POWER TO CREATE EXECUTIVE OFFICES OR REORGANIZE THE GOVERNMENT

Presidential power to create investigating bodies: Pursuant to his duty to faithfully


execute the law, the President has the power to conduct investigations and create
an ad hoc investigating body: The creation of the Philippine Truth Commission finds
justification under Section 17, Article VII of the Constitution, imposing upon the President the
duty to ensure that the laws are faithfully executed. The President’s power to conduct
investigations to aid him in ensuring the faithful execution of laws – in this case, fundamental
laws on public accountability and transparency – is inherent in the President’s powers as the
Chief Executive. As explained in the landmark case of Marcos v. Manglapus, the powers of the
President cannot be said to be limited only to the specific powers enumerated in the
