Advanced Course on Trademark Law

Internal Assessment
(Draft)

A. Project 10 Marks
General Instructions:

1. Students may choose any project topics of their choice.


2. No project topics shall be registered without submission of an abstract.
3. Students are required to submit the abstract / synopsis as per the notification of academic office.
4. The project consultation may be had on prior appointment basis.
5. The soft copy of the completed project work shall be submitted to TURNITIN and the hard copy
shall be submitted as per the instruction of academic office.
6. In respect of projects which are theoretically oriented judicial interpretations are to be furnished.
7. In respect of case studies a review of the whole case has to be written as per law applicable.
8. The marks for the project will be accorded in terms of content analysis and presentation.
9. The Project Report of the Course should be only in typed and printed version.
10. Word limit
a. Synopsis: 300 words
b. Completed Project: Minimum of 2500 words (excluding footnotes)
11. Citation format: Bluebook 20th Edition

B. Viva – Voce on Project: 5 Marks


The dates for Viva-Voce will be notified after the submission of the completed project.

 Response to Questions

Note: Students are required to submit the following components on or before 2nd May, 2020 at 3
p.m. through ACADLY.

1. Revised Synopsis
2. Review of Literature
3. Research Objective
4. Research Question
5. Tentative Chapterisation
6. Bibliography

C. Continuous Assessment: [15 Marks]

For the academic year 2019-20, the continuous assessment for this course is as follows:

 Assignment: 10 marks
 Quiz: 5 marks [Total: 15 Marks]

Assignment:

Students are hereby instructed to submit any one of the three assignment type mentioned below
of their choice.

Note: Both ‘Individual and Group Assignments’ are allowed. A group may consist of minimum of 2
students and a maximum of 4 students and can be constituted only with the approval of course faculty.
The marks will be awarded on following basis

Assignment Type 1:
Trademark Filing: [10 marks]
Marking Component 1:
Create a trademark of your interest and submit an application for registration of your trademark
(inclusive of trademark search and classification under Nice Agreement) (5 marks)
Marking Component 2:
Draft a suitable opposition draft against a trademark application. (5 marks)

Assignment Type 2:
Case law analysis: [10 marks]
Interested students shall opt for a decided case from trademark law with the approval of course
faculty. The following components are essential
a. Facts
b. Procedural History
c. Issue (and questions presented)
d. Holding (and conclusions)
e. Analysis (rationale)
In addition a student may add other consideration like dicta, dissent and personal comments etc. If
there are any difficulty in getting access to the judgment, you can contact the course faculty. Please

Commercial Exploitation of Trademark: [10 marks]


Marking Component 1:
Draft a suitable Trademark License and Franchise Agreement (5 marks)
Marking Component 2:
Draft a suitable Trademark Assignment Agreement (5 marks)
