Outdoor Patio Guidelines 2020

Extension of a restaurant business by way of an outdoor patio has been made possible through an
Emergency Order issued by the Province of Ontario.

This is available to owners of licensed food establishments/restaurants and review and approvals are
to be submitted by the business owner (with consent of the owner of building if not the same) to the
City of Dryden, Building and Planning Department.

Guidelines:

 A site plan sketch outlining the layout of the proposed temporary outdoor patio is to be
provided to the City at time of application and for property records.
 The patio must be delineated from the publicly travelled portion of the property. Line of
demarcation can be by a self-supported railing, posts with rope, planters or other barrier
system sufficient to protect. Any patio end railing should include reflectors or such for night
safety. Any access points must also be clearly delineated;
 The patio must be accessible and meet the applicable requirements of the AODA;
 All exits, fire department access routes and fire department connections remain unobstructed
and accessible, inclusive of fire hydrants (contact Dryden Fire Services with any questions 223-
1178);
 Obtain a building permit prior to constructing any structure that requires a building permit
under the Ontario Building Code Act (contact Building and Planning with any questions 223-
1140);
 Per COVID-19 regulations, ensure a 2m (6ft)distance between seating at separate tables.
AGCO requires a minimum of 1.1 square metres per person for occupancy.
 Umbrellas must stand at least 2.1m (7ft) above the walking surface;
 A fire extinguisher (minimum 2A-10BC) must be available within 15.2m (50ft) of any part of the
patio;
 CSA-certified electric or propane patio heaters (with max 20lb tank) are permitted where
located at least 3m (10ft) away from tree branches or other flammable material, operated per
the manufacturer’s directions and not stored on a road right-of-way when not in use. Solid gel
or liquid-fuel fire features are not permitted
 Patio furniture must be movable, but sturdy and heavy enough to withstand wind and
weather.
 The posted occupancy load of the applicable establishment will not at any time be
exceeded. This is specifically applicable once dining-in is permitted.
 The required number of designated Accessible parking spaces must remain available for
parking use.
 The business owner shall be responsible for maintaining the appearance of the patio and any
furniture of fixtures. No litter, garbage or similar accumulations can exist on or around the
patio;
 Any consideration to the use of public parking spaces or City Sidewalks is at the discretion of
the City of Dryden and proof of insurance, WSIB certificate and valid business and liquor
licensing must be provided.
 Temporary patios permitted under this guideline shall extend no later than January 1, 2021 at 3
a.m. but should contraventions with this guideline and/or COVID-19 regulations occur, the City
may terminate these permissions upon 24 hours notice;
 The Chief Building Official and Dryden Fire Service are authorized to inspect all temporary
patios and require adjustments to the patio in order to address compliance with these
guidelines.

This application requests a temporary outdoor patio permitted to operate on private property
up to and including January 1, 2021. The establishment owner(s) are required to abide by the
regulations imposed by the NWHU, the AGCO and Liquor Licensing Act. Inspection will follow
after submission of this application. Compliance is to be achieved to the satisfaction of the
City of Dryden. A letter of support or denial will be issued upon review and inspection.

applicant authorization to apply for a temporary outdoor patio.
