“Good lawyers know the law, but great lawyers know the Judge.

” This statement for me is somehow


true. Obviously, you must first know the law before you become a lawyer. It only takes logic and the
right technique for you to win a case. This includes the familiarization with the Justice System and the
authorities behind it.

The relationship of logic and law as discussed in the works of Csaba Varga and Nicholas F. Lucas, taught
me the essence of legal technique and its importance when applied to in the Courts of Law. My
impression was, of course, we all need logic in our everyday lives in order to survive. It is same as true
with lawyers who need logic in order to survive a case. Respectively, the goal of logic in relationship to
law is to know the truth, based on facts and proof in pursuant to justice. If a lawyer thinks logically, he
would be able to determine if his client is telling the truth or not during counseling sessions. At some
point, the lawyer himself would know the remedy to do with his case and convince his client to tell the
truth for him to defend his client on court. Another situation, the Prosecutor must think logically in
order for him to determine whether there is a probable cause before filing an Information. Judges and
Justices too must know the principles of legal technique for them to arrive at a just ruling free from bias
and favor with respect to the truth.

Deduction is one of the tools in legal technique which fascinated me the most, it is useful especially
when winning an argument or claim. Adding facts or matters which are not related to the case, would
only make your claim vague and ambiguous, thus could lead to the dismissal due to irrelevant facts.

My view however, is that logic without imagination is useless. A lawyer may know the procedure and
the system. He may think critically in a logical manner. However, he does not know how to apply it when
he comes to court to present. He lacks the art of persuasion. Therefore, it could lead him to lose his
case. Logic is not just simply a science it is also an art.

Our laws are not only based on logical and legal principles. It is also based on sanctity and what is
ethical. As to contrary however, not all that is legal is ethical to some views of people. Ex. Law on same
sex marriage, legalization of cannabis sativa (marijuana), euthanasia etc. which other cultures find it as
taboo. A lawyer must also know his limitations when using legal technique and set boundaries with
respect to the customs and traditions of the State. As Csaba Varga quoted in his work “Legal technique
may be used, however only in one or other legal culture that delineates also the framework of tacit
conventions actually limiting from what and to what we can conclude at all.”

Furthermore, a logical lawyer for me is both artistic and ethical. He does not forget his principles in life.
Legal technique and logic are not only tools, but they serve as a lawyer’s weapon. Logic simply is the
search for truth. The essence of justice is for the truth to always prevail.
