COMPLAINT-AFFIDAVIT

I, Ma. Leonora Teresa Go, Filipino, of legal age, and with

residence at San Isidro, Isabela, after having duly sworn in
accordance with law, hereby depose and state that:

(1) This complaint-affidavit is being filed to charge Justin Bibo,

Filipino, of legal age and with residence at Ipil, Echague, Isabela, of
the crime of RAPE under Article (Art.) 226 of the Revised Penal Code
(RPC), committed as follows:

(a) On July 31, 2017, at around 8:00 pm, I and some of my

classmates went to Charina’s Grill to get some drinks after our
acquaintance party.
 (b) We arrived at the place at about 8:20 pm and we
rented a room with karaoke.

(c) We ordered 3 buckets of San Mig Light, 1 1-liter bottle of

Fundador, and different dishes for pulutan.

(d) Everybody started drinking when the beverages

arrived, except me because I do not feel like drinking at that time.

(e) I was just sitting and eating pulutan when respondent

Justin Bibo (Justin) sat beside me and offered me a glass of pineapple
juice which tasted weird when I drank it.

(f) I and Justin talked and shared stories about how the past
semester had been when my head ached and I started to feel dizzy;
but I ignored what I was feeling.

(g) At about 10:00 pm, the group decided to leave and we

all went for the parking lot where Justin offered to take me home, in
which I agreed because my head ache and dizziness was worsening
and I have a trust in him because he has been my classmate and
friend since our first year in college.

(h) He led me to his brown Toyota Vios, opened the door

for me and helped me get in his car.

(i) While driving he asked me if I could accompany him to

Alicia, Isabela to get his laptop from his grandmother’s home because
he left it there and after that he’ll directly and immediately take me
to our home; so, I agreed.
 (j) During the trip my head ache and dizziness worsened
more so I slept all throughout the ride; but the biggest shock of my life
happened when I woke up, the car was already parked, and Justin
was already exploiting me, inserting his penis into my vagina, and
satisfying his carnal desires.

(k) I resisted and screamed but because my body felt weak

and he was way stronger than me I failed to get away from him.

(l) After he finished exploiting me, he threatened me not to

tell anyone because he’ll kill me if I do; then he dropped me at our
house and reminded me to not tell anyone of what happened.

(2) Upon immediately entering the house I rushed to my parents

and narrated everything that happened and told them of the threat
Justin Bibo gave me.

(3) Shocked and outraged, my parents and I went directly to the

police station and reported the crime committed by Justin against
me. The Police took my sworn statement, a copy of which is hereto
attached and made an integral part thereof as Annex “A”.
Thereafter, I was examined by their medico-legal officer. A copy of
the Medico-Legal Report is likewise hereto attached and made an
integral part hereof as Annex “B”.

(4) Based on the foregoing facts, it is beyond objection that

respondent Justin Bibo committed the crime of Rape against my
person punishable under Art. 266 of the Revised Penal Code.
IN WITNESS WHEREOF, I have hereunto set my hands this 24 th day
of October 2017, in Santiago City, Isabela.
