ug kadtong mga tinuod nga nang hilabot
Sophia mga anak ug sapian.
(Based on the testimony of Sophia, she was still aware that it
was John Michael who brought her to the shanty. How come
she was able to know that it was John Michael when based on
the testimony of John Mark Lucid Sophia was already
unconscious? It is really impossible that John Mark Lucid was
able to see what is happening inside the shanty since is really
very dark and he is not also inside the shanty since John Mark
was with us the whole time. Even the screenshot that John Mark
Lucid attached in his affidavit, the same only shows Jamjam
(John Michael Castroverde). My name was not even mentioned
therein. Based on the said screenshot, it was Jamjam who told
John Mark to make up stories to hide what really happened.
That it was Jamjam who raped Sophia. I am the one they
thought to press the charges on because I am from a poor
family and the others who were with us and the one who did
rape Sophia are from wealthy families;)

 A : Ning ingon pa gyud si Sophia nga nihigda siya sa lamisa
pero ang gi ingon ni John Mark kay sa folding bed naghigda
si Sophia. Kabalo man siguro ta nga duha ka magkalain nga
butang ug kung muhigda ka anang folding bed makabalo
jud ka nga dili na lamisa kay lahi man ang feeling ana.
(Sophia even said in her complaint that she lay down on a table
but on the testimony of John Mark, Sophia laid down on a
folding bed. We all know that a table is different from a folding
bed and you would know for sure that if you lay down in a
folding bed it is not a table since it feels differently;)

A : Ang tubag pud ni Sophia sa question number 9 kay ang nag

insert sa penis kay si Jamjam Castroverde ug ug ako kibale
nag tan-aw lang. Unsaon pagkakita ni Sophia nga ngitngit
man kaayo ang payag kay wala man suga didto. Ug ni ignon
pa gani si Sophia nga pagkamata niya si John Michael ang
iyang nakita nga nag fix sa iyang kaugalingon. Wala man
gani ko niya nakita nag fix pud sa akong kaugalingon.
(Sophia’s answer also to question number 9 that the one who
inserted his penis was John Michael Castorverde and what I did
was just watch. How can Sophia see that when it is too dark
inside the shanty because there was no light therein? And
Sophia even said that when she gained consciousness, it was
John Michael who he saw fixing himself. She did not say that I
was there fixing myself too.)

23. Q : Niining mga tak-naa wala nako ipangutana pa kanimo, aduna

pa kay idugang?
(At this moment, I no longer have any questions to ask, do you
have anything to add?)

A : Ang ako gusto ug hangyo sa opisina sa piskalya sa

Malaybalay nga ipa dismiss ni ang kaso kay wala gyud ni
kamatuoran. Ako willing nga mutestigo kung kinsa gyud
ang tinuod nga nang hilabot kang Sophia.
(What I want and request from the Office of the City Prosecutor
of Malaybalay City is to dismiss this case against me because
there is no truth to it. I am willing to testify against the person
who raped Sophia.)

24. Q : Imoha ba ning gihimo nga judicial affidavit sa maayong

kabubut-on ug wala nagpugos nimo?
(Did you make this judicial affidavit at your own free will and
nobody forced you to make and sign the same?)

ka kasohan ug perjury o false testimony?

which means that you may be prosecuted for perjury or false
testimony if it turns out that you lied about any of the answers
you have given in response to the questions propounded upon
