1. GENERAL
All orders placed with Temper Energy International, S.L. (hereinafter referred to as the Vendor)
are subject to these general conditions and constitute full acceptance by the customer of the
conditions unless otherwise specifically agreed by the parties. All other conditions not agreed by
the vendor will be deemed null and void.
2. ORDER CONFIRMATION
Orders must be specifically confirmed in writing before they can be accepted by the vendor.
The sale shall only comprise the products ordered, except in specific cases in which the dispatch
of documentation or additional media has been agreed.
Orders must include the date and clearly specify the delivery address for the goods.
Measurements, weights, dimensions and technical specifications appearing in our catalogues are
provided for information purposes only and may be subject to change without prior notification.
3. PRICE AND TERMS OF PAYMENT

The terms of payment are set in advance by the parties and registered by the vendor unless, in
specific cases, a different arrangement has been agreed.
If a customer places an order for equipment that needs to be specially manufactured to meet
their specific requirements, the vendor reserves the right to ask for a down payment amounting
to a given percentage of the total value of the order when it is confirmed.

4. DELIVERY TIME AND CONDITIONS

The goods are delivered packaged by complete unit.
The delivery time and conditions are agreed beforehand by the parties.
Unless otherwise stated, the conditions of sale are understood to be 'ex works'.
5. PARTIES
For international orders, the delivery conditions will be agreed by the parties at the time the
order is confirmed.
6. CLAIMS AND REFUNDS

Should a claim be made in respect of a product malfunction, the goods in question will be verified
and checked by the vendor.
Under no circumstances will products be refunded if they are not returned in their original
packaging and in good condition.
No returns will be accepted without the prior agreement of the vendor.

In the case of refunds for causes not attributable to the vendor, a minimum of 15% will be deducted
from the net invoiced amount as a restocking and repackaging fee and to cover administrative
costs. For export orders, the purchaser will also be liable for any eventual carriage and customs
costs incurred by returning the goods to our premises and these will be deducted from the refund.
Please consult the conditions for each individual case.
7. WARRANTY
In accordance with the law, all products are guaranteed against manufacturing defects for two
years. Defects due to improper use or handling are not covered by the warranty.
To make a claim on the warranty, please contact the distributor from whom you purchased the
product and attach your invoice along with a detailed description of the observed malfunctioning.
We will then send the product to the technical department to have it analysed.
8. LIMITATION OF LIABILITY AND APPLICABLE LAW

Civil liability for our products expires one year after delivery. Temper Energy International declines
all liability due to misuse of its products.
These conditions are governed and interpreted in accordance with Spanish laws.
In the event of litigation as a result of a sale, both parties submit to the jurisdiction of the Oviedo
law courts and the purchaser waives any other jurisdiction that may apply.
