presented retrenchment was the valid ground termination. The SC made an
equal assessment on the rights to property of the company and the rights
of the laborers. Since the company suffered financial loss, the need to
removal of the employees were justifiable. When the termination of
employment is due to retrenchment to prevent losses, or to closure or
cessation of operations of establishment or undertaking not due to serious
business losses or financial reverses, the separation pay is only an
equivalent of one (1) month pay or at least one-half (1/2) month pay for
every year of service, whichever is higher.
