execution of the following works by the MCD from approved and eligible contractor and will be received as per time table and will be
opened on 15.01.2019 at 11.03 AM. on website http:// mcdetenders.com by Dy. Director (Horticulture) / Rohini Zone. The registered
contractors of MCD only are eligible to tender for the amount they have registered in their respective category subject to the conditions that
they are neither black listed nor debarred at the time of purchase of tenders. The contractor shall have to produce registration certificate,
TIN (tax payers Identification Number). The validity of rates will be counted from the date of negotiation. Conditions given in the printer
NIT form A-32 chapter VI of Mpl. Account Code Part-I will hold good. The contractors will have to give a declaration about the name of their
relatives employed in MCD along with each tender. The contractors will have to submit a lost of Hort. Woks which are in hand at time of
purchase of tenders as mentioned below: 1. Name of work 2. Name of division 3. Amount of work 4. Date of completion. As per agreement
5. Position of work 6. Remarks (Reasons for delay, if any,) or as applicable. Bidding Documents can be downloading from the website-
http://mcdetenders. com. Deduction of VAT at source shall be made as per the rules. The desirous contractors shall have to Pay the Tender
cost and Earnest Money mentioned against the work at the time of download of tender documents and the same has to deposited in the
time of Re-encryption of online bids. The responsibility of correctness and geniuses of all the documents submitted by the contractor solely

Deduction of VAT at source shall be made as per rule. The desirous contractors shall have to pay the tender cost and Earnest Money
mentioned against the work at the time of download of tender documents and the same has to be deposited at the time of Re-encryption of
online bid in the office of the DDH/RZ. The responsibility of correctness & genuine of all the documents submitted by the contractor solely
lies on the contractor. Detailed NIT can be seen on the Notice Board in the office of the undersigned. Tender containing detailed terms &
conditions can also be seen in the office of under designed.
SPECIAL CONDITIONS

1) The Contractor/Supplier shall carry out all tests required and pay all charges in connection their including fee for testing as may specified
to be conducted by an approval testing authority or Dy. Director of Hort. Unless otherwise specified. However, no testing charges will be
borne by the contractors/suppliers for testing conducted in MCD laboratories. In all cases, cost samples and to an from cartage shall be
borne by the contractor. Nothing extra shall be payable to the contractor of the above of testing charges where levied.
2) Contractors/Suppliers shall be responsible to arrange all his own cost for necessary tools and plants required for the execution of the
work. The contractor shall bear all incidental charges for cartage.
3) All incidental charges of any kind whatsoever including cartage, storage, cutting and wastage etc. shall be borne exclusively by the
contractor and nothing extra shall be paid to him on this account. Nothing extra shall be paid to the contractor/suppliers for delivery to the
MCD stores/sites as supplier for delivery of the goods to the MCD stores/stores as specified in the contract document.
4) Rate for all items to work shall, unless clearly specified otherwise include cost labour, material and other inputs involved in the execution
of the item.

5) The contractor/supplier shall be required to produce samples of all material sufficiently in advance to obtain approval of the Deputy
Director of Horticulture. Subsequently the material to be actually supplied shall strictly conform to the quality or samples approached. In
case of variation, such material shall be liable to rejection. All the approved samples be preserved till the completion of the supply.
6) In addition to the detailed specification stipulated in the relevant C.P.W.D specification, the children play equipments shall be brought to
the stores or place of supply by the supplier will prime and there after the children play equipment shall painted by the supplier in store or
place of supply.
7) Whenever necessary, the supply may be got tested by Dy. Director of Hort. through MCD laboratory or from other laboratories and the
contractor/suppliers shall not make any objection to the same.

8) The supply made by the contract/supplier shall be liable to be tested by the S.E. Quality Control of MCD by the Chief Technical Examiner
Officer of the Govt. of India and the contractor/supplier shall not made objection to such testing by such testing authorities. The findings,
test result arrived at by the S.E. Quality Control of the Chief Technical Examiner’s Office shall be binding on the contractor/suppliers and
shall have to agree with any short of recovery pointed out to him by the Dy. Director of Horticulture as a consequence of the testing done
by the S.E. Quality control or by the Chief Technical Examiner’s Office or by any other as per the advice to the Dy. Director of Hort.

9) Work would be carried out on holidays.

10) No material will be issued by the department.

11) The requirement provided should be safe in operation and free from danger to the playing children. If necessary, the deviation on
higher side of strength shall be allowed that stipulated in the drawing if it is necessary for giving added strength shall be allowed.

12) The tenders should have guarantee against manufacturing defects for period of six months from the date completion of the work extra
item shall be considered in such cases.
ADDITIONAL CONDITIONS

1) Arbitration Clause : Except where otherwise provided in the contract all questions and disputes relating to the meaning of the
specifications, designs, drawing and instructions herein before to the mentioned and as the quality of workmanship of material used on the
work or as to any other question clai,right matter or thing whatsoever in estimate instruction orders or these conditions or otherwise
concerning the work or the execution of failure to execute the same work arising during the process or the work or after completion or
abandonment shall where referred to the same arbitration of the person appointed by the Commissioner, MCD at the time of dispute or the
administrative head of MCD at the time of such appointment. It will be no objection to any such appointment that the arbitrator so
appointed is a Government Servant that be had to deal with the matter to which the had expressed views on all or any or the matter in
originally referred being transferred or vacation his office or being unable to act or any reason the Commissioner or Administrative Head as
aforesaid at the time such transfer vacating or officer or indemnity to act, shall appoint another person to as arbitrator in accordance with
from the state at which it was left by his processor, it is also a terms of this contract that no person other than a person appointed by the
Commissioner or Administrative Head of MCD as aforesaid should act as arbitrator had in any person that is not possible that matter is not
be referred to arbitrator at all cases where the amount if the claim on dispute of Rs. 25,000/- and above the arbitrator shall give reason for
the award.

2) Subject as aforesaid the provisions of Arbitration Act, 1960 or any statutory modification or re-enactment thereof and the rules made
there under and for the time being enforce shall apply to the Arbitration proceeding under this clause. It is terms being of the contract that
part referred arbitration under this clause together with the amount that claimed in respect of such dispute. It is also a term of the contract
and if the contractor(s) do/does not made any demand for arbitration in respect of any claim in writing within 90 days receiving the
intimation from the Corporation or any officer authorized in this behalf that the bill in ready for payment the claim of the contractor will be
deemed to have been waived and absolutely barred and the Corporation shall be discharged and released of all liabilities under the contract
in Rs. 10,000/- the award of the arbitration shall be a speaking award.
1) The Arbitrator’s mau from time to time with consent of the parties entarge the time for aking and publishing the award. The decision of
the S.E. regarding the quantum of education with justifications there of in respect rates of sub standard work which may be decided to be
accepted will be final and would not be opened the arbitration.
2) The contractor shall not deposit any material on any site which may cause serious inconvenience to the public or in the execution of
work, the instructions by the officer in charge of the work shall be carried out by the contractor fail to remove the material causing
inconvenience to the public of Govt. work in the officer in charge of the work may remove such material at cost of the cost of contractor any
loss of material in the process if a cause will be borne by the contractor.

3) Engineer-in-Charge reserves the right of increase or decrease the quantity of supply upto 33% and the supplier will have no objection to
each increase and decrease in quantity.
4) If the contractor/supplier supply inferior material and the same is rejected by Engineer-in-Charge the rejected material will have to be
removed from MCD Store within 3 days after the issue of rejection letter failing which the same shall be removed at the risk and cost of
supplier.
5) The material supplied by the contractor shall be properly stacked and the contractor will have to see that the same is measured soon
after the supply is made Government will not be responsible for any loss before it is measure.

6) No execution of time shall be granted if adequate and valid reasons are not given well in time.
7) 7% Income Tax will deducted from the contractor and 1% from the sub contractor if the total payment under the contract is likely to
exceed to Rs. 10,000/- only given letter No. F(S)/CA/F&C623 dated 13-04-1988.

8) The contractor shall have to engage capable work against who can instruction of the drawing and who can carry out work according to
the instruction of the Officer-In- Charge and as per specifications.
9) The supply shall be made at place specified in the supply order.
10) Conditional tenders will not be entertained and are like to rejected.
11) The work will be carried out as per 1985 Delhi Schedule Rate with correction slip upto date and including correction slip No. 10
circulated vide No. D/EE/(P)III dated 24.02.1989, I CPWD specifications 1977 Vol. II with correction slip No. 15 circulated vide No.
D/50/EE/(P) 19-03-1990 except where otherwise specified in the description of item given in the schedule of qualities. In case it is silent,
that relevant ISI standard nation building code revised upto date will be applicable. In absence of all the sound Engineering practices as per
decision of Engineering-in-Charge shall be final.

12) In case the contractor deposit security in shape of fixed deposit he will be responsible personally for getting it renewed in due date and
the MCD will no tender against any claim for loss of interest in fixed deposit due to its no-revalidation in time.

13) In case if flats, angles and joints etc. steel used in the work shall be measured as per design or as authorized by the Engineer-in-
Charges

14) Final bill shall be paid to the contractor only after affecting the essence of work.

15) Final bill shall be paidto the contractor after affecting recoveries based on C.E.’s observations or otherwise.
16) The rates of items including cost of material and labour exclusive of all carriage unless and otherwise specified in the item and nothing
extra shall be payable on that account.
17) The contractor is responsible for passing or plans etc. to any unauthorized hand either in person or in full under provision on Sec. 2 and
5 of the Official Secrets Act.

18) The contractor shall quote his rates in figures as well as in words the rate amount tendered by them. The amount for such items shall
be worked out the requisite total given. Special case should be taken to write the rate in figures as well in words and the amount in figures
only in such interpretation in not possible. The total amount should be written both in figures and words.
19) The contractor shall not be permitted to tender or work in the MCD circle responsible for work and execution of contract in which h is
relative is near posted as Divisional Accountant or an officer in any capacity between grades of Sup. Eng. & J.E. He shall also intimate the
name of person who are working with his any capacity or are subsequently employed by him and who are near relative to any JE/Gazetted
Officer in MCD and breach or his condition by the contractors would tender him liable to be remove from the approved list of contractors for
Department.

20) LIST OF ACTS AND COMMISSION FOR WHICH THE FINE CAN BE IMPOSED In accordance with the rule(d) of the CPWD Contractors
labour regulation to be displayed predominantly at the site of work both in English and local languages. In case the amount awarded by the
Arbitration exceed Rs. 20,000/- and from time to time with consent of the parties only at the time or making and publishing the award.
1) With full in-subordination or dis-obedience, whether along or including with others.

2) The fraud or dishonestly in connection with contractor besides the business or property of MCD.
3) Taking or giving bribe or any illegal rectification.
4) Actual late attendance.
5) Smoking near or around the area where combustible or any other material are locked.
6) Habitual negligence.
7) Habitual indiscipline.
8) Drunkness sictour or disorderly or indifferent behaviour.
9) Causing damage to work in the progress or to the property of MCD.
10) Sleeping on duty.
11) Malingering slowing down work.
12) Giving of false information regarding name, age father’s name etc.
13) Habitual less or wise cards supplied by the employees.
14) Unauthorized use of employer’s property or manufacturing or making unauthorized article at the work place.
15) Bad workmanship in construction and maintenance by skilled workers which is not approved by the Department and for which the
contractor compelled to undertake rectifications.
16) Making false complaints and misleading statement.
17) Engaging on trade within the premise of the establishment.
18) Any unauthorized divulgence of business affairs of the employees.

19) Collection or canvassing for the collection of any money within premises of an establishment unless authorized by the employers.

20) Holding meeting inside the premises without prior sanction of the employer.
21) Threatening or intimidating any workman or employees during the working hours within the premises.

22) In addition to the detailed specification stipulated in the relevant CPWD specifications, all the steel work shall be brought to the stores
or the place of supply by the supplier with primary cost thereafter it should be painted by the supplier in store i.e. place of supply.
23) It shall be responsibility of the contractor to provide deep hand pump/tube wells at the site or work to made available the safe drinking
water free from any contamination to the labour engaged in the work.
24) All te tubes used shall confirm to the ISI 1161/1960 along with all the upto date correction slips regarding tubes.
