SECTION 11166.5,
CHILD ABUSE REPORTING
Seotion 11166.5 of the California Penal Code states, in part:
On or after January 1, 19R5, any mandated ceporter ,.. prior 10 commencing his or her
employment, and as a prerequisite to that employment, shall sign a statement on a form provided to him,
or her by his or her employer to the effect that he or she has knowledge of the provisions of Section
11166 and will comply with is provisions.”
Section 11166 of the California Peral Code states, in par:
““A mandsted reporter shall mace a report to an agency ... whenever the mandated report, in his
or her professional capacity or within the scope of his or her employment, has knowledge of or observes a
child vhom the mandated reporter knows or reasonably suspects has been the vietim of child abuse or
neglecl. The mandated reporter shall make a report to the agency immediately or as soon as is practicably
possible by telephone, and the mandated reporter shall prepare and send a written report thereof within 35
hours ofteceiving the information concemming the incicent.”
Section 11165.7 of the California Penal Code defines a “mandated reporter” as including: teacher: an
instrucional aide; « teacher's aide or a teacher's assistant employed by any public ot private school;
classed employee of any public school; an administrative officer or supervisor of child welfare and
attendance, or cenficated pupil personnel employce of any public or private school, any empleyee of a
counyy office of education or the California Department of Education, whose duties being the employee
in contact with children on a regular basis; a headstart teacher; an employee ofa school district police or
seourity department.
Section 11167 (¢) of the California Penal Code explains states in part:
“The identity of all persons who report under this article shall be confidential and disclesedt only
amongagencies receiving oF investigating mandated report... or when those persons waive confidentiality
or by court order.”
‘The California Penal Code Section 11172 (2) provides that mandated reporters are TMMUNE FROM
LIABILITY, as provided, in part, as follow: .
“No mandated reporter shall be civilly or criminally liable for any report required or authorized
by this article.”
‘The Caifumia Penal Code Section 11166 (b) provides penalties for FAILURE TO REPORT is follows:
“Any mandated reporter who fails to report an incident of known or reasonably suspected child
abuse er neglect as required by this section is guilty of a misdemeanor punishable by up to six months
confinement in a county jail or by a fine of one thousand dollars ($1,000) or by both that fine and
punishment,”
