Chapter 62 Oregon Law s 2019 (HB 2325)
Relating to the Secretary of State’s duties as a f iling of f icer; creating new provisions;
amending ORS 56.016 and 56.140; and prescribing an ef f ective date.

(1) Notw ithstanding any provisions of ORS chapters 58, 60, 62, 63, 65, 67, 70, 554,
647 and 648 or ORS 128.560 (“Business trust” described) to 128.600 (Filing,
service, copying and certif ication f ees), 649.010 (Def initions f or ORS 649.010 to
649.080) to 649.080 (Unauthorized display of name or insignia of motor vehicle
association), 649.990 (Penalties) or 661.210 (Counterf eiting of union label and
possession or sale thereof prohibited) to 661.280 (Attorney f ees) relating to the
Secretary of State as the f iling of f icer:

(a) A document may be delivered to the of f ice of the Secretary of State f or f iling by
electronic f acsimile transmission if the original document is otherw ise
acceptable f or f iling.

(b) Any other reproduction of a document may be delivered to the of f ice of the
Secretary of State f or f iling if the original document is otherw ise acceptable f or
f iling.

(c) A document delivered under paragraph (a) or (b) of this subsection need not be
accompanied by a true copy of the document. Af ter f iling a document delivered
under paragraph (a) or (b) of this subsection, the Secretary of State shall
return an acknow ledgment of f iling to the domestic or f oreign business entity or
its representative.

(2) Subsection (1) of this section applies only to documents delivered to the of f ice of
the Secretary of State f or f iling under ORS chapters 58, 60, 62, 63, 65, 67, 70, 554,
647 and 648 and ORS 128.560 (“Business trust” described) to 128.600 (Filing,
service, copying and certif ication f ees), 649.010 (Def initions f or ORS 649.010 to
649.080) to 649.080 (Unauthorized display of name or insignia of motor vehicle

(3) The Secretary of State by rule may establish f ees f or receiving and sending
acknow ledgment of f iling of documents delivered f or f iling under this section. [1993
