Purpose of the testimony: Plaintiff, BONIFACIO CRUZ is testifying to prove

that there was no Deed of Sale executed between him and defendant’s
employee, Aurelio Laxa, in favor of the latter.
 BONIFACIO A. CRUZ, of legal age, Filipino, a businessman, with
address at Sampaguita St., Tulip Drive, Matina, Davao City, after having
been sworn in accordance with law and fully conscious that I do so under
oath and that I may face criminal liability for false testimony or perjury by
way of answers to the questions propounded to me by Atty. Hannah Keziah
P. Dela Cerna, with office address at Dela Cerna, Ilagan, Paulma, Rosal
(DIPR) Law Firm, 8F Pryce Tower, Pryce Business Park, JP Laurel
Avenue, Bajada, Davao City, do hereby depose and state:

I, BONIFACIO A. CRUZ, 40 years old, single, Filipino, and residing at

Sampaguita St., Tulip Drive, Matina, Davao City, under oath, depose:

1. Q1 – Please state your name, age, residence, and occupation.

A1 – I am Bonifacio A. Cruz, 40 years old, married, residing at
Samapaguita St., Tulip Drive, Matina, Davao City. I am a
businessman.

A1: Ako po si Bonifacio A Cruz, 40 years old, kasal, naninirahan po
sa Samapaguita St., Tulip Drive, Matina, Davao City. Nagtatrabaho

2. Q2 – In what language do you want your examination to be

conducted?
A2 – I am used to speaking Tagalog, but English is also fine.

A2: Mas sanay po akong mag-Tagalog, pero okay lang din po pag
Ingles.)

3. Q3 – Why are you here today?

A3 – I am here to give a sworn statement by way of testimony
regarding the events that took place on November 21, 2019 when I
left my Cimmaron Jeepney at the Marcelo Lara’s shop for repair and
when the alleged Deed of Sale was executed.

(Q3: Bakit ka nandito ngayon?

A3: Andito po ako para tumestigo sa pamamagitan po ng
pagsasalaysay ng mga nangyari noong ika-21 ng Nobyembre 2019,
kung kailan iniwan ko ang aking Cimmaron Jeepney sa repair shop ni
Marcelo Lara at kung kailan di umano isinagawa ang Deed of Sale.)

4. Q4 – What happened on November 21, 2019?

A4 – I brought my Cimmaron Jeepney bearing Plate No LXX—349 at
Marcelo Lara’s shop, Ultra Speed Machine Shop and A’s Metal
Products located at Bajada, Davao City.

(Q4: Anong nangyari noong ika-21 ng Nobyembre 2019?

A4: Dinala ko po ang aking Cimmaron Jeepney na may Plate No.
LXX—349 sa Ultra Speed Machine Shop and A’s Metal Products sa
Bajada, Davao City. Ang shop po ay pagmamay-ari ni Marcelo Lara.)
5. Q5 – What else happened?
A5 – I spoke with the employee, Aurelio Laxa, about the possible
repairs to be done on my car. After, he invited me inside the office to
sign a paper. He assured me it was only to serve as a receipt for my
payment of the cost of repairs as the shop’s cashier was then out of
the shop.

(Q5: Ano pa ang ibang nangyari?

A5: Nagkausap kami ng isang empleyado, si Aurelio Laxa, patungkol
sa mga posibleng repair na isasagawa sa sasakyan. Pagkatapos ay
inimbitahan nya ako sa loob ng opisina para maglada sa isang papel.
Ang sabi nya ay iyon daw ay magsisilbing resibo para sa aking bayad
sa repair dahil wala sa pagkakataong iyon ang cashier ng shop.)

6. Q6 – What was the appearance of the paper?

A6 – It was a mere blank paper, attorney. Blank. He assured me he
will be filling out the details later. I signed the paper in confidence
since I have transacted with him multiple times already. He repaired
other cars I brought in the shop in the past.

(Q6: Ano po ang hitsura ng papel?

A6: Wala pong laman ang papel, attorney. Blangko po. Sabi ni
Aurelio ay isusulat nya ang mga nararapat na detalye pagkatapos.
Nilagdaan ko po ang papel dahil sa aking tiwala kay Aurelio. Siya rin
po kasi ang nagrerepair ng mga sasakyan na dinadala ko sa shop
noon pa.)

7. Q7 – Were there anyone else with you in the office at the time of the
signing of paper?
A7 – Yes, Ma’am. Marcelo Lara, the owner of the shop, was also
inside the office.

(Q7: May kasama ba kayo sa loob ng opisina noong oras ng

paglalagda ng papel?
A7: Opo Ma’am. Si Marcelo Lara po, ang may-ari ng shop, ay nasa
loob din po ng opisina.

8. Q8 – After the signing, what happened?

A8 – I was told I will be contacted when the repairs are already done.
I was also assured that I will receive the receipt on the same day.
After that, I left.

(Q8: Pagkatapos ng paglalagda, ano pa ang nangyari?

A8: Sinabihan po ako na tatawagan nalang ako kapag tapos na ang
repair at doon ko na rin makukuha ang resibo. Pagkatapos noon ay
umalis na po ako.)

9. Q9 – Were you able to receive the supposed receipt?

A9 – No, Ma’am. I was also not able to retrieve my car from the shop
until I was informed it figured into an accident. Later, I discovered
 that the same paper I was made to sign was forged into a Deed of
Sale to make it appear I sold it to the employee, Aurelio Laxa.

(Q9: Natanggap mo ba ang resibo?

A9: Hindi po, Ma’am. Hindi ko rin po nakuha ang aking sasakyan
hanggang sa malaman kong ito ay naaksidente na pala. Nalaman ko
nalang din po na ang papel na nilagdaan ko ay ginawa nilang Deed
of Sale para maipakita na ipinagbili ko ang sasakyan kay Aurelio
Laxa.)

A10 – The document was annexed in their Answer to the Complaint
I filed, Ma’am.

Complaint na aking isinampa.)
