COUNTER – AFFIDAVIT
OF PREZEL SOLIVA LARROZA

I, PREZEL SOLIVA LARROZA, of legal age, single, Filipino,

with address at Jereos, Lapaz, Iloilo City, after being sworn in
accordance with law, hereby deposes and states that:

1. I am the respondent in Criminal Case NPS DOCKET NO. NPS-VI-

10-INV-18D-00303 for VIOLATION OF R.A. 8293, Sec. 170;

2. I am executing this Counter-Affidavit as a reply and comment to

the Complaint Affidavit of Duque R. Zingapan;

3. I am NOT the owner of B.Power Motorparts and Accessories. I am

but a mere cashier of B.Power Motorparts and Accessories. My
duties and responsibilities as a cashier is to receive payments from
the customers and to remit the day’s sale to management. I have
no knowledge whatsoever how my employer sells her
merchandise, where she got her stocks or who her supplier is.
Being a mere cashier, I cannot distinguish what is a fake KOYO
merchandise or otherwise. I do not participate in the ordering,
purchasing and receiving of the merchandise being sold at our
store. I do not sell any merchandise to customers. I just man the
cash register and accepts payments;
4. I am only a high school graduate and a minimum wage earner;

5. My co-employees and I were surprised when the personnel of the
NBI conducted their search and seizure last March 14, 2018. They
told us that we are selling fake KOYO bearings. Despite of this, all
of us cooperated and provided our names, and the search and
seizure were done peacefully;

6. That in the Search Warrant, the ONLY subject is the

owner/proprietor;

7. During the abovementioned search and seizure by the personnel

of NBI, Michael Iguidez and I were forced to sign as witnesses by
a female NBI agent;

8. Then on May 8, 2018, we received a Subpoena to appear before the

Hon. Pros. Nazelle A. Biliran-Infante on May 16, 2018;

9. My co-employee, Michael Iguidez-our mechanic, and I are scared

because:
a. because I have not been accused of any crime in all my life nor
have I committed one. The thought of going to jail keeps me
awake at night,
b. because I do not understand the things I am accused of, and
c. because I do not have the financial capacity to legally defend
myself. This counter-affidavit alone cost me a whole month of
salary;

10. To reiterate, Michael Iguidez and I are not the owner /proprietor
of B.Power Motorparts and Accessories;

11.WHEREFORE, in the interest of justice, it is respectfully prayed

that the instant criminal complaint be DISMISSED for lack of
merit;

12.FURTHER, the respondent respectfully prays for such and other

reliefs as may be deemed just and equitable in the premises.
