ANS: Negotiation is a method by which people settle differences. It is a process by which


compromise or agreement is reached while avoiding argument and dispute.

ANS: Negotiation is a contemporary form of dispute resolution. It is a part of the ADR


system of resolving disputes out of court. ... The dispute concerns both parties in such a way
that the parties are dependent on each other. The parties should have the willingness to settle
the dispute.

ANS: There are certain essentials and certain characterstics of negotiation, they are

 The dispute concerns both parties in such a way that the parties are dependent on each
other.
 The parties should have the willingness to settle the dispute.
 The dispute at hand should be negotiable.
 The voluntary consent of both parties to negotiate on the dispute
 There is a minimum of two parties present in any negotiation.
 Both parties have pre-determined goals that they wish to achieve.
 There is a clash of pre-determined goals, that is, some of the pre-determined goals are
not shared by both the parties.
 There is an expectation of outcome by both parties in any negotiation.
 Both parties believe the outcome of the negotiation to be satisfactory.
