DEFENDANT, GASPAR DOE, through counsel, answering

plaintiff's complaint, alleges:

(Admission and Specific Denials)

AS CROSS-CLAIM AGAINST BALTAZAR DOE

1. That defendant GASPAR DOE, while he did sign promissory note,

Annex "AV,"as co-principal debtor, was in truth and in fact, merely
acting as surety for his co-defendant BALTAZAR DOE, the latter
having received the full amount loaned on said promissory note,
without a single peso thereof having been received by, or having
accrued to the benefit, of herein cross-claimant.

WHEREFORE, DEFENDANT CROSS-CLAIMANT prays for

judgment dismissing the complaint against him, and, on the CROSS-
CLAIM:

In the event that judgment be rendered ordering defendant

cross-claimant to pay to plaintiff the amount claimed in latter's
complaint, that cross defendant be simultaneously ordered to pay
back to cross-claimant whatever amount is paid by the latter to
plaintiff in accordance with said judgment.
