On November 11, 2019, the management has sent you a memo that required your
submission of your explanation regarding the charges of insubordination and other
disrespectful conduct towards management, failure to cooperate and work
effectively with co-workers and management, and inciting disorders and illegal
concerted actions against the management.
After a thorough investigation and examination of all the evidence, evaluations and
reports submitted and on hand, including your letter of explanation dated
_____________, you are found guilty of the committing serious and willful
misconduct towards the employer through insubordination and inciting disorder
against the management.
The company has the right to protect its interest in operation and your behavior in
enticing other employees to join your en masse resignation on the company’s
foundation day without any justifiable cause on the company’s end is ultimately
disruptive and harmful to the industrial relations of the management and the your
co-employees. Your claim to be “anti-management” and your subsequent acts of
disrupting the harmony of the company on a very important event fall under
analogous circumstances in relation to serious and willful misconduct under Art.
282 of the Labor Code of the Philippines and empowers the management to
terminate your employment for just cause even if committed only once.
As such, we regret to inform you that your employment with the company is hereby
deemed terminated effective immediately upon receipt of this notice. You are
given five (5) days from receipt of this notice of termination to file any letter of
reconsideration. All entitlements prior to your termination will be released to you
upon completion of clearance procedures with the HR Department.
