Re: Demand Letter against C

Sir,

I am writing to you in behalf of my client, Mr. B, with whom you entered a contract
for the delivery to Mr. A one hundred and fifty (150) trophies on November 26, 2019 and an
additional five (5) to be delivered until December 7, 2019. Despite the timely delivery, all the
trophies turned out to be defective which served merely for picture taking purposes.

Pursuant to Article 1170 of the Civil Code of the Philippines, those who in any
manner contravene the tenor of the obligations are liable for damages. Stipulated in the
contract is your incumbent obligation to deliver trophies in good quality to Mr. A. Thus, the
delivery of defective trophies constitutes contravention of your obligation resulting to the
breach of contract with Mr. B.

In view hereof, you are hereby demanded for the payment of damages arising from
breach of contract in the amount of P P50,000 within fourteen days (14) days from this
letter’s date. Otherwise, I shall be constrained to resort to legal processes to recover the same
and to protect my clients’ rights and interest under said contract and applicable laws. In such
event, you shall be liable for the cost and expense. This letter serves as the LAST AND
FINAL DEMAND.
