The new law addresses the perceived weaknesses in RA 8049 which merely
regulated hazing or initiation rites. So week was the law that only one
conviction was made in the 23 years since it was passed.

Hazing is an initiation rite or practice as a
prerequisite for admission into membership in
a fraternity, sorority or organization by placing
a recruit, neophyte or applicant in some
embarrassing or humiliating situation such as
forcing him to do menial, silly, foolish and
similar tasks or activities or otherwise
subjecting him to physical or psychological
suffering or injury.
Elements of Hazing:
3. The act includes but is not limited to the following: paddling, whipping,
beating, branding, forced calisthenics, exposure to the weather, forced
consumption of any food, liquor, beverage, drug or other substance, or
any other brutal treatment or forced physical activity which is likely to
adversely affect the physical and psychological health of such recruit,
neophyte, applicant, or member.
NOTE:
Interestingly, under the present law, hazing covers not only initiations as a
prerequisite to an admission into membership to an organization or fraternity
but also those acts which are inflicted or enforced for continued
membership.
Banned under the law are "all forms of hazing" not only in fraternities,
sororities or organizations in schools, but also those in communities and
even businesses and uniformed service learning institutions.

8. Former officers, nonresident member, alumni of the fraternity, sorority,
or organization who, after the commission of any of the prohibited acts

officials allowed or consented to the conduct

All existing and new fraternities, sororities, and other organizations are
required to be registered with proper school activities before conducting
activities on- or off-campus, including recruitment of members.
All fraternities, sororities, and other organizations are also required submit
the name of names of their faculty advisers who must not be members of the
respective groups.
The law also compels the schools to take more proactive steps to protect its
students from the dangers of participating in activities that involve hazing.
