COMPILATION OF LAWS CONFERRING JURISDICTION

2S (2016-2017)

1. PD 1606, as amended by RA 10660:

NOTE: This Law provides for the jurisdiction of the Sandiganbayan, however, in RA 10660 an EOJ
was granted to RTC as provided below.

NOTE: Under Sec. 4: “Provided, That the Regional Trial Court shall have exclusive original
jurisdiction where the information: (a) does not allege any damage to the government or any
bribery; or (b) alleges damage to the government or bribery arising from the same or closely
related transactions or acts in an amount not exceeding One million pesos (P1,000,000.00).”

2. RA 3019: ANTI GRAFT AND CORRUPT PRACTICES ACT

Sec. 10: Competent Court. Until otherwise provided by law, all prosecutions under this Act shall
be within the original jurisdiction of the Sandiganbayan.

3. RA 1379: ACT DECLARING FORFEITURE OF ILL-GOTTEN WEALTH OF PUBLIC OFFICERS AND


EMPLOYEES

Sec. 2: Filing of Petition. Solicitor General xxx shall file xxx in the court of First Instance of the
city or province where said public officer or employee resides or holds office.

NOTE: Repealed by amendatory laws giving exclusive original jurisdiction of cases involving RA
1379 to the Sandiganbayan.

4. RA 6713: CODE OF CONDUCT AND ETHICAL STANDARDS FOR PUBLIC OFFICIALS AND
EMPLOYEES

NOTE: There’s no express provision designating Sandiganbayan as having EOJ over violations of
this law. HOWEVER by virtue of PD 1606, as amended, Sec. 4 (b): “other offenses of felonies xxx
committed by public officials and employees mentioned in subsection a of this section in
relation to their office.

NOTE: Case is cognizable under the exclusive original jurisdiction of the Sandiganbayan pursuant
to Sec. 4, par. (a) of PD 1606, as amended.

6. RA 7080: PLUNDER LAW

Sec. 3: Until otherwise provided by law, all prosecutions under this Act shall be within the
original jurisdiction of the Sandiganbayan.

7. RA 9372: HUMAN SECURITY ACT OF 2007

Sec. 54 (8): 8. Request the Supreme Court to designate specific divisions of the Court of Appeals
and Regional Trial Courts in Manila, Cebu City and Cagayan de Oro City, as the case may be, to
handle all cases involving the crime of terrorism or conspiracy to commit terrorism and all
matters incident to said crimes. The Secretary of Justice shall assign a team of prosecutors from:
(a) Luzon to handle terrorism cases filed in the Regional Trial Court in Manila; (b) from the
Visayas to handle cases filed in Cebu City; and (c) from Mindanao to handle cases filed in
Cagayan de Oro City.

8. RA 7055: COURT MARTIAL JURISDICTION

Sec. 1: Members of the Armed Forces of the Philippines and other persons subject to military
law, including members of the citizens Armed Forces Geographical Units, who commit crimes or
offenses penalized under the Revised Penal Code other special penal laws, or local government
ordinances regardless of whether or not civilians are co-accused, victims, or offended parties
which may be natural or juridical persons, shall be tried by the proper civil court except when
the offense, as determined before arraignment by the civil court, is service-connected, in which
case the offense shall be tried by court-martial: provided, that the President of the Philippines
may, in the interest of justice, order or direct at any time before arraignment that any such
crimes or offenses be tried by the proper civil courts.

As used in this Section, service-connected crimes or offenses shall be limited to those defined in
Articles 54 to 70, Articles 72 to 92, and Articles 95 to 97 of Commonwealth Act No. 408, as
amended.

9. OMNIBUS ELECTION CODE

Sec. 268: Jurisdiction of courts. - The regional trial court shall have the exclusive original
jurisdiction to try and decide any criminal action or proceedings for violation of this Code,
except those relating to the offense of failure to register or failure to vote which shall be under
the jurisdiction of the metropolitan or municipal trial courts. From the decision of the courts,
appeal will lie as in other criminal cases.

10. RA 9344: JUVENILE JUSTICE AND WELFARE ACT OF 2006

NOTE: No express provision, but it can be correlated with RA 8369, Sec. 5 (a) on Family Court’s
Jurisdiction.

11. RA 9160: ANTI MONEY LAUNDERING ACT

Sec.5. Jurisdiction of Money Laundering Cases. – The regional trial courts shall have jurisdiction
to try all cases on money laundering. Those committed by public officers and private persons
who are in conspiracy with such public officers shall be under the jurisdiction of the
Sandiganbayan.

12. RA 9165, as amended by 10640: COMPREHENSIVE DANGEROUS DRUGS ACT OF 2002

Sec. 90. Jurisdiction. – The Supreme Court shall designate special courts from among the existing
Regional Trial Courts in each judicial region to exclusively try and hear cases involving violations
of this Act. The number of courts designated in each judicial region shall be based on the
population and the number of cases pending in their respective jurisdiction.

13. RA 10175: CYBERCRIME PREVENTION ACT

SEC. 21. Jurisdiction. — The Regional Trial Court shall have jurisdiction over any violation of the
provisions of this Act. including any violation committed by a Filipino national regardless of the
place of commission. Jurisdiction shall lie if any of the elements was committed within the
Philippines or committed with the use of any computer system wholly or partly situated in the
country, or when by such commission any damage is caused to a natural or juridical person who,
at the time the offense was committed, was in the Philippines.

There shall be designated special cybercrime courts manned by specially trained judges to
handle cybercrime cases.

14. RA 8369: FAMILY COURTS

Sec. 3. Establishment of Family Courts. - There shall be established a Family Court in every
province and city in the country. In case where the city is the capital of the province, the Family
Court shall be established in the municipality which has the highest population.

Sec. 5. Jurisdiction of family Courts. - The Family Courts shall have exclusive original jurisdiction
to hear and decide the following cases:

a) Criminal cases where one or more of the accused is below eighteen (18) years of age but not
less than nine (9) years of age but not less than nine (9) years of age or where one or more of
the victims is a minor at the time of the commission of the offense: Provided, That if the minor is
found guilty, the court shall promulgate sentence and ascertain any civil liability which the
accused may have incurred.

The sentence, however, shall be suspended without need of application pursuant to Ptesidential
Decree No. 603, otherwise known as the "Child and Youth Welfare Code";

i) Cases against minors cognizable under the Dangerous Drugs Act, as amended;

j) Violations of Republic Act No. 7610, otherwise known as the "Special Protection of Children
Against Child Abuse, Exploitation and Discrimination Act," as amended by Republic Act No.
7658; and

k) Cases of domestic violence against:

1) Women - which are acts of gender based violence that results, or are likely to result in
physical, sexual or psychological harm or suffering to women; and other forms of
physical abuse such as battering or threats and coercion which violate a woman's
personhood, integrity and freedom movement; and

2) Children - which include the commission of all forms of abuse, neglect, cruelty,
exploitation, violence, and discrimination and all other conditions prejudicial to their
development.

If an act constitutes a criminal offense, the accused or batterer shall be subject to criminal
proceedings and the corresponding penalties.

15. RA 8293: INTELLECTUAL PROPERTY CODE

Sec. 163. Jurisdiction of Court. - All actions under Sections 150, 155, 164, and 166 to 169 shall be
brought before the proper courts with appropriate jurisdiction under existing laws.

CORRELATE WITH: SEC. 27, RA 166:

Section 27. Jurisdiction of Court of First Instance. - All actions under this Chapter and Chapters
VI and VII hereof shall be brought before the proper Court of First Instance.
