1) DEFINITIONS .........................................................................................................................................................................3
In meeting each of the obligations below (but without limiting its legal obligations to DB Schenker or generally), the Contractor
must comply with all applicable laws, Standards and DB Schenker requirements. However, the Contractor is not required to
comply with a DB Schenker requirement where to do so would be unlawful (unless the Contractor could make it lawful by
obtaining a license, permit, qualification or similar approval required for products or services that the Contractor has agreed
to provide).
1) DEFINITIONS
Personnel: Includes the Contractor’s employees, agents and subcontractors (including work experience students and delivery
drivers)
Site Manager: The person designated by DB Schenker as manager of a particular site, or if no such person is advised, the
person who is the manager in charge of that site at the relevant time.
Works: The physical activities performed on site in accordance with the specifications and other requirements agreed in
writing between DB Schenker and the Contractor. The Works exclude non-physical activity (e.g. consultancy services).
Standards: The Australian, New Zealand or other applicable industry standards, as the case may be.
Chemicals: Dangerous goods, hazardous substances, schedule 5 or 6 poisons or combustible liquids (C1 and C2).
4) PERSONAL SAFETY
4.1 Clothing and Personal Equipment
The Contractor must ensure that the Personnel dress appropriately for each task and wear fully closed-in footwear at all times.
The Contractor will be responsible for providing personal protective clothing for all Personnel as required by DB Schenker and
the nature of the work, and also for ensuring that they are worn as and when appropriate.
4.2 No Smoking Policy
The Contractor will ensure that all Personnel observe the smoking restrictions in force on DB Schenker premises.
4.3 Drugs/Alcohol
No person will be permitted to enter or work on DB Schenker premises while under the influence of illegal or narcotic drugs
or in an intoxicated state. Alcoholic beverages must not be consumed or stored on the premises.
4.4 Harassment or discrimination
The Contractor must ensure that its Personnel comply at all times with all laws and DB Schenker policies regarding harassment
and discrimination. In particular, the Contractor will assist DB Schenker to provide an environment in which employees,
contractors, customers and visitors can work without interference caused by harassment or discrimination. Any form of
harassment or discrimination will not be tolerated.
4.5 Pedestrian Safety
The Contractor will maintain a minimum 3 metre separation from operating Material Handling Equipment (Forklifts etc.)
4.6 Mobile Phone Usage
If there is a need to use a mobile phone, the Contractor must remain stationary in a safe place away from mobile plants.
6) FIRE PROTECTION
6.1 Evacuation and Fire Procedures
The Contractor must ensure that all Personnel complete the site-specific orientation, including evacuation and fire procedures,
prior to commencing the Works.
The Contractor must ensure that its Personnel are familiar with all emergency procedures for the site, including the location
of the emergency exits and evacuation assembly points.
In carrying out the Works, the Contractor must not restrict or impede emergency evacuation routes or access to fire
extinguishers, hoses or doors.
6.2 Smoke detectors
Permission must be obtained from the Site Manager prior to the commencement of Works that may produce dust or smoke.
Isolation of smoke detectors or other fire protection equipment may be required by DB Schenker before any hot or dusty work
is commenced. In such cases, a Fire Protection Equipment Impairment Notice must be completed (see 7.3 below).
7) WORK PERMITS
7.1 Hot Work Permits
The Contractor may not commence any task likely to produce a source of ignition, such as welding, within DB Schenker
premises without a hot work permit approved in writing by the Site Manager or DB Schenker employee. The Contractor must
adhere to all of the requirements in the permit.
7.2 Confined Space Permits
All entry to a confined space will comply with the relevant confined space Standards and laws.
7.3 Hazardous Works permit
The Contractor must complete a Hazardous Works Permit before commencing any of the following activities:
• Roof work
• Trenching and excavation work
• Crane operations
• Energy isolation (water, gas and electricity)
An authorized representative of the Contractor must approve the permit before the Personnel can commence hazardous work.
For the purpose of this permit, the authorized representative is the Contractor’s supervisor or the principal contractor’s
supervisor (where the Contactor is not the principal contractor)
9) SITE MANAGEMENT
9.1 Site Security
Photo ID Badges must be worn at all times.
Bags, toolboxes and other containers may be inspected by DB Schenker when Personnel leave the site.
Unauthorized use or removal of DB Schenker equipment is forbidden, as is the unauthorized use or removal of any other DB
Schenker property, including intellectual property (such as documentation or software), or of DB Schenker’s confidential
information.
Entry into sections of a building other than the designated work area is forbidden.
If working on the roof, the Contractor must ensure that all doors, ladders and other means of access are closed or secured to
prevent unauthorized access.
If access is required outside of a DB Schenker site’s normal trading or operating hours, arrangements for after hour’s access
should be made with the Site Manager.
9.2 Clean Work Environmental/Waste Disposal
The Contractor will be responsible for maintaining a clean and tidy worksite. All waste will be disposed of by the Contractor
off-site, unless the Site Manager or DB Schenker employee specifies otherwise.
All precautions must be taken to minimize the generation of environmental hazards, such as exposure to chemical substances,
dust, fumes, gases and vapor. In some cases, this may mean completing a job outside normal trading hours (but only where
authorized in writing by the Site Manager).
13) SUB-CONTRACTORS
The Contractor must ensure that all sub-contractors’ safety performance is monitored.
In addition to any rights of termination or other remedies that DB Schenker may have under an agreement with the
contractor or otherwise at law, DB Schenker may require the contractor to immediately remove from DB Schenker
premises any of its personnel who are (or who are causing the contractor to be) acting unlawfully or in breach of any
occupational health and safety laws or DB Schenker requirements. Upon receipt of such a request, the contractor
will remove the personnel in question and make available a suitable replacement as soon as possible. DB Schenker
will have no liability to the contractor in respect of such a replacement.
