AFFIDAVIT OF
ARREST

WE, SPO1 Charles Boyle and SPO2 Amy Santiago, of legal age, Filipino
citizen, PNP members assigned at Police Station 1, Angeles City and
designated as members of the Drug Enforcement Unit, after having duly
sworn to in accordance with law do hereby depose and state the following:

(1) That we are filing a charge of Violation of Section 5 of R.A. 9165

against JAKE PERALTA y HOLTZ;
(2) That our office received information from a confidential informant
that a certain Jake residing in Brgy. Tokhang Angeles City was
selling illegal drugs in the said Barangay;
(3) The information was further validated by members of the Drug
Enforcement Unit of this office and conducted surveillance on the
activities of Jake and was able to confirm that he was involved in
selling illegal drugs in their Barangay;
(4) Having the information at hand, we advised our confidential
informant to contact Jake and to arrange a transaction buying
illegal drugs for Php 300.00;
(5) That on January 25, 2019, the informant came to our office and that
the transaction is already settled;
(6) Thereafter, our Station Commander, PCI Harry Potter directed our
Team Leader to form the group and plan to conduct a possible buy-
bust operation to be led by himself against Jake accompanied by the
confidential informant;
(7) During the briefing, our team leader directed us to coordinate with
PDEA where we secured a PDEA control no. # 56122-92233-3780;
(8) I, SPO1 Charles Boyle was assigned to act as a poseur buyer and was
given three (3) pieces of One Hundred Peso bills with serial No.
OOOO1, OOOO2, OOOO3 to be used as marked money to buy the
 drugs in the said operation and marked with my initials “CB” on the
upper portion of the bill Attached herewith is a copy of the
Coordination form marked as Annex A. The Picture of pre-marking
the money to be used and briefing conducted by PCI Harry Potter
at Police Station 1 marked as Annex B.;
(9) SPO2 Amy Santiago and the rest of Drug Enforcement Unit of Police
Station 1 will serve as back up;
(10) I, SPO1 Charles Boyle will scratch my head to signal the other
members that the transaction has already been completed;
(11) On January 24, 2019 around 8:00 PM we, together with the
informant and other members of the team proceeded to Brgy.
Tokhang Angeles City;
(12) At the said target place, our team took their respective positions
and waited in a nearby tricycle terminal within eye’s view of the
poseur buyer and the confidential informant;
(13) The informant called Jake using a cellphone and after a few minutes
the latter arrived and the informant introduced me as the one who
he’s talking about who wants to buy drugs;
(14) After shaking hands, Jake pulled from his pocket a clear heat sealed
plastic sachet containing a white power like substance and handed
it to me, and in turn, I handed to him the marked money;
(15) I scratched my head, signaling the transaction is complete;
(16) I introduced myself as SPO1 Boyle, read his rights and arrested him
and thereafter, the Team arrived at my positon;
(17) I, SPO2 Amy Santiago did a bodily search of the subject and found
the three (3) Php 100 marked money;
(18) The DOJ representative, media representative, and Barangay
official was called to witness the on-site marking and inventory of
the evidence obtained;
(19) That on the on-site inventory present were the Brgy. Tokhang
Chairman Danela Yaling, the media representative Archie Agustin,
and DOJ representative Erikka De Vera.
 (20) The physical evidence collected were the three (3) Php 100.00
marked money with serial no. OOOO1, OOOO2, OOOO3; one (1)
clear heat sealed plastic sachet containing a white power like
substance marked with “CB-1”. Photographs of onsite inventory,
were witnessed by the Media, DOJ representatives are attached and
marked as Annex C to Annex C1);
(21) The Arrested suspects and the physical evidence recovered were
brought back to Police Station 1 for documentation where it was
turned over to the investigating officer SPO3 Loui Ramirez;
(22) At around 3:00 AM on January 25, 2019, we, together with SPO3
Ramirez brought the specimens to the crime laboratory to conduct
drug test. Photographs of the physical evidence, three hundred
peso bills marked money and confiscation receipt are hereto
attached as Annex D; a copy of the drug test request form hereto
attached as Annex E;
(23) At around 1:00 PM on January 25, 2019, we returned to the Angeles
City Crime Laboratory to pick up the results of the examination
conducted. A report was issued by the ACCLO under Chemistry
Report No. D-992-2019 (ACCLO) that the specimens submitted
marked as “CB-1” yielded POSITIVE results in the presence of
Methamphetamine Hydrochloride or Shabu, a dangerous drug;
(24) The specimen collected (Urine sample) from the accused yielded
POSITIVE results in the presence of Methamphetamine
Hydrochloride or Shabu, a dangerous drug. A copy of the results of
the Drug tests are hereto attached as ANNEX F;

In witness hereof, we affix our signatures this 25th day of January, 2019
to test the truthfulness of the above statement and to serve as a tool in filing
the appropriate charges against the arrested suspect.

INFORMATION

The undersigned City Prosecutor hereby accuses JAKE PERALTA y

HOLTZ, a resident of Bgy. Tokhang Angeles City, Pampanga, for violation of
violation of Section 5 of R.A. 9165 or the “Comprehensive Dangerous Drugs
Act of 2002”, committed as follows:

That on or about the 24th day of JANUARY 2019, in the City of Angeles,
Philippines, and within the jurisdiction of this Honorable Court, the above-
named accused, did and there, willfully, unlawfully and feloniously sell and
or deliver to poseur buyer one (1) small size heat-sealed transparent
plastic sachet weighing ONE HUNDRED FIVE THOUSANDTHS (0.105) OF A
GRAM with marking “CB-1” of Methamphetamine Hydrochloride (Shabu),
which is a dangerous drug, without authority whatsoever.
