COMPROMISE AGREEMENT

THE UNDERSIGNED PARTIES:

DIEGO RECTO, Filipino, of legal age with residence address at 123

Matapang Street, Mandaluyong City, (hereinafter reffered to as PRIVATE
COMPLAINANT);
-AND-

JUAN MASIPAG, of legal age with addresses at 20 Pacific Place,

Ayala Avenue, Makati City and MELCHOR GASPAR also of legal age
with address at 38 Lapu-Lapu Street, Pasig City (hereinafter referred to as
the ACCUSED);

AGREED AS FOLLOW

1. The accused, JUAN MASIPAG, without going into the merits of

the above entitled case, solely for the purpose of buying peace and full
settlement of the civil aspect of said cases, shall pay the PRIVATE
COMPLAINANT in installment via postdated checks (PDCs) payable in
TWO (2) years,, the amount total of Two Million (PhP2,000,000)
(hereinafter referred to as the PAYMENT), representing the total monetary
claims together with other fees and charges of the latter, by way of
amicable settlement;

2. That, upon actual receipt of the full value of the PAYMENT,
PRIVATE COMPLAINANT shall cause the dismissal of the above entitled
cases by executing an Affidavit of Desistance and/or Motion to Dismiss, or
any other document to that effect in favor of all the ACCUSED in said
cases;

3. The actual receipt of the full value of the PAYMENT shall

constitute as the PRIVATE COMPLAINANT’s, together with his assigns
and heirs, ultimate waiver of any rights, whatsoever, on the checks subject
matter of these cases;

4. The full compliance with the terms and conditions of this

Agreement shall constitute as the final settlement of the civil aspects of the
above-entitled cases and all other claims and causes/s of action that the
PARTIES might have against each other, in relation to the above entitled
cases, shall be considered waived. And

5. The PARTIES shall cause the filing of this Agreement from the
Honorable Courts wherein the cases are pending for its approval and that
judgment be rendered in accordance therewith.

IN WITNESS WHEREOF, the PARTIES hereto have mutually and

voluntarily agreed to the above stipulations, and sign this Agreement on
this _____ day of _____________ 2018, for the consideration and approval
of this Honorable Court.

This instrument refers to a Compromise Agreement consisting of four (4)

pages, including this page wherein this acknowledgment is written and
the attachments, each and every page of which has been signed by the
parties and their instrumental witnesses.
