Ministry of Corporate A airs (MCA) has noti ed Companies ((Appointment and Quali cation
of Directors) fourth Amendment Rules, 2018. These Rules shall came into e ect from 10th
July, 2018. The Two major amendments that are done -

In order to remove the tag of Active-non compliant status, then company has to le for
ACTIVE e-form, with the penalty of Rs. 10,000. And in order to remove the tag of De-
activated DIN, director has to le DIR-3 KYC form with a penalty of Rs. 5000.
It`s Time to Change
Also, if any director’s DIN is deactivated they are not eligible for ling of any company Your
compliance. Therefore, it becomes necessary for a director to change their DIN status from COMPLIANCE OFFICER
de-active to active by ling of DIR-3 KYC.
With the circular No. 11 dated 24th March, 2020, MCA has provided the company and their
directors with another chance for ling of DIR 3 KYC and ACTIVE (Active Company Tagging
Identities and Veri cation) without any penalty.
As per this noti cation, if the lling will be done on or before 30th September, 2020 there
will be no penalty.

ACTIVE (Active Company Tagging Identities and Veri cation) is a new compliance update
from MCA. The ling of this mandatory for all the companies which are incorporated on or
before 31st December 2017.
All the organisations (whether private limited, public limited, OPC, or LLP) registered on or 4.59 average
