Preface
This publication has been updated to take account of regulation 3(2) being
amended to remove the requirement for HSE to approve the training and
qualifications of appointed first-aid personnel.
In this, the 2013 edition, the text of the Regulations has been amended to reflect
the change above, and to incorporate some additional amendments brought about
by other previous legislative changes. Furthermore, the first-aid Approved Code of
Practice has been withdrawn and associated guidance has been strengthened to
assist employers in their selection of first-aid training providers.

Introduction
1 The Health and Safety (First-Aid) Regulations 1981 set out the essential
aspects of first aid that employers have to address. This publication will help them
to understand and comply with the Regulations and offers practical advice on what
they need to do. Employers may also find it useful to look at HSE’s ‘First aid at
work’ web pages (see ‘Further information’). Practical guidance on first aid at mines
is given in a separate publication (see ‘Further reading’). These Regulations apply to
all workplaces, including those with fewer than five employees.

Regulation 2 Interpretation
Regulation 2 (1) In these Regulations, unless the context otherwise requires – “first-aid”
means –
(a) in cases where a person will need help from a medical practitioner or
nurse, treatment for the purpose of preserving life and minimising the
consequences of injury and illness until such help is obtained, and
(b) treatment of minor injuries which would otherwise receive no treatment
or which do not need treatment by a medical practitioner or nurse;
“mine” means a mine within the meaning of Section 180 of the Mines and Quarries
Act 1954.

Guidance 2 3 Employers have a legal duty to make arrangements to ensure their employees
receive immediate attention if they are injured or taken ill at work. It doesn’t matter
whether the injury or illness is caused by the work they do, what is important is that
they receive immediate attention and that an ambulance is called in serious cases.
First aid can save lives and prevent minor injuries becoming major ones. First-aid
provision in the workplace covers the arrangements that need to be made to
manage injuries or illness suffered at work. The Regulations do not prevent staff
who are specially trained from taking action beyond the initial management stage.
(2) Subject to paragraphs (3) and (4), an employer shall provide, or ensure
that there is provided, such number of suitable persons as is adequate and
appropriate in the circumstances for rendering first-aid to his employees if they are
injured or become ill at work; and for this purpose a person shall not be suitable
unless he has undergone such training and has such qualifications as may be
appropriate in the circumstances of that case.
(3) Where a person provided under paragraph (2) is absent in temporary and
exceptional circumstances it shall be sufficient compliance with that paragraph if
the employer appoints a person, or ensures that a person is appointed, to take
charge of –
(a) the situation relating to an injured or ill employee who will need help from
a medical practitioner or nurse, and
(b) the equipment and facilities provided under paragraph (1)
(c) throughout the period of any such absence.
(5) Any first-aid room provided pursuant to this regulation shall be easily
accessible to stretchers and to any other equipment needed to convey patients to
and from the room and be sign-posted, and any such sign to comply with
regulation 4 of the Health and Safety (Safety Signs and Signals) Regulations 1996
as if it were provided in accordance with that regulation.

5 The aim of first aid is to reduce the effects of injury or illness suffered at work,
whether caused by the work itself or not. First-aid provision must be ‘adequate and
appropriate in the circumstances’. This means that sufficient first-aid equipment,
facilities and personnel should be available at all times, taking account of alternative
working patterns, to:
You may choose not to use this optional framework and use an alternative
means to demonstrate compliance with your needs assessment. The
thinking behind this guidance, however, applies equally to whatever level of
training you choose (unless alternative guidance is provided for specific
instances).

11 Table 1 contains a checklist to help employers assess their needs and record
relevant information. Appendix 1 can act as a record of first-aid provision. The HSE
first-aid web pages also contain examples of needs assessment case studies for
different industry sectors and levels of hazard, to help explain what the result of a
first-aid needs assessment would look like.

14 Using your health and safety risk assessments you will have identified the
hazards in your workplace and the possible harmful consequences for employees
and others. This information will help you determine the level of first-aid provision.
For example, in organisations such as offices or shops, employers may only need
to provide an appointed person to take charge of first-aid arrangements, and a
clearly identified and suitably stocked first-aid box. However, even in these
circumstances it is still possible for an accident or sudden illness to occur and
employers may wish to consider having a qualified first-aider available.
15 Where the work involves higher level hazards such as chemicals or dangerous
machinery, or special hazards such as hydrofluoric acid or confined spaces, first-
aid requirements will be greater. Employers may then need to:

Guidance 3 16 In deciding on their first-aid provision, employers will need to take account
of different work activities in different parts of an establishment. For example, a
work site may contain production and office/administration areas. In such
circumstances, separate risk assessments will have to be made for individual
departments, and the results of these should be carried over to the assessment
of first-aid needs.
History of accidents
18 Information collected when investigating previous accidents/incidents
should be used when assessing the adequacy of future first-aid provision. For
large and/or multi-site organisations, this information could be helpful in
determining where first-aiders should be located, what geographical area they
should be required to cover and what first-aid equipment is necessary.
Work patterns
22 First-aid requirements may vary where employees work shifts or out-of-
hours. It is important that sufficient provision is always available when
employees are at work, and separate arrangements may have to be made for
each shift.

■■ the level of provision for employees does not fall below the standard required
by these Regulations;
■■ the level of provision for non-employees complies with any other relevant
legislation and guidance.

Records
31 It is sensible for employers to provide first-aiders and appointed persons with
a book in which to record incidents they attend. Any such book should be kept in
accordance with the requirements of the Data Protection Act 1998 (see ‘Further
reading’). Where there are a number of first-aiders working for a single employer, it
would be advisable for one central book to be used, though this may not be
practicable on larger, well spread out sites. The information to be recorded should
include:
32 This information can help the employer identify accident trends and possible
areas for improvement in the control of health and safety risks. It can be used for
reference in future first-aid needs assessments. These records may also be helpful
for insurance and investigative purposes. The record book is not the same as the
statutory accident book (see ‘Further reading’), although the two might be
combined.
RIDDOR
33 All employers, self-employed people and people in control of work premises
have duties under the Reporting of Injuries, Diseases and Dangerous Occurrences
Regulations 2013 (RIDDOR).2
34 They must report certain work-related injuries, cases of ill health and
dangerous occurrences. HSE will pass details to the relevant enforcing authority.
RIDDOR applies to all work activities but not all incidents are reportable.
First-aid containers
36 The minimum level of first-aid equipment is a suitably stocked and properly
identified first-aid container. Every employer should provide for each work site at
least one first-aid container supplied with a sufficient quantity of first-aid materials
suitable for the particular circumstances.
37 Depending on the findings of the first-aid needs assessment, more than one first-
aid container might be required on large sites. First-aid containers should be easily
accessible and preferably placed near to hand-washing facilities. They should only be
stocked with items useful for giving first aid and should be protected from dust and

Guidance 3 damp. All first-aid containers should be identified by a white cross on a green
background.3 Guidance on the contents of first-aid kits can be found in Appendix 2.
40 If mains tap water is not readily available for eye irrigation, at least one litre of
sterile water or sterile normal saline (0.9% w/v) in sealed, disposable containers
should be provided. Once the seal has been broken, containers should not be kept
for reuse. Containers should not be used beyond their expiry date.
41 There may be a need for items such as protective equipment in case first-
aiders have to enter dangerous atmospheres, or calcium gluconate for the
management of hydrofluoric acid burns. Such items should be stored securely near
the first-aid container, in the first-aid room or in the hazard area, as appropriate.
Access to them should be restricted to people trained in their use.
43 Some workers carry their own medication that has been prescribed by their
doctor (eg an inhaler for asthma). If an individual needs to take their own prescribed
medication, the first-aider’s role is generally limited to helping them do so and
contacting the emergency services, as appropriate.

48 A first-aid room will usually be necessary where there are higher hazards such
as in chemical industries or on large construction sites, and in larger premises at a
distance from medical services. A designated person should be given responsibility
for supervising it. The room(s) should be clearly signposted and identified by white
lettering or symbols on a green background.3
50 Typical examples of the equipment and facilities a first-aid room may contain are:
51 If the first-aid room(s) cannot be reserved exclusively for giving first aid,
employers need to make sure that the first-aid facilities can be made available
quickly if necessary. For example, they should consider the implications of whether:
■■ the activities usually carried out in the room can be stopped immediately in an
emergency;
■■ the furnishings and equipment can be moved easily and quickly to a position
that will not interfere with giving first aid;
■■ the storage arrangements for first-aid furnishings and equipment allow them
to be made available quickly when necessary.

52 Where the first-aid assessment identifies a need for people to be available for
rendering first aid, the employer should ensure that they are provided in sufficient
numbers and at appropriate locations to enable first aid to be administered without

Guidance 3 delay should the occasion arise. Where 25 or more people are employed, even in
low-hazard environments, at least one such person should be provided.
54 After completing the checklist in Table 1, the flow chart in Appendix 3 serves
as a general guide on how many first-aiders or appointed persons might be
needed. The numbers quoted in Appendix 3 are suggestions only. The employer
should take into account all relevant information to make a valid judgement.
First-aid training
58 Employers may obtain appropriate training from the Voluntary Aid Societies,†
who together are acknowledged by HSE as one of the standard-setters for
currently accepted first-aid practice (see paragraph 61) as far as they relate to the
topics covered in FAW (Appendix 5) and EFAW (Appendix 6) training courses.

Guidance 3 59 When an employer selects a training provider, they will need to be confident
that the provider will deliver training with appropriate content (ie content identified
as being appropriate within the needs assessment, and/or content in line with
Appendices 5 and 6), use suitable trainers and assessors, and has relevant and
robust quality assurance systems in place.4 (Similar quality standards are expected
of all first-aid training providers including non-affiliated, independent first-aid training
organisations.) All training providers should be able and prepared to demonstrate
how they satisfy these criteria.
61 Training organisations should use training material, and teach the first-aid
management of injuries and illness, as covered in FAW/EFAW training courses and
in accordance with:
■■ the individual being trained knows how to use the technology that delivers the
training;
■■ the training provider has an adequate means of supporting the individual
during their training;
■■ the training provider has a robust system in place to prevent identity fraud;
■■ sufficient time is allocated to classroom based learning and assessment of the
practical elements of the syllabus. HSE strongly recommends that elements of
the syllabus requiring practical demonstration of first-aid administration should
be assessed by direct observation to ensure the competence of candidates;
■■ the provider has an appropriate means of assessing the e-learning component
of the training.
Employers should also ensure they are complying with Regulation 13 of the Health
and Safety Management Regulations 1999, which has a requirement to ensure
adequate time is set aside during the working day to undertake any first-aid training
employees receive.
64 Where an employer decides to provide this training in-house, they will need to
establish that it is appropriate by ensuring that the content reflects the content of
the FAW or EFAW qualifications listed in Appendices 5 and 6 and is delivered in
accordance with currently accepted standards for first aid.

66 You may find it beneficial to maintain records of training. If you keep training
records, they should be retained for a minimum of three years after the assessment
process has been completed and any certificates should be in accordance with
paragraph 68. For further information see GEIS3 Selecting a first aid training
provider.5
67 There is no requirement for the checks you carry out when choosing a training
provider to be formalised or written down, although it may be useful for you to
retain a written record. By documenting the checks you have undertaken to confirm
the competence of a training organisation, and retaining a record of those checks,
you can demonstrate to an HSE or local authority inspector how you selected a
training provider.
Certificates
68 For an individual to demonstrate they have a competence in first aid they will
hold a certificate that contains all of the following minimum information:

78 Where an employer’s assessment of first-aid needs identifies that a
designated first-aider is not required, the minimum requirement for an employer is
to appoint a person to take charge of the first-aid arrangements, including looking
after the equipment and facilities, and calling the emergency services when
required. Arrangements should be made for an appointed person to be available to
undertake these duties at all times when people are at work.

Guidance 3 Therefore, it is important that someone is always available to take charge of the
first-aid arrangements, including looking after the equipment and facilities and
calling the emergency services when required. In the absence of first-aiders,
employers should appoint a person for this purpose. Appointed persons are not
necessary where there is an adequate number of first-aiders.
80 To fulfil their role, appointed persons do not need first-aid training, though they
may benefit from completion of an EFAW course (or other suitable alternative).
Given this, and the remaining possibility of an accident or sudden illness, rather
than providing appointed persons, employers may wish to consider providing
qualified first-aiders.
Regulation 4 An employer shall inform his employees of the arrangements that have been made
in connection with the provision of first-aid, including the location of equipment,
facilities and personnel.

of work (hypoallergenic plasters can be provided if necessary);

In addition to the above, when working in areas where you have significant exposure
to members of the public but are classified as low hazard you may wish to consider
EFAW training, as listed in Appendix 6, and the management of major illness.
