A: Yes

Q: How do you know the accused?

A: He is the husband of my deceased cousin Gemeliz Rico.

Q: When did you came to first know the accused?

A: when I was five back in 2002, I was introduced to him by my cousin who was then his girlfriend.

Q: what was your relationship to him at the time?

A: I was close to him as my cousin and he would treat me as their own daughter as they had no children.

Q: what do you mean by the word close?

A: they would come and fetch me from my parent’s house, and we would go places. He would buy me
toys and clothes and other things for school. I would call him addy, short for daddy and I live with them
during my vacation months from school.

Q: where do you stay with them during your vacations you mentioned?
A: I lived with them in their house in Cainta, here in Laguna, and in Cavite.

Q: when did these happen if you can recall?

A: in Cainta that was around 2004 up until early 2006. In laguna, we lived with them first in his mother’s
house around late part of 2006 up until he and my cousin had their own house also in laguna around
early part of 2008. I spent my vacations in their house in cavite starting around 2010.

Q: having spent all that time with them, can you say you treated them like your own family?
A: Yes, for the first part of it.

Q: what do you mean by that?

A: that was when Rico treated me differently during my summer vacation in 2008.

Q: can you elaborate on how he treated you differently?

A: it was at that time he made his first sexual advance on me.

Q: in what manner did he commit this sexual advance?

A: it was when I was massaging him after I massaged my cousin. He was facing down on his bed while I
was massaging his upper back just below the nape and I was sitting on his lower back just above his
buttocks. he suddenly turned to face me which threw me to the left side of the bed and grabbed my
right breast using his left hand, after he shifted on his right side .

Q: where was your cousin at the time?

A: she was asleep beside us.

Q: you mean to say she didn’t wake up during that sudden tussle?
A: yes because she is a deep sleeper.

Q: how long did he hold your breast?

A: he mashed my right breast for about three seconds while he was looking me in the eye.

A: I jumped down to where my bed was on the floor and covered my whole self with my blanket.

Q: How about Rico? Did he do anything after that moment?

A: I didn’t see him, but he didn’t continue or stepped off their bed, until I finally fell asleep and I didn’t
know what happened after.

A: it was evening when I started massaging him and my cousin.

A: I was eleven at that time.

A: I wasn’t able to because Rico threatened to kill me and my cousin if I told her.

A: the next morning when I woke up, I wanted to use the bathroom outside the room we slept in, but
my cousin was using the bathroom. That was when Rico suddenly grabbed me and dragged me inside
the kitchen. He was holding me with his arm barred around my neck with his left hand and his gun
pointed towards my right temple.

A: I was shaking in fear because it was my first time to see a gun and very close to me. I was afraid that it
might fire that time. I cried softly while he was restraining me.

A: the door of the bathroom opened and Rico let go of me and I went immediately to the other room
beside the kitchen.

Q: what happened afterwards if you can recall?

A: that night, Rico molested me.

Q: What do you mean by molest? Can you elaborate?

A: that night, I woke up to Rico taking off my panty and started to lick my private parts.

Q: How do you know it was Rico who was licking you?

A: because I felt his beard and moustache rubbing against my private parts, he was the only one in the
house who has facial hair in that house and I confirmed it by taking a peek and I saw his face.

Q: how long did he lick your private parts during that time?
A: I do now know as I can’t move to check the time and I was afraid to let Rico know I was awake. I
pretended to be asleep for that whole time.

Q: were you still awake when he finished doing that to you?

A: Yes, he even put back my underwear afterwards.

Q: How many times did he abuse you like this?

A: Many times, I can no longer recall particularly, but he would lick my private parts everytime he would
rape me even in Carmona.

Q: was that the only kind of sexual abuse done to you by Rico?
A: No, he also forced me to put his penis in my mouth after he licked my vagina.

A: No.

A: it was a few days after he first abused me.

Q: How was he able to abuse you in this manner?

A: I was sitting in front the desktop computer browsing my Friendster profile when he suddenly brushed
me aside and typed something on the keyboard. The internet page loaded into a pornographic site with
a video playing of a woman performing oral sex on a man. He told me to follow what was on the screen.

Q: Did you do as he commanded?

A: No, but he held my head and forced his penis into my mouth. I began crying and tried to pull my head
away, but he held onto my hair with his right hand and he was video recording it with a digicam with his
left hand, and he even remarked,” Yan ang gusto ko, yung lumalaban!”
Q: How long did he make you do that?
A: it was around 5 minutes. He stopped when he ejaculated

Q: How many times did he abuse you like this?

A: I cannot also recall, but he would force me to do this everytime he would rape me even in carmona.

Q: you didn’t report this or told anyone?

A: No, because threatened me that he will spread the video on the internet.

Q: the video of you being forced to do oral sex on him?

A: yes.

Q: do you recall any other form of abuse he has committed against you aside from those he mentioned?
A: he also made me strip naked in front of a web cam.

Q: when did this happen?

A: it was around my summer vacation in 2009 when I was staying at their house in Laguna, while he was
in China.

Q: why was he in china?

A: he used to work there as a musical performer.

Q: how did he make you strip in front of a webcam

A: it was during skype calls to my cousin. He would tell me to stand up in front of the camera and told
me to take off my clothes and touch my vagina.

Q: was your cousin there at that time?

A: yes, but he somehow makes her leave the room, telling her he wants to talk to me privately.

Q: why didn’t you tell your cousin of this abuse against you?
A: Because he told me he will kill my cousin when she goes to china that year if I report him or told
anyone.

A: yes, I am very much scared of him and I love my cousin very much.

A: almost everytime when he was still in China and would skype call my cousin while I was there staying
in their house in laguna.

A: during my vacation stays in their house in Laguna and when my cousin would fetch me to stay there
during the weekends.

A: 1 year and a few months, he returned to the Philippines July 2010.

Q: did he continue in committing this kind of abuse to you when he returned to the Philippines in July
2010 or after that time?
A: not anymore, but he abused me sexually.

A: he still licked my private parts and made me put his penis in my mouth.

Q: for how long were you abused after he returned back from china?
A: he abused me and even raped me on September on 2011, up until he impregnated me and finally
stopped raping me when I gave birth to Red, my daughter

A: he raped me by putting his penis into my vagina and I did not want him to.

Q: Why did allowed him to do those things to you?

A: because he would always threaten me that he will kill me, or he would spread the videos he took of
me while he forced me to put his penis in my mouth. He would say “alam mo naman na may baril ako”
or “di ka naman sasama sa akin, di ikakalat ko na lang yung mga video natin” he even recorded when he
first penetrated me inside a motel room and would use that video to rape me even more until he finally
stopped when I gave birth to my daughter.
