SOFTWARE LICENSE AGREEMENT

The software on this disk is owned by The American Radio


Relay League, Incorporated (ARRL) and its licensors. It is
protected under applicable copyright laws. Your right to use this
software is limited to the terms and conditions described herein.
If you do not agree to the terms and conditions of this license
agreement, return the software immediately to ARRL.

LICENSE

You own the compact disc (CD-ROM) on which this software is


encoded. All intellectual property rights in the software remain
the property of ARRL and its licensors. YOU MAY (1) use the
enclosed software on a single computer; (2) physically transfer
the software from one single computer to another if you delete
the software from the computer on which it was originally
stored; and (3) make one [1] copy of the program in machine-
readable form solely for backup purposes, if you reproduce the
copyright notice and any other proprietary legends on a label on
any such backup copy. You may not sell this backup copy.

YOU MAY transfer this software to anyone, provided you


maintain no interest in, nor copies of, the software, and provided
the transferee agrees to abide by the terms and conditions of this
Agreement.

YOU MAY NOT (1) distribute unauthorized copies of this


software to anyone; (2) rent, lease, or grant sublicenses or other
rights to, this software; or (3) provide the software for use in any
network or other multiple-computer system or as part of a
computer service business without the prior written consent of
ARRL.

TERM

Your license to use this software will automatically terminate if


you fail to comply with the terms of this Agreement. If this
license is terminated, you agree to destroy all copies of the
software.

LIMITED WARRANTY

This software is provided "as-is" without warranty of any kind,


either expressed or implied, including but not limited to the
implied warranties of merchantability and fitness for a particular
purpose. The entire risk as to the quality and performance of the
software is with you. Should the software prove defective, you
(and not ARRL) assume the entire cost of all necessary
servicing, repair or correction.

Some states do not allow the exclusion of implied warranties, so


the above exclusion may not apply to you. This warranty gives
you specific rights and you may also have other rights that vary
from state to state.

ARRL does not warrant that the functions contained in the


software will meet your requirements or that the operation of the
software will be uninterrupted or error free. However, ARRL
warrants the CD-ROM on which the software is furnished to be
free from defects in material and workmanship under normal use
for a period of ninety (90) days from the date of purchase, as
evidenced by a copy of your receipt.

LIMITATION OF REMEDIES

ARRL's entire liability and your exclusive remedy shall be:

The replacement of any CD-ROM not meeting ARRL's


"Limited Warranty" that is returned to ARRL with a copy of
your receipt. In no event will ARRL be liable to you or to any
third party for any damages, including lost profits, lost savings,
or other incidental or consequential damages arising out of the
use or inability to use such software, even if ARRL has been
advised of the possibility of such damages. Some states do not
allow the limitation or exclusion of liability for incidental or
consequential damages, so the above limitation or exclusion may
not apply to you.
