SARMIENTO VS MISON

FACTS
Mison was appointed by Pres Aquino as the Commissioner of the Bureau of Customs.
Petitioners then questioned his appointment because it appears that his appointment
was not submitted to the Commission on Appointments for its approval. Sarmiento
insists that heads of bureaus, like respondent, require the approval of CA.

ISSUE
W/N heads of bureaus need the confirmation of CA for their appointment

RULING
NO.

Among the group of appointees by the President, only those heads of the executive
depts, ambassadors, other public ministers and consuls, officers of the armed
forces from the rank of colonel or naval captain, and other officers whose
appointments are vested in him in this Constitution are conditioned to the approval
of CA. Not being one of those enumerated, appointment of respondent need not the
approval of CA.
