ADMINISTRATIVE ORDER 3-30-20

ORDER ADDRESSING JURY NOTIFICATION AND HEARINGS


PURSUANT TO RULE 33.05 WHILE DOCKETS ARE SUSPENDED

WHEREAS the Federal government has extended its “social distancing” policies until April 30,
2020, and the States and localities will likely follow suit in coming days, and

WHEREAS, logistical questions have arisen regarding the summoning of jurors and hearings for
criminal defendants pursuant to Missouri Supreme Court Rule 33.05 during the period of
suspended proceedings,

WHEREFORE, the Presiding Judge hereby enters the following order:

1. Administrative Order 3-23-20 and 3-16-20-3 shall continue to be in full force and effect
to the degree those prior orders are not modified by this Order.

2. During the period of suspended proceedings pursuant to Orders 3-23-20 and 3-16-20-3 or
any subsequent order, no notices shall be sent to prospective jurors summoning them to a
specific jury trial on a specific date. All jury trials for which notice would be required to
be sent during the suspension period will be continued from their current trial date even
though that trial would occur on a date not currently covered by the suspension order.
All jury trial summonses already sent during this period of suspended proceedings shall
be recalled and the prospective jurors will be informed by the office of the Circuit Clerk
that they are not compelled to appear for jury duty.

3. The Court finds that all hearings which would occur within seven days of the initial
appearance of a criminal defendant pursuant to Missouri Supreme Court Rule 33.05 are
hereby continued for good cause shown, namely, the COVID-19 pandemic, and shall be
re-scheduled by the judge of the division to which that case is assigned. The hearing
pursuant to Rule 33.05 may be held during or after the period of suspended proceedings
at the judge’s discretion. Any defendant may make an application for review of the
defendant’s detention or conditions of release under Rule 33.01, which shall be heard as
soon as practicable by the duty judge by videoconference.
