1. What are the rights of persons arrested, defend or under custodial investigation?
o Article III, Section 12 of the 1987 Constitution (also known as the Bill of Rights) states that any
person under investigation for the commission of a crime or offense "shall have the right to be
informed of his right to remain silent and to have competent and independent counsel preferably
of his own choice."
o If you can't afford a lawyer, the state will provide you with one.
o The right to remain silent is emphasized because any statement you give can be used against you
in court.
o Likewise, it is your right to call or have access to a lawyer at all times throughout the ordeal of
arrest or detention.
o These rights cannot be waived "except in writing and in the presence of counsel," says the
Constitution.
2. What are the legal effects of violating the force cited rights?
o Section 11 of Article II of the 1987 Constitution of the Republic of the Philippines declares that
the State values the dignity of every human, person and guarantees full respect for human rights.
Pursuant to this declared policy, Section 12 of Article III of the Constitution prohibits the use of
torture, force, violence, threat, intimidation, or any other means which vitiate the free will and
mandates the compensation and rehabilitation of victims of torture or similar practices and their
families.

o three types of questions: (1) open ended, (2) specific, and (3) motivation questions.
4. What are the basic parts of sworn statement and explain each?
o There are several required elements of a sworn statement that ensure that the statement will be
accepted as a legal document. First, it is imperative that a sworn statement be as detailed as
possible, and written in the first-person. Exaggerations and opinions should be left out. All a
statement should consist of is straight facts, including events listed chronologically. The person
writing the statement should use his full, legal name, and he should date the document with the
date he signs it. One of the most important required elements of a sworn statement is the clause
at the bottom, in which the person making the statement acknowledges that the information he
has provided is true and complete to the best of his knowledge. This shows that he is aware that
he is asserting these facts under oath, and that he may be punished under penalty of perjury if he
is lying.
5. Give 5 methods of varying, are currently use by physician to determine time of death and explain
each?
o Body Temperature
Normal body temperature is 98.6 degrees Fahrenheit. After death, the body loses or gains
heat progressively until it equilibrates with that of the surrounding medium. Since corpse
temperature can be easily and quickly obtained (see page XX), the search for a formula
that uses this parameter to define the time of death has been sought for years. As early as
1839, English physician John Davey undertook the study of corpse heat loss in London,
and as late as 1962, T.K. Marshall and F.E. Hoare attempted to standardize this analysis
when they established a computerized mathematical formula known as the Standard
Cooling Curve. In the intervening years, and even since Marshall and Hoare, many others
have attempted to devise similar schemes. Unfortunately, none of these have proven to be
any more accurate than the current formula for heat loss of 1.5 degree per hour.
o Rigor mortis
(Latin: rigor "stiffness", and mortis "of death"), or postmortem rigidity, is the third stage
of death. It is one of the recognizable signs of death, characterized by stiffening of the
limbs of the corpse caused by chemical changes in the muscles postmortem.
o Livor mortis
refers to the bluish-purple discoloration (lividity) under the skin of the lower body parts
due to gravitation of blood after death. ... A prominent purple discoloration of subdermal
vessels appears later in the process of decomposition and leaves a marbling pattern.
o Putrefaction
Is the fifth stage of death, following pallor mortis, algor mortis, rigor mortis, and livor
mortis. This process references the breaking down of a body of an animal such as a
human post-mortem (meaning after death). ... The approximate time it takes putrefaction
to occur is dependent on various factors
o Cornea cloudiness
Is a transparent structure that covers the iris. Certain metabolic diseases, trauma,
infectious diseases, nutritional deficiencies and environmental situations may cause the
cornea to be less transparent and cloudy. If the cornea becomes cloudy, it can lead to
various degrees of vision loss
