3 A RESOLUTION OF THE CITY OF BOCA RATON URGING

4 PALM BEACH COUNTY TO RE-OPEN BEACHES,

5 PASSIVE PUBLIC AND PRIVATE PARKS AND TENNIS

6 COURTS, AND PRIVATE GOLF COURSES TO THE

7 PUBLIC WHILE CONTINUING TO FOLLOW CURRENT

8 CDC GUIDELINES IMPLEMENTING COMMUNITY

9 MITIGATION STRATEGIES TO CURTAIL THE SPREAD OF

10 COVID-19 IN PUBLIC PLACES DURING THE DECLARED

11 PUBLIC HEALTH EMERGENCY; PROVIDING FOR

12 REPEALER; PROVIDING AN EFFECTIVE DATE

14 WHEREAS, on March 20, 2020, in connection with the COVID-19 public health

15emergency, Florida Governor Ron DeSantis issued Executive Order 20-70 (subsequently

16extended on March 31, 2020 by Executive Order 20-90) (the “State EO”), ordering, among other

17things, the closure of all beaches within Palm Beach County (including beaches within the City

18of Boca Raton), subject to further action by Palm Beach County; and

19 WHEREAS, on March 25, 2020, Palm Beach County (“County”) issued Emergency

20Order No. 3 (subsequently amended on March 29, 2020 by Emergency Order No. 3a) (the

1“County EO”), ordering the closure of all public and private parks and recreational facilities,

2including golf courses and tennis courts, within both the unincorporated and incorporated areas

3of Palm Beach County (including public parks within the City of Boca Raton), and such County

4EO supersedes any conflicting or contradictory municipal order; and

5 WHEREAS, in the event that beaches, public and private parks and tennis courts,

6and private golf courses can be used and enjoyed by the public in a passive manner, without

7unnecessarily exposing either government personnel or members of the public to an increased

8risk of infection from COVID-19 while continuing to follow the current guidelines issued by the

9Centers for Disease Control and Prevention (“CDC”) and Florida Department of Health

10(“FDOH”) implementing community mitigation measures (such as social distancing and the use

11of cloth face coverings) to curtail the spread of the COVID-19 in public places, the City Council

12supports the relaxation by the County of the County EO and the State EO for the passive use of

13such beaches, parks, tennis courts, and golf courses; and

14 WHEREAS, the City Council supports the passive use of beaches, public and private

15parks and tennis courts, and private golf courses, and the re-opening of same to the public as

16soon as prudently possible, provided that such re-opening does not redirect government

17personnel and resources to these facilities or unnecessarily expose either government

18personnel or members of the public to an increased risk of infection from COVID-19; now

19therefore

1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOCA

2RATON:

4 Section 1. That the City Council urges Palm Beach County to relax portions of the

5County EO and the State EO to allow beaches, public and private parks and tennis courts, and

6private golf courses to be re-opened, used and enjoyed by the public in a passive manner,

7without unnecessarily exposing either government personnel or members of the public to an

8increased risk of infection from COVID-19, while continuing to follow the current guidelines

9issued by the CDC and FDOH implementing community mitigation measures (such as social

10distancing, the use of cloth face coverings and, in the case of golf courses, such social

11distancing measures prescribed by the National Golf Foundation) to curtail the spread of the

12COVID-19 in public places, as soon as prudently possible, and at such time and in a manner

13that will not redirect government personnel and resources, or unnecessarily expose either

14government personnel or members of the public to an increased risk of infection from COVID-

1519.

16 Section 2. If any section, subsection, clause, or provision of this resolution is held

17invalid, the remainder shall not be affected by such invalidity.

18 Section 3. All resolutions or parts of resolutions in conflict herewith shall be and

19hereby are repealed.

20 Section 4. This resolution shall take effect immediately upon adoption.
