I, Gagapuram Venu, S/o. Satyanarayana, Age;36 years, Occu:

Private Employee, R/o. Excise Colony, Hanumakonda, Warangal, do

hereby solemnly affirm and stated on oath as under:-

1) I am the deponent herein and defendant in the above said suit and I

know the facts of the case.

2) I submit that the respondent No.1 herein filed the above suit

against me and another respondent herein for recovery of money

with false allegations under the guise of the fabricated documents.

3) I submit that from the year 2003 I am not residing in the plaint

mentioned address and due to my employment I shifted to

Hyderabad and recently I shifted to here again. I submit that I have

not received summons in the above said suit, the respondent No.1

herein wontedly paid the process to the plaint mentioned address

and taken the steps for substitute process and got published the

notices in the paper and on 04-02-2010 I was set ex-parte. I submit

that I have no knowledge about the publication of notice against me

in the paper. I submit that recently I came to know the same

through my friends with regard to the publication and on enquiry I

came to know that I was set ex-parte on 04-02-2010. I submit that I

have no knowledge about the service of summons on me through

paper publication and my absence is not intentional due aforesaid

reason only. I submit that I am advised to file the present petition

to set aside the ex-parte order dt:04-02-2010 to participate in the

suit proceedings. I am ready to file my written statement after

allowing this petition immediately. If the petition is allowed no loss

or damage will cause to the respondent herein.

Therefore, I pray the Hon. Court may be pleased to set aside the

ex-parte order dt:04-02-2010 passed against me and permit me to file

the written statement and proceed with the case, in the interest of

justice.
