BRIEF BACKGROUND OF THE SPEAKERS

On the 27th day of February 2020 the College of Business Administration Bachelor of
Science and Entrepreneurship conducted a seminar-lecture about BIR that has
correlation with the title "Starting up a Business held at CBA Incubator room". And this
was led by three representatives from the said government institution (BIR). They are
Ms. Carla Christine S. Manajero, a graduate from the Ateneo de Davao University, she
has been employed for 3 years in BIR, she passed the CPA board exam last October
2017. The second speaker named Ms. Kristine Mae E. Tajan, she is also an alumni
from Ateneo de Davao University and has been employed for 2 years in BIR, she
passed the CPA board exam last October 2017. And the last speaker addressed as Ms.
Adrianne N. Molina a alumni of Holy Cross of Davao College, 3 years of being
employed in BIR and passed the CPA board exam last October 2017.

What I have learned during the seminar on DTI, when you have a new business or
business idea that is not yet exist in the market you need to seek protection first before
you commercialize it. That is because if you just implement it without registering first,
someone might steal and do register it in DTI claiming to be the first who think and
create of that new business and might have the power to report you by stealing such
idea that is supposed to be yours. If you want to register your business and does not
want someone can plagiarize, so it is better to register it under Trade Secret the
example company that register under this is Coca Cola Company. Also, I learned that
generic product is not meant as really cheap or entitled to be using of cheaper raw
materials, this is just simply means that it might be the entity has expired registration or
its patent has been expired and the raw materials are using has been exposed so that
other brand/brands can also produce that kind of product or imitate, the speaker said
that if you buy generic products you must choose the brand that is not too cheap.
What I have learned in BIR is that if a person who are subject to internal revenue tax
he/she is required by the law be registered with the BIR. The responsibilities of the
business establishment is to register the business establishment, File and pay
corresponding taxes like income tax, business tax, withholding tax and etc., and issue
receipt or invoice for every sale.

What I have learned in FDA seminar we had, is that they are the one who come
personally to your business they will inform you that they might come and visit or just
surprise you to see and check the place if you follow all the required procedures on
producing the products you are selling to the public if it is safe or not. The speaker said
that if you have a business and you used your house as a manufacturing or where you
produce the products it is very much prohibited because once your business violated
the rules or precautions your business will be closed also your house so you cannot
enter to your house. The speaker said that you must have a place and a building to your
business so that if that business of yours will be closed your house is not affected. The
FDA has an exception like karenderya, retailers, etc.

I learned that the Department of trade and industry is committed to protecting the rights
and interest of the consumers and is also committed to developing policies and
programs aimed at sustaining the growth and development of the Philippine economy.
DTI also provides protection to consumers through consumer education and information
dissemination programs. The DTI also clustered its work basis of core themes, which
collectively seek to promote a more effective and co-ordinated approach to
implementation of strategic objectives for an enhanced and long-term impact of the
country.

Also, I learned that it is very important to obtain registration certificate whether you are
a freelancer or a business owner m. BIR form 2303 and CERTIFICATE OF
REGISTRATION (COR), this type of document gives you the legal rights to operate
business in the Philippine l. All professionals licensed by the Philippine regulatory
commission, Non-licensed professionals like freelancers and people with digital careers,
sole proprietors, partnerships, corporate and cooperatives should have this sheet of
paper and should take care of it. It provides you with the tax identification number (TIN)
for your business, if you are a professional as a sole proprietor, your personal TIN is
the one indicated in the Certificate of registration. It also states the types of taxes you
will settle. Many business owners are hesitant to register their venture because the
process can be expensive and time consuming. But having a legitimate business is
beneficial to your business and its growth.

Lastly, I learned that FDA is task for protecting the public health specially by ensuring
the safety, efficiency and security of human and veterinary drugs, biological products
and medical devices. FDA also dealing with a large organization can frequently be time
consuming, frustrating experience. Although there is no acceptable panacea, FDA has
instituted a number of activities aimed at casing this problem for regulated small
business. There are also units that provide technological assistance to small companies
hold exchange meetings to hear the views and perspectives of small business, conduct
educational workshop, develop informational materials and provide and accessible,
efficient channel through which small business can acquire information from FDA.

DTI or Department of Trade and Industry is one of the government agencies that
entrepreneurs must comply its requirements. As a future entrepreneurs we have
discussed during the seminar the requirements needed for you to operate a business. I
also learned that if your a sole proprietary business you need to register your business
on DTI, if you are in a corporate business you need to register your business on CS. I
also learned how to categorize your business and how important it is to have an
attractive business name. DTI's job also is to secure the rights of every consumer
especially when we talk about price of the products offered in the market. They also
cater consumers complaints towards uncertain actions by the manufacturer or
businesses. I also learned that its a first registration basis, which means that who ever
the first one to register the specific business name he or she is has the right to use it.
Even if you have the same name use with the others and you did not register it to DTI
you have no right to complain toward any authorities.

All businesses must compile the requirements needed that the government imposes.
One of this is the requirement imposes by the B. I. R. Applying to the b. I. R. You need
to pass all the necessary documentary requirements. Such as, certification, land title
and the mayor's permit. And then, the B. I. R will give you a certificate of registration
that issued confirming registration of your business. In the B. I. R you should also know
all the tax that you need to pay such as, income tax, registration fee and others.

FDA or The Food and Drug Administration is the national health product regulatory
agency created by Rebuplic Act (RA 3720). FDA regulates the drugs, medical devices,
food, cosmetics and toys, and household /urban hazardous substances. If you will offer
these products you must comply the FDA's requirements. Which are accomplished
application form, proof of business name registration, risk management plan and so on.
FDA's role also is to inspect the business establishments in the Philippines. FDA also
inspect all ingredients that have been used in your product offered. For example food
and cosmetice, FDA make sure that you do not use ingredients that are not fit for it or
ingredients that may have bad effect to your customers.

The Philippine Department of Trade and Industry or DTI is a prime mover of consumer
welfare. It is committed to protecting the rights and interests of the consumers and is
also committed to developing policies and programs aimed at sustaining the growth and
development of the Philippine economy. Besides overseeing the effective
implementation and enforcement of trade regulation and fair trade laws, the DTI
provides protection to consumers through consumer education and information
dissemination programs.

The Bureau of Internal Revenue or BIR is an agency of Department of Finance. BIR

collects more than half of the total revenues of the government. Every person subject to
internal revenue tax are required by the law to be registered in BIR under section 236 of
the NIRC. There are different forms of registration under BIR from 1901-1905. The
documentary requirements are the certification, contract of lease and the Mayor's
permit. There are different invoices and receipts indicated and different kinds of taxes
that will impose to different businesses.

The Food and Drug Administration (FDA) is a government agency established in 1906
with the passage of the Federal Food and Drugs Act. The agency is separated into
divisions that oversee a majority of the organization's obligations involving food, drugs,
cosmetics, animal food, dietary supplements, medical devices, biological goods, and
blood products. There are laws, rules and regulations implemented. There are 2 FDA
authorization: The License To Operate(LTO) and the Certificate of Product
Registration(CPR). There are documentary requirements such us proof of business
name registration and proof of payment. There are 4 covered establishments: Drug,
Food, Cosmetics, Medical devices establishments. The Republic Act no. 10611 is a
regulatory system to insure Food safety all the mandates must be follow in every
businesses.

DTI has come up to help in setting set up your own business and be a smarter
entrepreneur to earn more. But before anything else when starting up a business there
is foremost a need to register the entity or a sole proprietary entity with DTI. As stated
of the speaker during our seminar that DTI can help embrace the right and positive
entrepreneurial attitude that will carry through vibrant entrepreneurial behaviour. That is
because of DTI's Negosyo Center program as mentioned by the speaker. This program
infuse an entrepreneurial mind-set that is all about success and innovation-driven,
collaborative, and proactive. In a Negosyo Centers, they teach to master the know-how
& how-tos of entrepreneurship, from what are the needs to set up a business, basic
rules of spotting market opportunities, finding product positioning and differentiation,
product development, market development, basic business finance and plan
preparation, as well as developing a system for continuous innovation. It is very
important that I have known part of it because as entrepreneur student this information
will help my mind-set and willingness grow to become businesswoman in the future.
There are lots of topic we have during the seminar but this topic has created space
remained in my heart and mind. Recently, I have doubts if I could still pursue my
profession as entrepreneur after I will be graduated, it is just that I think of financial
instability if I will really pursue. But because of the seminar I have known that DTI is not
about paying for a registration but it will help every entrepreneur lift up a dream to
become successful. Once I will already have my business, DTI’s Negosyo Centers can
help me when applying for my business registration and permit to make it easy for me to
do business.

There are many organizations nowadays that hold taxation seminars which can range
from basic tax compliance topics to more specialized tax programs and other business
documents that needs to be complied topics. Our subject integration has dealt a
seminar within a class, and so our group was assigned to ask for a speakers from
Bureau of Internal Revenue (BIR) to discuss more about taxes compliance especially
when starting up a business. The Bureau of Internal Revenue or BIR is an agency of
Department of Finance. One of the most important thing that I have learned is that taxes
are inevitable. Whether you own a business or you’re just an individual, it is an
obligation to file and pay taxes. As what one of the speaker discussed that there are
corresponding tax rules to consider when filing and paying. Such as income tax,
business tax and withholding tax that are becoming responsibilities of an entity or
establishment to fulfil. It is a best practice to know and understand some concepts to
avoid committing mistakes that will lead up to unnecessary penalties. Especially for me
as an entrepreneur student I should be aware of these. In the nearer future if I will
pursue my profession to become entrepreneur and build my own business, since I am
aware of these things then everything will be good to go. In the future I can immediately
avoid unnecessary penalties and operate my own businesses smoothly. To completely
perform these things the forms when registering a business will be under BIR FORM
1901 for, BIR FORM 1903 for, BIR FORM 1905 for and BIR FORM 2303 for. In addition,
I have learned that businesses must also comply requirements needed that the
government imposes. First things first a business will be fully owned and fully legal
when it specified as certified by BIR. In compelling as certified by BIR the necessary
documents to comply forthwith are certification, land title and the mayor's permit.
Thereafter, the BIR will provide a certificate of registration that issued confirming
registration of the business. This is very significant that as entrepreneur student must
know. Enable to be mindful and have power on my creativity to build new and modern
ideas. And to be knowledgeable on how am I going to start with accurately following the
process of starting up a business.

The Food and Drug Administration of the Philippines was created under the Department
of Health to license, monitor, and regulate the flow of food, drugs, cosmetics, medical
devices, and household hazardous waste in the Philippines. The FDA's main goal is to
ensure the health and safety of food and drugs made available to the public. The
seminar that has conducted in our class is very relevant to the all of us inside of the
room especially because we are entrepreneur student. The importance of knowing FDA
rules and regulations is very attention seeking matters. For me as entrepreneur student,
and hand my preference of putting up a business into fields of foods, the seminar had
helped me figured out things that should be taken up when starting a business like
such. It is never that easy to open up a business like what I have said to where field I
am preferred for. Since it also important for me the welfare of every customer, so in the
future if I will put up a business like in the food industry there is a need to comply
thereof for the rules and regulations implemented by FDA government agency.
According to the speaker during the seminar, there are laws, rules and regulations
implemented. Like, These rules and regulations will help me rectify foods to be created
and sell appropriately. (Republic Act No. 10611) "An Act To Strengthen The Food and
Safety Regulatory System In the Country To Protect Consumer Health And Facilitate
Market Access Of Local Foods And Food Products, And For Other Purposes." This
means the assurance that food will not cause harm to the consumer when it is prepared
or eaten according to its intended use. If I will be entitled on this in the future, therefore I
value customers more than my intention of providing them true satisfaction and
convenience.

Thus, by having all of these knowledge it can be easier for me to completely put up a
business like such field. And, by having my willingness in the future to comply with the
rules and regulations imposed by FDA government agency simply meant of also putting
true and pure value for future customers.

To register the business name DTI is the agency where entrepreneurs should comply.
The the business is sole proprietorship it is register in DTI. One of the requirement to
register is the business permit that is issued by the Local government unit. DTI protects
the rights and interest of the consumer. The agency also issued policies and program
that are effective for the implementation of trade regulation and fair trade laws. DTI
protects the intellectual property of the a person. Trademarks is represent as the
reputation of the company it is any word slogan symbol or design or combination that
identifies business. It is the brand of goods and services. Patent is the invention of the
entrepreneur or any formulation of the products that are exclusive. Copyright is to
protect creation or literary works od an individual. What difference about trademark and
business name is that trademark I what the company known by the public while
business name is what being register to any agencies of the government or any private
sector.

In business it is important to have legal documents that enable business to operate

legally in the market It also have responsibilities to the government which imposed laws
in the country. It all starts at BIR. Business cannot operate without tax identification
number (TIN).It is needed to register the business either Sole Proprietorship partnership
or even corporation. Establishment and all its branches are need to be register in the
agency. Once it is registered, BIR already expects to pay the taxes as a business.
Being an register business gives an advantage that protects the company’s reputation
and of the customer. Consumers tend to buy products from credible and trustworthy
brands. When the business is registered, it is required to display the certificate and
other forms in the establishment, such as the Mayor’s Permit, Sanitary Permit, Health
Clearance, and Fire and Safety Inspection Certificate. These documents have the
power to make customers feel safe. They will be more confident to purchase goods and
recommend by the establishment. This gives the chance to attract more customers and
gain more profit.

Being an entrepreneur student it is beneficiary for us to know about how to start a

business and what are the licenses to operate from the DFA and compliance of the
business to other government agencies. The seminar thought us that it is important to
have food safety inspection specially when our business is in the food industry to avoid
penalties and fines. DFA protects the safety of the consumer and with the business. It is
important that it should be inspected by the authorities for us to know what are the does
and don’ts of the business and of the products. They also present what are the
documentary requirements so that business have license to operate from the agency. In
DFA they implement initial and renewal of the license. Initial is 2 years validity and
renewal is 5 years validity. This insures that the business follows the guidelines of the
agency. If the business would interfere for what is require it subject for closer and
suspension. And probably subject for penalties and fines.

DTI. DEPARTMENT OF TRADE AND INDUSTRY. I have learned that The Philippine
Department of Trade and Industry is the executive department of the Philippine
Government tasked as the main economic catalyst that enables innovative, competitive,
job generating, inclusive business, and empowers consumers. They also helps the
small medium enterprises and start uo business and young and young entrepreneurs on
how to handle business even though they have not taken any business courses. DTI
also ensures that all business is following the right suggested retail price ( SRP) and
maintain the market competition fair and square to both parties.

BIR. or the bureau of internal revenue helps the government collects taxes. The BIR is
important because they're agency's that monitors the businesses if they are compiling
and following the needed requirements and tax payers it is because taxes is the blood
of every government and country. I have learned the penalties and requirements
needed by the business and the responsibilities of the business owners to comply and
maintain.

FDA. FOOD AND DRUGS ADMINISTRATION. I have learned that the FDA helps the
governement ensures that the quality of products is safe and is responsible for
protecting the public health by assuring the safety, efficacy, and security of human and
veterinary drugs, biological products, medical devices, our nation's food supply,
cosmetics, and products that emit radiation. it also help the businesses maintain the
quality assurance of each product.

As an entrepreneur we must be aware of our responsibilities set bybthe government to

avoid penalties and to ensure the safety of our consumers.
