RENT AGREEMENT

This rent agreement is made at Gurugram on 1st March, 2020 between:

MR. K.D. DHANDA S/o LATE SHIRI KASHI NATH & MRS. INDRA DHANDA W/o MR. K.D.
DHANDHA, BOTH R/o HNO – 800, SECTOR 12, PANCHKULA. (hereinafter called the First
Party), of the one part.

AND

MR. PRASHANT GANDHI, S/o MR. RAJENDRA PAL GANDHI, R/o HNO. 21, E-2.1, VATIKA
INDIA NEXT, SECTOR 82, GURUGRAM – 122012 (hereinafter called the Second Party), of the
one part.

The Expression First Party and Second Party shall mean and include his successors, assigns,
and representative.

Whereas, the First Party is the lawful owner in possession of MAPSKO CASSA BELLA, Tower
AB1, Unit No. 1202, Sector 82 Gurgaon – 1220012. (hereinafter referred to as “The Said
Property”).
NOW THESE PRESENTS WITNESSETH AS UNDER.
WHEREAS the FIRST PARTY has agreed to let out the SECOND PARTY and the LESSEE has
agreed to take on rent the portion comprising 3 Bedrooms, 3 Bathrooms, Drawing Cum
Dining & Kitchen (hereinafter referred to as “the Demised Premises”) subject to and on the
terms and conditions contained in this agreement; and WHEREAS the FIRST PARTY has
represented that the Demised Premises are free from all encumbrances and the FIRST
PARTY has a clean and unrestricted right to the Demised Premises and is legally competent
to enter into this House Lease Agreement (The Agreement) on the terms and conditions
contained herein.
1. That the tenancy of the above said premises shall continue from 1ST March 2020 to
31ST JANUARY 2021 for a period of 11 months from the date of tenancy. Any
enhancements hereinafter in the maintenance will be borne by the Second Party
during the tenure of the contract period.
2. That the Second Party shall pay the month rent of RS 11,979/- (Rupees ELEVEN
THOUSAND NINE HUNDRED AND SEVENTY NINE ONLY) All maintenance charges will
be paid by the Second Party.
3. That the Second Party shall pay the Electricity charges to the Concerned Department
regularly. And give the original receipt to the owner. The Second Party will be
responsible for safety of Electricity Meters and will get replace if it goes out of order
during the contract period.
4. That in case the SECOND PARTY requires the said premises for any period beyond
the expiry of this agreement. He will seek the permission of the FIRST PARTY before
termination of the agreement. However, in case the FIRST PARTY agrees to extend
the period of agreement it will be done on fresh terms and conditions as agreed to,
by both parties by fresh rent agreement on mutually agreed rent.
5. That the Second Party will not make any addition, alteration in the rented Premises
without the written permission from the First Party.
6. That the Second Party will not sublet any portion of the rented premises to any other
person and maintain the premises neat and clean.
7. That if the Second Party vacate the rented premises before 11 months in that Case
he shall serve one month notice to the First Party. And clear all the pending dues
before vacating the said Flat.
8. That the First Party has also received RS 13000/- (Rupees THIRTEEN THOUSAND
ONLY) as the security deposit and RS 11,979/- (Rupees ELEVEN THOUSAND NINE
HUNDRED AND SEVENTY NINE ONLY) one month advance rent from the Second
Party. Also, the last rent will not be adjusted against the security deposit as same will
be returned by the First Party after the adjustments of any type of damages to the
property at the time of vacating.
9. That in case of default for non-payment of rent, the First Party shall be fully entitled
to get the rent along with penal interest of 18% p.a. through court of law under
specific performance of contract at the cost & risk of the Second Party.
10. That the Second Party will abide by all the rules and regulations of “NIMBUS” or any
competent authority enforced from time to time.
11. That the property shall be used only for residential purpose.
12. That if First Party wishes to get vacate the rented premises before the Contract
period he shall serve one month notice to the Second Party.
13. That the Second Party shall at the time of occupation verify that all sanitary fittings,
electric fittings or other fittings and fixtures are in perfect order and that nothing is
broken or missing.
14. The SECOND PARTY shall restore them in the same condition when handing over the
possession back to the FIRST PARTY.
15. That the SECOND PARTY shall permit the FIRST PARTY or his agents to enter upon
the demised premises for inspection and / or / carry out repairs at any reasonable
time as and when necessary.
16. That since complete maintenance of the premises has been carried out before
handing over of the said premises to the SECOND PARTY. No maintenance will be
carried out by the FIRST PARTY during the period of the said agreement.
17. That the major structural repairs or major repairs shall be carried out by the FIRST
PARTY at his own cost. Minor and day to day repairs such as Fuses, leakages of the
taps, breakage of glasses panes or wood work, repair of electrical filaments and
connection etc. shall be carried out by the SECOND PARTY at his own cost.
18. In witness whereof both the parties have signed on this rent agreement on the Day
of month and year first above mentioned in the presence of the following witnesses.
19. There will be escalation of 10% of the rent after 11 months by mutual
understanding.
