ANSWER

I, JOCELYN L. PEDARIA, of legal age, Filipino, single, currently residing

at 60-D 14th Avenue, Murphy Cubao, Quezon City, state the following that:

1. I am a ticket seller III and have been with DOTr-MRT3 since 1999;

2. I received a formal charge against me and was given 72 hours from receipt
to answer for the same;

3. I am the person being formally charged with the following to wit:

a. Violation of Reasonable Office Rules and Regulations for

bringing in personal money amounting to Four Hundred
Pesos (P400) in the Ticket Office of 23 October 2018 in
violation of Office Order No. 2002-147 regarding the Use of
Locker Cabinets at Stations;

b. Serious Dishonesty (Qualified Theft) for concealing the act of

taking money for personal reason from your sales
amounting to One Hundred Sixty Pesos (Php160.00) and
from the sales of Ms. Analyn D. Dimaculangan, Ticket seller
II, amounting to One Thousand One Hundred Pesos
(Php1,100.00) which resulted to her shortage on 23 October
2018)

4. In response to the offenses charged against me, I admit that I have

inadvertently violated the rule regarding the former but vehemently deny
the latter, for Serious Dishonesty:

1
a. During the start of my shift on 23 October 2018, at around 6
am, I was already prepping my self for work;

b. As my usual routine for the past Nineteen (19) years, I usually

place my calculator, scissors, and ball pen in my pouch bag;

c. Also, I also placed inside a letter for my son to be sent in Leyte

through my Niece, Angeline Tagoy, who will be travelling to
Leyte on the same day and I was supposed to give my niece an
allowance for her travel;

d. I went to my station because of the rush hour, placed the said

pouch in the drawer and started my shift;

e. At around 10am, my niece suddenly passed by the office

earlier than scheduled, so I went briefly outside to meet her;

f. Before going outside, I went to the drawer to get the letter for
my daughter and inadvertently found my money in the
amount of Four Hundred Pesos (PHP400.00);

g. I suddenly remembered that I was supposed to give the

allowance which I left in our locker room downstairs after my
shift for my niece;

h. Considering that I was still in the middle of work and it will

take me a long time to go downstairs to get the allowance for
my niece, I took the Php 1,100.00 and Php 160.00 from my
cash register as well as the Php400.00 from my pouch and
gave the same to my niece;

i. I immediately went back to work to continue my shift;

j. Around 1pm, I asked Henrich Lopena to lend me Php 160.00

and PHP 1,100.00 from his cash register to replace the money
I took earlier. Mr. Lopena told me to just simply take the
money because he was busy during that time, so I did;

k. I ended my shift and went home, but before the same, I gave
Ms. Analyn Dimaculangan, Mr. Lopena’s reliever, Php160.00.

2
but accidentally forgot to also remit Php1,100.00 when I was
on my way home;

l. Considering that I was already on my home, I decided to

return the money the following day;

m. On 24 October 2018, during my shift, I was called by

management as well as Mr. Lopena, Ms. Dimaculangan
regarding herein incident before I got to return the money;

5. It was not my intention to steal the money considering that as far I can
remember, I informed my co-workers that I borrowed the money;

6. I admit that I borrowed the money, but I deny the charge against me that I
stole the same;

7. Considering the 19 years of work I rendered, I have no intention to commit

the charge of Serious Dishonesty for the said amount of in the complaint;

8. This answer is hereby submitted today, 22 February 2019.

IN WITNESS WHEREOF, I have hereunto set my hand this day of 22

February 2019, in Quezon City.
