This INSTRUMENT made and executed in the City of Pagadian, this __ day of ___, by
and among:
(1) HELEN BERBANIA, of legal age, married to Emeliano Quiao, Filipino citizen and
a resident of Pagadian City.
(3) ALVIN QUIAO, of legal age, single, Filipino citizen and a resident of Pagadian City.
(4)ELLEN PARAN, of legal age, married to Ivan Lloyd M. Paran, Filipino citizen and a
resident of Pagadian City. hereinafter known and referred to as the VENDORS;
WITNESSETH THAT:

A parcel of land (Lot 6) of the subd. plan Csd-09-001816-D-OL/T being a D-OL/
T being a portion of Lot 581, Pls-119, Pagadian Public Land Subdivision, situated in the
barrio of Tulawas, City of Pagadian, Island of Mindanao. Bounded on the NE., line 3-4
Lot 50, on the SE., line 4-1 by Lot 7, on the SW., line 1-2, on the NW., line 2-3, both of
lot Lot 5, all of the subd. Beginning at a point marked “1” on plan being S. 80 deg. 32’E.,
3291.92 m. From NLLM No. 9, Pls- 119. Thence.,N. 42 deg.49’W., 19.91 m. to point 2;N.
68 deg.09’E., 20.72 m. to point 3;S. 37 deg. 34’E., 20.32 m. to point 4;S. 71 deg. 05’W.,
19.12 m. to point of beginning, containing an area of THREE HUNDRED SEVENTY
SEVEN (377) SQ.M. All points referred to are indicated on the plan and marked on the
ground by OLT cyl. conc. mone., 15 x 60 cms., bearings true; date of original survey July
1 to December 31, 1951 and that of the subd. survey executed by Engr. Abelardo P.
Corpuz on March 30-31, 1987.
WHEREAS, the parties thereto are the compulsory heirs of the decedent, who are all in
legal ages and have the capacity to succeed the entire estate of the deceased.
WHEREAS, there are no known debts or obligation due against the state of said
decedent.
WITNESSETH FURTHER: THAT:
WHEREAS, it is known to the collective wishes of the heirs, they being the direct
compulsory heirs through their right of representation, being the direct descendants of,
who are called by law to succeed the inheritance mentioned hereof, that instead to
adjudicate, divide and partition the above- described real property among themselves,
the same would be entirely sold to the VENDEE, MERLYN R. VILLAHERMOSA,
widow, and resident of Unit 3G, Capri Condominium, Alabang, Muntinlupa City;
NOW THEREFORE, for and in consideration of the foregoing premises, and invoking
the provision of Section 3, Rule 74 of the Rules of Court, and likewise, the parties hereto
have agreed they hereby voluntarily do so agree, that their respective shares in the
partition as above mentioned, shall be sold entirely to the vendee and to forever
surrender, transfer and quit claim any ownership and interest over the aforesaid
property.
