WHEREAS the Seller/sellers wanted to sell the Open Plot under arazi No.-……………………… as

and the Purchaser being interested in purchasing the same has offered a SUM of Rs

NOW THIS AGREEMENT TO SELL WITNESSETH AS UNDER:

That the Seller shall sell the Open Plot under Arazi No.-………………………….. Situated at
revenue Mauza village ……………………………………………………………………………………………………

measuring about ………………………… sq. ft. in favors of the Purchaser for a total sale
consideration of Rs ………………………… out of which the Purchaser has paid the sum of Rs
…………………………… dated ……………………………. as advance, the receipt where of the Seller
hereby acknowledges.
1. That the Seller assures that the plot agreed to be transferred under this
agreement is free from all sorts of transfers, liens, court attachment and encumbrances
etc. and the Seller has every right and title to transfer the same in favor of the
Purchaser.
2. That all the taxes or any other dues, in respect of the said plot up to the date of
sale deed shall be borne and paid by the Seller and thereafter by the Purchaser.
3. That all the expenses for execution and registration of the sale deed shall be
borne and paid by the Purchaser.
4. That As per agreement to sell is mentioned that sale deed executed in her favour
within two month from the date of this agreement today for registered sale deed in
favour of Purchaser after paying the balance sale consideration to the Seller.
5. That in case of default on the part of the Purchaser in getting the sale deed
executed in their stipulated above, the Seller/Sellers shall have the right to forfeit the
advance paid under this agreement while in case of default on the part of Seller in
executing the sale deed in favour of the Purchaser, the Purchaser shall have the right to
get the sale deed executed in her favour through court of law by seeking specific
performance of this agreement.
6. That the actual Vacant physical possession of the plot has not been delivered to
the Purchaser by the Seller under this agreement the same shall be delivered at the time
of execution of the sale deed.
