Exec WHEREAS, on March 12, 2020, 1, Steve Sisk, Governor of the State of Nevada ismed 4 Declaration of Emergency t facie the State's response to the COVID-19 pandemic; and WHEREAS, on March 18, 2020, Doosld J. Tramp, President of the United States declared a nationwide emergency punuant to See. 501(b) of the Robert T. Staford Disaster Relief and ‘Bmergency Assistnce Act, & USC. 5121-5207 (Whe “Stafford Act) and WHEREAS, porsvant to NRS 414070(), the Governor may exercise the power “Yo auborze providers of emexgency medial services and providers of mental health services who are not lceneed, ‘xtifed or registezed, as aplicable, in this State bue hold # license, certificate, sepstation or simile czedenil in good standing in another sate ofthe United States, the Distt of Cohumbia, the CCommonweslthof Puerto Rico of any testy o insular possesion subject to the jtisdiction ofthe United States to practice their profession within thet scope of practice as if they were icented, crtfied or registered, as applicable, in this State for the amount of time necessary to ait ia _espoading tothe emergency or disaster” nd WHEREAS, pursuant to NRS 414070(7), the Governor may perform and exercise such other functions, powers and duties as are necessary to promote and secue the sufety and protection of the civilian population; snd WHEREAS, NRS 4141101) provides tat all functions under Chapter 414 and al other scvites reltng to emergency management ae hereby declared to be governmental functions. WHEREAS, NRS 414.110() provides that any requirement for license to practice any professional, mechanical of other skill doce not apply to any authotized wotker who, inthe course of perfouming his or her duties as such, practices that profesional, mechanical or other sill during an emergency o& aster WHEREAS, NRS 414.110() defines “works” to include without limitation any full-time or part time paid, volunteer or atiiry employee ofthis State, of ay politcal sublision thereof, of other stites, tetris, possessions or the District of Columbia, of the Federal Goverment, of any neighboring county, or of any politcal ubdivsion thereof, or of any agency oF organization, petfotming servicer for emergency management at any place inthis State subject to the order of Eontrol off or pursuant toa sequent af the Site Government or any polseal subdivision thereof and WHEREAS, Nevada saust be prepared to expand its health care workforce to protect ts citizens ‘who requie emergency ca and services and ensure all crical medical resources aze avilable to ‘dei and teat those impacted by COVID-19 dusing this emergency, WHEREAS, Asicle 5, Section 1 of the Nevada Constcation provides: “The supreme executive power of this State, shall be vested in a Chief Magistrate who shall be Governor of the Sate of Nevada" and NOW THERBFORE, bythe thority vested in me as Governor by the Constitution and the laws ‘of the State of Nevade and the United States, and pussust to the March 12, 2020, Emesgency Declantion, ITS HEREBY ORDERED THAT: SECTION 1: The waiver of licensing provision of NRS 414.110 i hereby invoked. Any medical facility as defined by NRS 449.0151, laboratory, fo pharmacy employe or contacts with «provider of emergency medial aves wh isnot licensed in Nevada dusing this declated emergency most ensure thatthe provider bas notified the applicable Nevada license board or agency ‘The Chief Neal Officer and, to the extent necssuy, the appropiate professional licensing bourd shall expedite the processing nd final dxposiion of all plications to practice under che txt ofthis Disective |A provider of medical services during this emesgency is authorized to supervise stadents in their profession to provide any emergency medical services as i tpproptiate to the stents knowledge and skill level without furcher licensure of ceriieaton. This restriction shall not bbe construed to prohibit the suspension ot revocation of Heenses for reasons that jeopatize patent helt, including without limitation, incompeteney or malpractice. SECTION 15: This Directive shall remain in effect wn specifically modified or terminated by 2 subsequent Directive promulgated puseuant to the Mazch 12, 2020 Declaation of Emergency o facilitate the State's zxponte tothe COVID-19 pandemic.
