PETITION

Petitioner, through the undersigned counsel and before this Honorable

Court, states that:

1. Petitioner UZUMAKI KUSHINA, is of legal age, a Filipino citizen,

single and a resident of No. 426 Balsigan, Davao City;

2. UZUMAKI NARUTO, whom guardianship is prayed is an 11-year-

old minor, and a resident of No. 423 Balsigan, Davao City, attached
herewith is the photocopy of the minor’s birth certificate and marked
as Annex “A”;

3. Sometime in October 3, 2015, Ms. SAKURA HARUNO, the mother

of UZUMAKI NARUTO was diagnosed with ENDOMETRIAL
CARCINOMA STAGE III-C CANCER and hereby consents to the
petition for guardianship over the person of the above-named minor
and for the issuance of the corresponding letters of guardianship in
favor of Mr. JOSE MALECDAN;

4. The biological father of UZUMAKI NARUTO is a Canadian citizen

living in Calgary, Canada with another family;

5. Ms. SAKURA HARUNO, the mother of minor UZUMAKI

NARUTO, is the co-owner of a house located at No. 423 Balsigan,
Davao City, and likewise the owner of several shares of stocks of
SATARAH INCORPORATED, and due to her unfortunate health
condition wishes to transfer ownership over the said properties to
minor UZUMAKI NARUTO, her compulsory heir and be the subject
of guardianship as well;
 6. The names, ages and residences of the relatives of the named minor
are the following:

7. Letters of guardianship over the person and properties are prayed for
by petitioner, who is the godfather of the minor, and with whom the
minor is entrusted every time the mother of the minor is not capable
of performing her obligations due to her unfortunate health condition
and considering the fact that the father of minor is not residing in the
Philippines, the latter being a Canadian citizen and has his own family
there.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed

of this Honorable Court, that after due notice and hearing, the petitioner be
appointed guardian over the person and properties of minor UZUMAKI
NARUTO and that corresponding letters of guardianship be issued in his
favor.

Such other reliefs and remedies which may be just and equitable
under the circumstances are likewise prayed for.

1. I am a petitioner in the above-stated case representing the republic
of the Philippines;
2. I caused the preparation of the foregoing petition;
3. I have read the contents thereof and the facts stated therein are true
and correct of my personal knowledge and/or on the basis true and
authentic records.
4. I have not commenced any other action or proceeding involving the
same issues in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;
5. To the best of my knowledge and belief, no such action or
proceeding is pending in the Supreme Court, the Court of Appeals, or
any other tribunal or agency;
6. If I should thereafter learn that a similar action or proceeding has
been filed or is pending before the Supreme Court, the Court of
Appeals, or any other tribunal or agency, I undertake to report that
fact within five (5) days therefrom to this Honorable Court.
