URGENT MOTION FOR RESETTING

DEFENDANT DATU ALICIO PATAC, by counsel, to this

Honorable Court, most respectfully states:

1. Herein defendant is still under detention in the District Jail

of Surigao del Norte, after being charged of a non-bailable offense of
possession of explosives before RTC Branch 32 of Surigao del Norte;

2. The Petition for Bail filed on his behalf is still under

consideration by the Presiding Judge, and to date, has not been ruled
upon, thus, said defendant, in all certainty cannot be presen in court,
in the hearing set for 31 January 2018, in compliance with the Order of
this Court dated 16 November 2017.

WHEREFORE, premises considered, herein defendant is left with

no other option but to ask for the cancellation of the hearing of this case
set on 31 January 2018, and for the same, to be reset in the March
2018 calendar of this Honorable Court.

ACCUSED, in the above entitled cases, to this Honorable Court,

most respectfully state:

1. The last Order of this Honorable Court dated 15 November

2017, has directed the Prosecution to file its Formal Offer of evidence,
after the termination of the presentation of all its evidence on said date;

2. To date, prosecution has failed to file the same, thus, an

indication that it has waived the filing of the same.

WHEREFORE, premises considered, it is most respectfully prayed

of this Honorable Court, that the Prosecution be declared to have waived
the formal offer of its evidence, and thereafter, for the Defense to be
allowed to File a Demurrer to Evidence.
