The United Nations Security Council

Topic: “The Kashmir Crisis”

The Security Council,

Calling for an immediate de-escalation of tensions


Re-affirming the Kashmiri right to self-determination

Urges member states to act quickly and in a coordinated manner to resolve matters
of humanitarian violations and aid

Recognizing the need for an impartial solution to prevent the outbreak of war
Calls for member states to consolidate their efforts and unite for peace through all
powers within their use under Article 24 of the Security Council charter

Recalling UNSC resolution 80 and the McNaughton Proposals

1. Invites a fund pool similar to the Addis Ababa Plan previously used by
the G20 and the model presented by the One Belt One Road Initiative:
a. Fund pool comprising of funds from the willing regional bodies
and countries,
b. The funds will be transferred to the government of India ,
Pakistan or Independent Kashmir depending on the Plebiscite’s
outcome,
c. Will be tracked by a team of representatives from The
UNHRC who will make sure that the funds are used
appropriately and in the interest of the government and then
report it to the UNSC,
d. Excess funds allocated will be invested in Local Business to
expand the Kashmir market;
2. Demands India and Pakistan recommit to the Nuclear No First-use
policy and extend its scope to include the use of tactical nuclear weapons:

3. Recommends India to reconsider the AFSPA and the PSA and repeal
the acts in all territories where it has been implemented and the immediate
release of political leaders imprisoned on the principle of PSA and repeal
immunity for security forces;

4. Urges the immediate redrafting of the Indus water treaty as the summit of
water distribution:
a) Nullify inter dominion accord of the Indian Independence Act (1947)
approved by the previous minister the World Bank,
b) Asian development bank and the IMF to oversee construction of water
storage and water projects under the UNDP,
i. Both the nations should refrain from constructing dams and any
hydel projects in the Kashmir region which requires clearance
of civil infrastructure and dispersion of permanent residents in
the vicinity,
ii. To nullify and black list projects such as the Kishenganga and
Baglihar hydel projects which impeaches Article 4 Chapter 14
of the international water commission which allows provision
of water to countries dependent on it,
iii. Monetization and compensation provided to terminate or finish
projects deemed and declared as illegal,
c) To assist both the nations in discussing the conduction and assessment
of the flow of water on transboundary rivers,
d) Reconvene the Permanent Indus Commission to mediate conflicts
between Pakistan and India;

5. Encourages Pakistan and India to collaborate with the Counter


Terrorism Committee (CTC) of the United Nations to:
a) Under the Financial Action Task Force (FATF):
i. Investigate and identify charitable organizations involved in
terror financing,
ii. Create a framework for establishing a certain criteria which
religious committees and groups must meet to be eligible for
government funding,
b) Create programs to facilitate the crackdown of terrorist groups
operating in Indian and Pakistani administered Kashmir,
c) Identify small arms and light weapons black markets which arm
terrorist groups,
d) Submit biannual reports of progress to the United Nations
Security Council;

6. Urges the committee to adopt the Peace and Prosperity initiative whereby:
a) Recognizes in the event of the failure of bilateral negotiations within 2
months,
b) Thse issue will be acknowledged as one which requires international
intervention;

7. Recommends extending the mandate of the United Nations Military


Observer Group within India and Pakistan whereby:
a) Monitoring and sending reports on human violations within Indian
Occupied Kashmir,
b) Monthly reports to be made to the United Nations Security Council
and the Office of the Commissioner of Human Rights,
c) The Indian government must permit personnel to observe the Indian
Line of Control to report ceasefire violations;

8. Recommends the implantation of the following measures in order to ensure


a de-escalation of tensions:
a) The international community must intervene to diplomatically and
economically influence India,
b) Hold India accountable for its violation of human rights through the
use of limited economic sanctions,
c) Calls for an end to the communications and social media blackout
and crackdown on free-speech by Indian security forces,
d) Recommends the AFSPA be amended to restrict the use of indefinite
military policing powers,
e) A gradual military withdrawal must be issued with all personnel
restricted to cantonment areas,
f) The de-construction of bunkers and check posts within Indian
Occupied Kashmir,
g) Calls for the establishment of a United Nations inquiry commission
under the Office of the High Commissioner of Human Rights to
investigate claims of human rights violations within Indian Occupied
Kashmir:
9. Recommends that new accountability measures and judicial reforms must be
put in place for the prosecution of Indian troops involved in human rights
violations:
a) Any and all civilians detained during the period of curfew must be
released,
b) Political leaders must be released from custody,
c) Recommends the establishment of special accountability courts
directly overseen by a bench constituted by the Indian Supreme
Court,
d) Further recommends that the trials be held publicly in order to ensure
greater transparency;

10. Appreciates South Africa’s Liberation struggle which ended in 1999 and
nominates it to act as a supervised Body for the Mutual Trusteeship and
Arbitration for the Future Of Kashmir and oversee its operations;

11. Recognizes the need for the establishment of a Mutual Trusteeship and
Arbitration for the Future Of Kashmir committee and the conduction of a
plebiscite:
a) Recommends the reconvention of the Trusteeship Council under
which only the demilitarization of Kashmir will take place by:
i. Simultaneous demilitarization by both Pakistan and India under
the principles of the McNaughton Proposals with a phased
approach,
ii. Withdrawal of the regular forces of Pakistan and India not
required for the purpose of security and maintaining law and
order,
iii. Demobilization of Azad Kashmir forces and Kashmiri State
Forces,
iv. Establishing a time frame for the demilitarization of forces from
both Pakistan and India,
b) The committee to be formed of 5 neutral members representing
different regions:
i. An additional member to be nominated by the secretary general
of the United Nations,
ii. The committee to work in collaboration with representatives
from both Indian and Pakistani administered Kashmir in order
to ensure a free and impartial plebiscite,
iii. India and Pakistan to be given observer status within the
committee,
c) The administration of the region to be overseen by the United Nations
Security Council alongside the Mutual Trusteeship and Arbitration
for the Future Of Kashmir committee, and to include the Kashmiri
people on a local government level;

12.Encourages the involvement of strategic partners of both countries such as


China to mediate and urge India and Pakistan to exercise restrain;

13.Encourages the mapping of the Kashmiri region in order to ensure fair


elections and proper demographics of the region are collected:

a) Mapping to be conducted by members of the Mutual Trusteeship and


Arbitration for the Future Of Kashmir committee,
b) Should include the use of satellites and GPS tracking,
c) Include the collection of data in regards to the ethnic and religious
demographics of the region;

14. Adoption of standardized principles for conventional arms control in South


Asia:
a) Indian military code must be reformed to classify pellet guns as
lethal weapons and outlaw their use,
b) Nullify the use of cluster munitions to target the civil
infrastructure,
c) Calls upon India and Pakistan to adopt weapon the International
Tracing Tool to reveal the sources of illicit weapons trade,
d) Recognizes the need to crackdown on dark-web trading of illegally
produced and untraceable 3D printed weapons through close
collaboration of international digital security groups including the
United Nations Group of Governmental Experts on Developments
in the Field of Information and Telecommunications;

15. Recognizes that the borders of the region must be secured in order to
prevent non-state actors from impacting the situation:
a) The area should be mechanized and the use of CCTV surveillance,
b) Increasing check posts along the borders of both Pakistan and
India,
c) Granting a general amnesty for militant and freedom fighters who
are willing to surrender in order to prevent an attack in the future,
d) Encourages India and Pakistan to launch internal investigations on
corrupt border personnel;
16. Recommends the establishment of a mutual security system under the
Pacific Settlement of disputes of the Security Council Charter so that
friendly parties of both countries can ensure the border security of each
nation whereby it will:
a) Involve strong allies of both India and Pakistan including China,
b) To ensure de-escalation between both countries;

17. Suggests the implementation of the IND frame work:


a) The Indian Armed Forces should be approached and invited to have
negotiations along with militant groups to advise both parties to
exercise restraint,
b) Efforts should be made by the Indian Forces to de-escalate the
situation by withdrawal of troops,
c) Militant groups should agree on refraining from inciting violence in
the region in return of withdrawal and promise of plebiscite
conduction,
d) Militant groups should be further advised not to exploit Madrassahs
and their students for inciting violence,
e) Should be ratified by both parties and sanctions should be placed if
India refuses timely withdrawal of troops,
f) Extreme crackdown should be imposed on militant groups if they do
not abide by the drafted agreement;

18. Recommends the implementation United Social security program bys:


a) A conference be held for the formation of a delegation to
represent the different regions of Kashmir,
b) Collaborate with the World Health Organization (WHO) to
provide medical aid and psychological assistance,
c) UNDP to develop a program for the economic revitalization of
Kashmir in developing infrastructure,
d) Establishing a database to ensure border security by creating a
registration system for all permanent residents of Kashmir;

19. Decides to remain actively seized on the matter.
