AFFIDAVIT OF GUARANTEE

I, GENEROSO P. BATTUNG , of legal age, married, Filipino and resident of B1 L11,

Violago Parkwood Subd, Bgy. Silangan, Q.C., after having duly sworn to in accordance
with the law, hereby depose and state:

1. That I am the President and General Manager of Ultima Builders Corp., a

corporation duly organized and existing under the laws of the Philippines,
with principal office at 2/F UBC Bldg., National Rd., Violago Parkwood Hills
Subd., Bgy Silangan, Q.C.

2. That said company is a contractor and doing business with Maynilad Water
Service, Inc. ( MWSI) for the Pipe Replacement of 100mmdia PVc along P.
Pio, P. Paterno and H. del Trabajos Sts., Cavite City and herein covered by
Contract No. NC-6NW-SOIM-003-04.

3. That Ultima Builders Corporation guarantee workmanship and bind itself to

make good defects and to answer for any claim by the MWSI within the
period of one (1) year from date of final accepatance of the project;

4. That I have executed this Affidavit in compliance with the Close-Out

Requirement of MWSI for Contract No. NC-6NW-SOIM-003-04.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 6 th day of August

2005 in Quezon City.
